December 19, 1978
The Council of Bal Harbour Village met Tuesday, December 19, 1978,
at 9:30 A.M. in the Village Hall.
Present: Messrs. Beatty, Davis, Krez, and Printup
Absent: Mr. Taplin
Also present were Fred W. Maley, Village Manager; Mary T. Wetterer,
Village Clerk; and Alas S. Gold, Village Attorney.
On motion of Mr. Davis, seconded by Mr. Beatty and voted the minutes
of October 31, 1978, were approved as submitted. On motion of Mr. Beatty,
seconded by Mr. Davis and voted the minutes of November 14, 1978, were
approved as submitted.
Mr. James Sims appeared regarding the storm sewer extension project.
It was agreed that they would try to finish one section before starting
another and have the streets cleaned up before the holidays.
Mr. Gold reported that the Supreme Court of Florida denied the petition
of the City of Miami Beach to review the lower court's decision that inter-
city water rates are under the jurisdiction of the Metro Water and Sewer
Board. Retroactive rates have not been set and the City of Miami. Beach
has asked for a rehearing on the Third District Court ruling, also assigning
this to the Water Board.
Mr. Ed O'Hara of Florida Power and Light Company discussed with the
Council various ways of upgrading the street lighting in the Residential
District. The Council requested Florida Power and Light Company to sub-
mit a written proposal outlining various alternatives to be considered at
a future meeting.
Mr. Maley reported that our external auditors have recommended that
a special audit be conducted of the Resort Tax collectors, as this has not
been done for ten years. They suggested that the audit be done on three
or four major properties covering the last three years, at a cost of
approximately $13,000.00. It was moved by Mr. Davis, seconded by Mr. Beatty
and voted that two oceanfront and one smaller property be audited.
Mr. Maley said that Wallace, McHarg, Roberts and Todd had asked if we
could reimburse them for their cost overrun on the Business District Zoning
study, which amounted to $2,701.00. It was moved by Mr. Davis, seconded by
Mr. Beatty and voted that due to the extra demands we made on them that we
pay $2,000.00 to defray some of their expenses.
Mr. Maley read a letter from the Water's Edge Apartments requesting
the Village to allow them to mark off and utilize the end of Bay Drive
for parking for their building. Mr. Maley recommended that the request be
denied as there was space on their own lot that could be used with repaving.
It was moved by Mr. Krez, seconded by Mr. Beatty that the request be denied.
Mr. Krez and Mr. Beatty voting 'yes'; Mr. Davis and Mr. Printup voting 'no'.
Due to the tie vote the matter will be considered again at the January meeting.
A letter from Mayor Haber of Miami Beach requested a pledge of
financial assistance to help finance the Republican National Convention on
which they are bidding. It was suggested that we might consider assistance
if the convention selects Miami Beach. Mr. Maley was asked to get a copy
of the City of Miami resolution covering this matter and Mayor Printup said
he would write Miami Beach a letter saying that we would make a decision in
January.
Mr. Maley explained that the permit for the Bal Harbour 101 Building had
been issued under a Court Order in spite of our zoning infractions shown
on the plan. The building is now almost complete and their garage entrances
will allow passenger vehicles only, as the overhead clearance is too low to
permit delivery trucks, or our garbage trucks, entrance to the building. He
said that the owners will have to devise some way of wheeling the garbage
bins to the front driveway for pickup. Mr. Gold explained to Mr. Desharnais,
the Village Building Inspector, that as of January 1, 1979, he should make
detailed notes of the status of construction in each unit of the building
with pictures in case of a protest regarding whether or not the building
should be on the 1979 tax roll. He asked Mr. Desharnais to have a Dade
County tax assessor do this with him. He said all partial Certificates of
Occupancy requested should be issued before the first of the year, if they
comply with South Florida Building Code.
Mr. Gold said that the County is working of the Balmoral case and that
it will take some time to prepare the case properly.
Mayor Printup passed out a publicity release prepared by Bill Kofoed
for the Tourism Department.
Mr. Maley was excused and on motion of Mr. Davis, seconded by Mr. Beatty,
and voted, he was granted a $1,000 bonus in lieu of sharing in the Employees
Christmas Fund.
There being no other business the meeting was adjourned at 11:50 A.M.
