HomeMy Public PortalAbout1986-020Member e moved its adoption: introduced the following resolution and CITY OF MEDINA RESOLUTION NO. off RESOLUTION GRANTING A CONDITIONAL USE PERMIT TO BRUCE NEUMANN TO PERMIT THE OPERATION OF A REPAIR GARAGE WHEREAS, Bruce Neumann (Applicant) owns property located at 25 Hamel Road and legally described as Lot 1, Hamel Legion Park, Hennepin County, Minnesota which is .zoned urban commercial (UC); and WHEREAS, Applicant has applied to operate a repair garage at the property; and WHEREAS, Section 826.55 of the Medina Code of Ordinances permits repair garages within the UC district provided the City Council grants a conditional use permit; and WHEREAS, the proposal has been reviewed by the Planning Commission and City Council for compliance with ordinance stan- dards. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Medina that the proposed repair garage is consistent with the City's zoning ordinance and will not impede the development of adjacent properties and that a conditional use permit for same is hereby granted, subject to the following conditions: 1. The repair garage shall be screened from public view by the fence currently in place on the property and by the landscaping to be planted in accordance with the attached plan. The Applicant shall install all landscaping materials by no later than June 1, 1986. The fence and landscaping materials shall be maintained in good condition throughout the duration of this conditional use permit. 2. The hours of operation of the repair garage shall not exceed 6:00 a.m, to 10:00 p.m. daily. 3. The City Council may review the condition of the property in five years and may require that the driveway be blacktopped. 4. The Applicant shall remove or relocate the gas storage tank from the property by no later than July 1, 1986. Any storage of flammable liquids on the property thereafter shall be done in compliance with all state and city codes. 5. The Applicant shall dedicate or convey to the City easements for right-of-way purposes along Brockton and Hamel Road acceptable to the zoning administrator and city attorney. 6. The Applicant shall combine Lot 1, Hamel Legion Park with Lots 1 and 2 and that part of Lot 3 which is southeasterly of a line drawn from a point in the northerly line of said Lot 3 distant 40 feet southeasterly from the northwesterly corner thereof to a point in the southerly line of said Lot 3, distant 50.5 feet southeasterly from the southwesterly corner thereof, all in Block 6, Plat of Hamel, Hennepin County, Minnesota. BE IT FURTHER RESOLVED by the City Council of the City of Medina that a violation of any of the above conditions shall be deemed to be a violation of the Medina zoning ordinance and may result in modification or revocation of this conditional use permit.
