HomeMy Public PortalAbout09-7458 Constructing Green Single Family Residential Units Sponsored by: City Manager RESOLUTION NO. 09-7458 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF OPA-LOCKA, FLORIDA, DECLARING TWO (2) VACANT CITY-OWNED PROPERTIES, IDENTIFIED BY FOLIO NUMBERS 08-2121-007-1041 AND 08-2122-007-0270 AS SURPLUS PROPERTIES; AUTHORIZING THE TRANSFER OF SAID SURPLUS PROPERTIES FOR THE PURPOSE OF CONSTRUCTING "GREEN" SINGLE- FAMILY RESIDENTIAL UNITS; FURTHER AUTHORIZING THE CITY MANAGER TO ENTER INTO AND EXECUTE AN AGREEMENT FOR THE TRANSFER OF SAID PROPERTIES TO THE MIAMI-DADE AFFORDABLE HOUSING FOUNDATION, INC. ("MDAHF"), CONTINGENT UPON CERTAIN CONDITIONS, IN A CONTRACT FORM ACCEPTABLE TO THE CITY ATTORNEY WHEREAS, the recent housing crisis is making it increasingly difficult for low-income families to purchase an affordable home that meets the minimum housing standards in the City of Opa-locka("City") and surrounding communities of Miami-Dade County; and WHEREAS, the City Commission of the City of Opa-locka ("City Commission") is actively promoting "Green" building standards in an effort to build sustainable neighborhoods by increasing the energy efficiency and reducing negative environmental impact; and WHEREAS, on July 23, 2008 the City Commission adopted Resolution 08-7315, authorizing the City Manager to pursue measures to become a "Green Local Government" through improved environmental performance, using criteria and standards developed by the Florida Green Building Coalition; and WHEREAS, the Miami-Dade Affordable Housing Foundation, Inc. ("MDAHF"), in conjunction with Miami-Dade Housing Finance Authority, is working to alleviate the shortage of housing in Miami-Dade County by stimulating the construction of affordable residential properties; and Resolution No. n 9-7 4 58 WHEREAS, MDAHF is proposing construction of "Green" affordable single-family homes as part of an affordable housing project within the City; and WHEREAS, MDAHF has requested that the City donate and transfer two (2) City- owned vacant parcels located on West Superior Street (identified by Folio # 08-2121-007-1041) and NW 143rd Street (identified by Folio # 08-2122-007-0270) to MDAHF, in a joint partnership with the Miami-Dade Housing Finance Authority, for construction of "Green" affordable single-family homes; and WHEREAS, the City Manager is recommending that the City Commission declare the City-owned vacant parcels located on West Superior Street (identified by Folio # 08-2121-007- 1041) and NW 143rd Street (identified by Folio # 08-2122-007-0270) as surplus property; and WHEREAS, the City Manager is further recommending that the City Commission declare its intent to authorize the donation and transfer of the properties to MDAHF subject to the conditions that construction of the "Green" affordable single-family homes be completed within a period of twelve (12) months from the passage of this resolution and are maintained as affordable for a period of at least ten (10) years based on standards established by Miami-Dade County; and WHEREAS, the City Manager hereby recommends that if MDAHF does not complete construction of"Green" affordable single-family homes within a period of twelve (12) months from the passage of this resolution that the City Commission rescind its action to deed the property and that the property revert, in all respects, back to the City without further action of the Commission; and WHEREAS, it is the intent of the City Commission that the City Manager and staff be involved in all aspects of the planning and development of the affordable housing project. Resolution No. 0 9-7 4 5 8 NOW, THEREFORE, BE IT DULY RESOLVED BY THE CITY COMMISSION OF THE CITY OF OPA-LOCKA, FLORIDA: Section 1. The recitals to the preamble are hereby incorporated by reference. Section 2. The City Commission of the City of Opa-locka hereby declares the City- owned vacant parcels located on West Superior Street (identified by Folio # 08-2121-007-1041) and NW 143`d Street (identified by Folio # 08-2122-007-0270) as surplus property. Section 3. The City Commission of the City of Opa-locka hereby authorizes the City Manager to enter into and execute an Agreement for the transfer of two (2) vacant City-owned parcels located on West Superior Street (identified by Folio # 08-2121-007-1041) and NW 143rd Street (identified by Folio # 08-2122-007-0270), between the City of Opa-locka and the Miami- Dade Affordable Housing Foundation, Inc. ("MDAHF"), in a joint partnership with the Miami- Dade Housing Finance Authority, in a contract form acceptable to the City Attorney, subject to the conditions that construction of the "Green" affordable single-family homes be completed within a period of twelve (12) months from the passage of this Resolution and that the properties remain "affordable" by the standards established by Miami-Cade County for a period of at least ten (10) years. Description: Staff has identified two (2) city surplus properties where single-family residential dwellings can be built according to the Green Building specifications. Both of these properties are vacant, one located on West Superior Street (Folio# 08-2121-007-1041 and the other on 143rd Street (Folio# 08-2122-007-0270). The recommendation is to authorize the City Manager to release both City-owned properties to Miami-Dade Affordable Housing Foundation, Inc in a joint partnership with Miami-Dade Housing Finance Authority to build a 2,200 Sq.Ft - three bedrooms and two bathrooms or four bedrooms and two bathrooms Green residential units, including a garage on the vacant properties. Financial Impact: Positive financial impact. Increase in Ad Valorum Tax. Implementation Time Line: Residential Units are expected to be completed by February 2010. Legislative History: Resolution No. 08-7315 Recommendation(s): Staff recommends the approval to transfer two (2) city owned surplus properties corresponding to Folio numbers 08-2121- 007-1041 and 08-2122-007-0270 to Miami-Dade Affordable Housing Foundation, Inc in conjunction with Miami-Dade Housing Finance Authority for the purpose of constructing Green Single-Family Residential Units. The resolution approving the transfer of property should include a restricted covenant (clause for contract) that stipulates a time frame for the completion of project within twelve months. If the project is not completed with the stipulated timeline both properties will be reverted back to the city. Analysis: Due to the recent housing crisis and limited income, families are finding it increasingly difficult to own a home that is affordable and meets minimum standards. It light of the aforementioned, the city wants to take a proactive step to provide residents the opportunity to live the American Dream of homeownership through a partnership program with Miami-Dade Affordable Housing Foundation, Inc and Miami-Dade Housing Finance Authority. This agenda item is a request to the City Commission to build affordable green single-family residential units on two (2) city-owned vacant properties while revitalizing the city neighborhood. The first property is located on West Superior Street (Folio# 08-2121-007-1041 and the other on 143rd Street (Folio# 08-2122-007-0270). The purpose of the aforementioned joint partnership is to build owner occupied residential dwellings for qualifying low-income families. Preference will be given to applicants that are currently residing in the city or employed by the City of Opa-locka. The Miami-Dade Affordable Housing Foundation, Inc. has established a Home Buyer Club, which is an educational and counseling home ownership program that walks applicants through the home buying process. Once the applicants have completed the program they will receive a Certificate of Training Voucher. The certificate voucher is good for 1 year or as long as they remain an "Active" member with the Club and is redeemable for the actual Certificate which is sent to the Bank Lender (upon request) when they are ready to purchase their home. The certificate verifies that they have completed the mandatory training for First Time homebuyers and may qualify you for subsidy assistance programs available in Dade County. The intent is to construct two three bedrooms and two bathrooms or four bedrooms-two bathrooms, of approximately 2,200 Sq.Ft Green units including garage space. Green building is the practice of increasing the efficiency with which buildings use resources — energy, water, and materials —while reducing building impacts on human, health and the environment during the building's lifecycle, through better siting, design, construction and maintenance. Miami-Dade Affordable Housing Foundation, Inc. —Homebuyer's Club The Club is a non-profit homeownership counseling service of the Miami-Dade Affordable Housing Foundation, Inc. created to prepare families to acquire and maintain a home. The Foundation is a HUD approved Housing Counseling Agency with NRI certified counselors. About the Club The Home Buyer Club is an educational and counseling home ownership workshop that walks you through the home buying process. Once you have completed the workshop you will receive a Certificate of Training Voucher. The certificate voucher is good for 1 year or as long as you remain an "Active" member with the Club and is redeemable for the actual Certificate which is sent to your Bank Lender (upon request)when you are ready to purchase your home. This certificate verifies you have completed the mandatory training for First Time homebuyers and may qualify you for subsidy assistance programs available in Dade County. Requirements Clients must be Miami-Dade County residence with a desire to live in Dade County; can not have a mortgage in your name for less than three years; must have three years of verifiable income. Club Services There is a $20 fee for the credit report and a$25 processing fee payable by money order or cashier's check to the Miami-Dade Affordable Housing foundation, Inc. There is a $50.00 registration fee for Homebuyer Education and counseling services provided by The Club. You will receive a$25 refund from the registration fee in exchange for your HUD-1 Closing Statement once you have purchased your home. Counseling services are provided on an individual and confidential basis. To Get Started 1. Complete application and gather documents to verify your income, employment and savings. 2. Schedule an appointment with your home ownership counselor. 3. Attend a Homebuyer Education Workshop 4. Take the necessary steps to repair your credit. 5. Start a savings plan for your future house.
