HomeMy Public PortalAbout1986-024Member moved its adoption: introduced the following resolution and CITY OF MEDINA RESOLUTION NO. 0 Cam- c2? i " RESOLUTION AMENDING A CONDITIONAL USE PERMIT FOR WILLIAM NUNN AND CAREY RADTKE TO OPERATE A HORSE STABLE WHEREAS, William Nunn and Carey Radtke (Operators) obtained a conditional use permit in January, 1983 to operate a horse stable at 2825 Willow Drive, which property is legally described on Exhibit A attached hereto; and WHEREAS, the Operators have applied for an amendment of the terms and conditions under which the conditional use permit was originally issued; and WHEREAS, the proposal has been reviewed by the Planning Commission and City Council for compliance with zoning ordinance standards. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Medina, Minnesota that the horse stable is consistent with the requirements of the Medina zoning ordinance relating to land located in the Rural Residential district and will not impede the development of adjacent property and that an amended conditional use permit for same is hereby granted, subject to the following conditions: 1. The maximum number of horses permitted to be housed at the stable, including the paddock and stable areas, shall not exceed 38 horses. Up to an additional five horses may be permitted at the stable for lessons on a daily basis. 2. Indoor sanitary facilities in the barn shall be provided to accommodate the customers and employees of the stable. The City may require additional temporary sanitary facilities for any special event held at the stable. 3. The City shall be notified at least two weeks prior to any special event held at the stable. For the purposes of this permit, "special event" shall mean any activity which is expected to attract 25 or more persons to the site. 4. Driveway and off-street parking areas shall be constructed and maintained to accommodate all trailers and vehicles brought onto the property. Plans of said driveway and parking areas shall be submitted to and approved by the City Engineer prior to construction. All parking associated with the operation of the stable shall be designated, off-street sites and no parking shall be permitted on or along the right-of-way of Willow Drive. 5. The Operators shall enter into an agreement with the Minnesota Pollution Control Agency (MPCA) to govern the terms of disposal and collection of horse manure. Manure accumulated through operation of the stable shall be stored in areas designated or approved by the MPCA. Manure shall be removed from the stable at a minimum of once every six months. The Operators shall also enter into and provide the City with a written agreement governing the off -site dis- posal of manure. 6. A bond in the amount of $13,200 shall be furnished to the City to guarantee removal of the manure accumulation on the site. 7. The hours of operation of the horse stable shall not exceed 9:00 a.m. to 9:00 p.m., Tuesday through Sunday. 8. The Operators shall post the Medina Horse Owners' Asso- ciation Rules in a location accessible to all persons using the stable. 9. The Operators shall be responsible for informing and con- trolling the customers using the stable to prevent trespass- ing on adjoining property. 10. The Operators shall comply with all provisions of the Medina Zoning Code. 11. There shall be a maximum of three full-time employees at the stable. 12. The total number of accessory structures to be located on the property shall not exceed three, they shall not exceed an aggregate size of 20,250 square feet and they shall be located a minimum of 150 feet from all property lines. 13. There shall be no outside storage except for licensed vehicles and a manure spreader, which shall be screened from public view. 14. Any signs which the Operators may construct shall comply with the requirements of the Medina sign ordinance for Rural Residential districts. 15. There shall be no outside public address system. 16. The Operators shall install and maintain fencing adequate to contain the horses in a secure manner. BE IT FURTHER RESOLVED by the City Council of the City of Medina that violation of any of the above conditions shall constitute a violation of the conditional use permit and of the Medina zoning ordinance. EXHIBIT A That part of the South 660 feet of the East 991 feet of the Southeast Quarter of the Northeast Quarter of Section 16, Town- ship 118 North, Range 23 West of the Fifth Principal Meridian, lying West of the following described line: Beginning at a point on the East line of said Southeast Quarter of the Northeast Quarter distant 895 feet North from the Southeast Corner of said Southeast Quarter of the Northeast Quarter; thence South along said East line a distance of 100 feet; thence along a tangential curve to the right having a radius of 575 feet and central angle of 38 degrees 20 minutes a distance of 384.70 feet; thence Southwesterly tangent to said curve to the South line of said Southeast Quarter of the Northeast Quarter and there ending.
