APPROVING PROFESSIONAL SERVICES CONTRACT,
JAMES F. CLARKIN, III
WHEREAS, the Borough of Carteret is in need of professional legal services
with regard to affordable housing is~ues ("COAH") in the Borough;/nd
WHEREAS, James F. Clarkin, III, of the law firm of Clarkin & Vignuolo, llOO
CenteIll1ial Avenue, Suite 203, Piscataway, NJ 08854 possesses the requisite
experience and expertise to provide said specialized legal services; and
WHEREAS, James F. Clarkin, III has proposed to perform said services at an
initial cost not to exceed $1,500.00, with an hourly rate of$150.00; and
WHEREAS, the Chief Financial Officer has certified that funds are or will be
available for said purpose.
NOW, THEREFORE, BE IT RESOLVED by the Mayor and Conncil of the
Borough ofCarteret that James F. Clarkin, III, is hereby appointed as special legal
counsel in regard to affordable housing issues in the Borough for an initial
maximum cost not to exceed $1,500.00.
BE IT FURTHER RESOLVED, that this action is approved as a professional
services contract pursuant to NJ.S.A. 40A:1l-5(l)(a) in accordance with the
Borough's Fair and Open Process as authorized by law.

Dear Mayor Reiman:
Pursuant to our conversation on January 22, 2008, this letter represents our firm's
proposal to perform the preliminary work necessary to consider the Borough's appropriate
response with respect to affordable housing issues. At this time I would respectfully
request an authorization not to exceed $1,500.00, with an hourly rate of $150.00. If this
is acceptable, please refer to the Council for adoption for a resolution.
