Land Use Application Reviews
A) Woods of Medina Preliminary Plat — Jeff Pederson has requested preliminary plat and rezoning
to subdivide 9.5 acres (8.8 net acres) at the intersection of CR116 and Shawnee Woods Road
into 16 R1 single family lots. The request includes a vacation of a portion of Shawnee Woods
Trail and a partial waiver from tree preservation requirements. The Planning Commission held
a Public Hearing at the November meeting and recommended approval. The application is
tentatively scheduled to be presented to the City Council at the December 17 meeting.
B) D.R. Horton Stage I Plan — D.R. Horton has requested Stage Plan I approval for development
of Mixed Use property west of Arrowhead, east of Mohawk and north of Highway 55. The
entire property is approximately 84 acres in area (approximately 59 acres upland) and the
applicant proposes 85 single family lots, a 54 unit apartment building and 5 acres of commercial
development. The Planning Commission held a Public Hearing at the September 10 meeting
and recommended substantial changes to the Stage I Plan and denial as presented. The applicant
has updated the Stage I Plan, and the Planning Commission reviewed at the October 8 meeting.
The Commission recommended approval with a number of changes, including reducing the
height of the apartment building and incorporating additional type(s) of housing. Staff is in
discussion with the DNR related to the extension of Chippewa Road, and the applicant has
granted an extension in order to allow the City to continue these conversations. The application
is tentatively scheduled for review by the City Council at the January 7 meeting.
C) Fawn Meadows subdivision — east of CR 116, north of Medina Lake Drive — Money Tree, LLC
has requested a preliminary plat and rezoning for the development of the 10 acres (5.72 net
acres) immediately north of the Toll Brothers Reserve of Medina project. A Public Hearing was
held at the September 10 Planning Commission meeting, and the applicant requested that the
Commission table the application to allow them to address staff comments.
D) Wakefield Subdivision — 3385 County Road 24 — The Wakefield Family Partnership has
requested approval of a rural subdivision of 74 acres at the southeast corner of Homestead Trail
and County Road 24. The applicant has submitted additional information for review, and a
Public Hearing will be scheduled when it is deemed complete.
E) St. Peter and Paul Cemetery CUP — St. Peter and Paul church intends to expand their cemetery
at the southeast corner of County Road 19 and Hamel Road. Improvements include new access
drives, landscaping, stormwater improvements and additional grave sites. The Planning
Commission held a Public Hearing at the July 9 meeting and recommended approval. The
applicant requested that the Council delay review until they could work through some of the
conditions.
F) Hartray Lot Combination — 4035 Apache Drive — the property owner has requested approval of
a lot combination of two lots which do not meet minimum lot size standards in order to create a
lot which is less non -conforming. The combination will also allow the construction of a new

septic system, because the only potential location lies across the common lot line. The request
is incomplete for review at this time, and will be presented to the Council when complete.
G) Lennar Variance — 3032 Basswood Road — Lennar has requested a variance from 7.5 feet to 5.0
feet for the side setback for the first detached townhome constructed in the Enclave at Brockton.
The home was constructed following the wrong setback requirements of the PUD, and staff did
not catch the error during the permit review. The City Council adopted a resolution of approval
at the November 19 meeting. This project will now be closed.
H) Three Rivers Park/Reimer Lot Rearrangement — the property owners have requested a lot
rearrangement to allow a "land swap" of property which the Reimers own on the west side of
Homestead Trail and which Three Rivers owns on the east side of Homestead Trail. The City
Council reviewed at the August 7 meeting and adopted a resolution of approval at the August 20
meeting. Staff will work with the owners to finalize the conditions of approval.
I) Morrison Lot Split and Variance — Truxtun and Adrienne Morrison have requested to
subdivide their 18 acres at 1525 Hunter Drive into two lots. The City Council approved of the
division at the June 4 meeting. Staff will work with the applicant to finalize the terms and
conditions of the approval.
J) Brede Estate Plat — The Estate of Caroline Brede has requested to re -plat property at 2921 and
2929 Lakeshore Avenue in the Independence Beach neighborhood. The applicant proposes two
lots on approximately an acre of property. Granting right-of-way for Lakeshore Ave. causes the
existing garage to no longer comply with front setback requirements, so the applicant has also
requested a variance. The Commission recommended approval of the variance. The City
Council adopted resolutions granting approval at the October 15 meeting. Staff will work with
the applicant to finalize the conditions of approval.
Other Projects
A) Storm water Utility — staff is working on updating stormwater utility billing information
(Residential Equivalent Factors) for Finance.
B) City Hall space planning — staff has designed a potential layout for City Hall and will be
looking to begin work with an architect on renovation plans.
C) On -going Litigation — Staff continues to be involved in discussions related to on -going
litigation.

33 Sparks presented report. The subject parcel is a wooded property south of Reserve
34 project. The property is guided low density residential, intended to be developed
35 under R1 designation. The applicant proposes to rezone the property to R1,
36 which would be consistent with Comp Plan. Sparks stated that there are two lots
37 off of the cul-de-sac are flag lots which are not exactly radial to the cul-de-sac as
38 required by city code. He noted that these lots have double frontage, but are
39 prohibited access off of County Road 116. Sparks also noted that flag lots were
40 platted off of the end of cul-de-sacs within the Foxberry neighborhood. Sparks
41 noted that the applicant is requesting a waiver from the full tree replacement
42 requirements because the site is so wooded and cannot be developed with single -
43 family homes without substantial removal. Sparks stated that staff worked with
44 the applicant on various alternatives to try to limit tree impacts and one of the best
45 alternatives was presented in the plans. Even this plan with clustered house and

46 alternative stormwater treatment required 38% of the trees on the site to be
47 removed. Staff believes it may make sense to exempt 38% of the tree removal,
48 recognizing that this amount is necessary even with substantial efforts to save
49 trees. Any removal above this amount could be replaced as required by code.

51 Nolan inquired about the possibility of extending the sewer line. He stated that the
52 cost of extending the line on a case -by -case basis if septic systems failed would
53 likely be prohibitive.

55 Finke stated that is has not been the City's practice to require the extension of sewer
56 lines as a condition of development for the purpose of bailing -out failing septic
57 systems on neighboring parcels.

59 Nolan inquired how much farther it would be to extend the pipe down Shawnee
60 Woods. Finke stated it was approximately 1500 feet. Nash stated that the cost
61 would be $25-$30 / foot, plus manholes.

63 Foote inquired where all of the replacement trees would be planted.

65 Nash responded that they would fit as many as possible, but would negotiate with the
66 City Council about a cash in -lieu payment of planting many of the trees.

68 R. Reid inquired if the developer had chosen a builder. Nash responded that they had
69 not, and are trying to get preliminary plat approval.

73 Eric Voltin of 630 Shawnee Woods stated that they were not opposed to the proposal.
74 While they do not like the fact that Shawnee Woods Road will be cut off, that is
75 not the developer's decision. He said that tree preservation is the primary
76 concern, especially related to the future development of the Golf Course property
77 to the south. He stated that any variance should be very strict because other
78 property owners will seek the same relief. While Mr. Pederson's property is fully
79 wooded and it is impossible to re -plant, the golf course is not under the same
80 constraints. They could place homes on the par -3, where no trees would need to
81 be impacted. The same formula should not be applied to the golf course.

83 R. Reid inquired if the formula for the tree waiver was specific to the property.

85 Finke replied that it was very specific to the property. Staff and the applicant's
86 engineer did a lot of work to find alternatives to save trees and to quantify. Finke
87 noted that even before you can qualify for a waiver, you have to step through 15
88 BMPs to try to save trees. One of the biggest BMPs is site layout, basically
89 placing homes where there are not trees. He noted that, to Mr. Voltin's point, if
90 there are alternative locations to place homes, it may be possible that another
91 applicant may not qualify for any type of reduction in replacement.

92 Jill Voltin of 630 Shawnee Woods said additional units on the golf course coming
93 through the neighborhood would be a major concern.

95 Nolan stated that the real problem seems to be County Road 116 and traffic from the
96 north, not additional development in Medina. Unfortunately, the County won't
97 take action until it becomes a major concern.

99 Williams stated that it might make sense for the traffic from the golf course to access
100 directly onto County Road 116.

102 Voltin asked how wide the proposed street was. Sparks stated that it was 28 feet in
103 width. Voltin asked if that was wider than Shawnee Woods today. Finke replied
104 that it was wider, and would be the same width as the streets within the Fields of
105 Medina or Enclave developments.

109 Martin inquired if there was a way to transplant the trees which need to be removed.
110 Nash stated that the trees are too large to transplant. Nash stated they limited the
111 grading to the extent they could.

113 Williams stated that it seemed to him that most of the trees were in the rear of the
114 lots. It appears that the applicant is making good faith efforts to save trees while
115 still developing the property consistent with the comp plan. He said the situation
116 seems very unique and he doesn't worry about precedent for the tree replacement
117 waiver.

119 V. Reid stated that she definitely supports the allowance for lower density. She says
120 that she likes staff's alternative plan better. She understands that it may not be
121 what people think they want.

123 Foote stated that he agrees with Kent and Vicki. He stated that he thinks signage is
124 important so people know where the line is. Also, he stated that future property
125 owners need to know about the penalty.

127 Mitchell stated that he is comfortable with the compromises the developer and the
128 staff have worked on to balance the interests of density, numbers of lots, tree
129 preservation, and so forth.

131 R. Reid said that she believes staff and the applicant have done a good job of
132 balancing the interests.

134 Nolan stated that he concurs and appreciates the attempts to save more trees. He
135 stated that the sewer thing is bothering him. Perhaps the City Council can use the
136 tree preservation waiver as part of a negotiation to have the sewer extended.

139 recommendations and language related contribution for necessary improvements for
140 County Road 116 and Highway 55 and further investigation of sewer, signs and
141 marketing materials for tree preservation area.

BACKGROUND / SUMMARY OF REQUEST
At the September Planning Commission, there was a review of an application from Money Tree
Holdings LLC for a rezoning and preliminary plat for a proposed development referred to as
"Fawn Meadows." The application was tabled for revisions requested by the Planning
Commission. The applicant has revised the plan and seeks to continue the review of the
application at this time. The current request is for a rezoning from Urban Reserve -Rural
Residential to R1 Single Family Residential and to plat the 10 acre site into 11 single family
parcels. Formerly there were 13 single family parcels.
SUBJECT SITE
The property is a vacant parcel located east of County Road 116 and south of Hackamore Road.
The site is currently vacant and contains some farmland, trees, and wetlands. It currently has
access through a 33 foot wide easement from across other properties from County Road 116.
The proposed division is intended to access from streets in the Reserve of Medina subdivision.
COMPREHENSIVE PLAN & ZONING
The Comprehensive Plan identifies the parcel as being guided for a Low Density Residential
land use. This requires a minimum net density of 2 units per acre up to a maximum of 3.49 units
per acre. This is the same land use classification as the Reserve of Medina. The gross acreage of
the site is almost 10 acres, but after deducting wetlands and buffers the site size is 4.65 net acres.
The minimum number of lots to meet the density is 10. The applicant is proposing 11.
The proposal is to rezone the property from RR-UR, Rural Residential -Urban Reserve to R1,
Single Family Residential. This rezoning classification is consistent with the Comprehensive
Plan and may be deemed acceptable.
PRELIMINARY PLAT & LOT STANDARDS
The proposed preliminary plat includes 11 single family lots, two outlots, and the dedication of
right-of-way. The lots range in size from 12,299 square feet to 26,781 square feet, with the
majority being between 12,000 and 15,000 square feet. Outlot A is for a storm pond in the
southeastern corner of the site. Outlot B is for a wetland on the north and eastern portion of the
site.

Lot 4, Block 2 is proposed as a flag lot with a 40 foot wide flag pole. A driveway is depicted not
within the pole but rather the existing 33 foot wide access easement along the rear of the lots
within the Reserve subdivision. This is the existing access easement referenced above as the
manner for which the subject site currently has access.
TRANSPORTATION
Streets
The applicant proposes an extension of Daisy Circle from the Reserve of Medina subdivision.
The proposed right-of-way is 50 feet in width with a 28 foot street surface. A temporary cul-de-
sac is proposed near the western end of the road. One parcel lies west of the temporary cul-de-
sac. This may be acceptable, provided this parcel is the lone parcel accessing beyond this point.
Lots 2 and 3 of Block 1 derive the required width by an "eyebrow" in the right-of-way. Without
this bulbous appendage to the right-of-way both parcels would have a lot width of about 80 feet.
Section 820.29 Subd. 2 of the Subdivision Ordinance states that this may be acceptable when a
"wider dimension is determined to be appropriate by the City Council in order to accommodate
the expected traffic, parking, pedestrian ways, and utilities." The eyebrow may be acceptable to
use for the housing of the temporary cul-de-sac. If the eyebrow is acceptable to City Officials, it
may be advisable to move the sidewalk to the edge of the right-of-way.
A ghost plat is provided depicting a continuation of the road west. The ghost plat shows about
50 feet of depth between the right-of-way and the trunk sewer easement on the north side of the
road. The ghost plat should be revised to ensure the right-of-way is in a usable location for
future orderly development. If the right-of-way within the Fawn Meadows Preliminary Plat
terminates in a location unacceptable for this purpose, an adjustment to the right-of-way on this
plat should be made.
Trails & Sidewalks
The applicant proposes a sidewalk on the western side of the road. There are no trails proposed.
As mentioned above, if the eyebrow remains, it may be advisable to have the sidewalk follow the
right-of-way. Decorative landscaping maintained by the homeowner's association may provide
an attractive community asset between the sidewalk and street.
UTILITIES & GRADING
Sewer & Water
The applicant proposes to provide sewer to the site from the trunk sewer main along the wetland
boundary behind the lots in Block 1. A connection is proposed between Lots 3 and 4 of Block 1
that extends to the right-of-way where a sewer main is placed. Water is proposed from a
continuation of a water main from the Reserve subdivision.
A private sewer service is proposed to be extended between Lots 2 and 3 in Block 2 back to the
Lot 4. It is proposed within a 20 foot easement. There is a cleanout located in this line. This
cleanout should be identifiable above grade to ensure its accessibility. Ideally, service lines
would not be located between houses like this. However, to have the service line only on Lot 4
would require extension of the sewer main. The preference is to limit the length of pipe in the
right-of-way to be to the minimum amount necessary.
Stormwater Management
A filtration basin is proposed in the southeastern corner of the development. Acceptable access
to the pond has been provided from the right-of-way. A revised Stormwater Management Plan is
required to verify that construction meets City specifications.
Site Grading
The previous plan had a system of retaining walls to create buildable area for the lots. The
Planning Commission requested the applicant revise the plan to remove these walls as much as
possible. The revised plan does still have some walls but they are far more limited to what is
customary in a residential subdivision with a maximum height of four feet. The retaining walls
are not permitted within drainage and utility easements and the plan should be adjusted.
Construction Access
The construction access is proposed coming from the Reserve subdivision. The final lift of
blacktop will not be installed on the streets within the Reserve development until the
development is nearly built -out. The applicant should use the access easement from County
Road 116 for construction access.
WATER RESOURCES
Wetlands
There is a 4.74 acre wetland on the northern portion of the site. The wetland was delineated in
conjunction with the planning for the trunk sewer main through the property. Staff recommends
a condition requiring an upland buffer planting plan and wetland buffer easements consistent
with City requirements.
Irrigation
Lawn and landscape irrigation systems are not permitted to be connected to the City water
supply in any new development. If there is an intent to have an irrigation system, the applicant
will need to provide an alternative plan with water from stormwater ponds and perhaps
supplemented by private wells. The design of this system will need to be approved by the City
Engineer.
LANDSCAPING & TREE PRESERVATION
Tree Preservation
There are 3900" of significant trees on the site. The applicant is proposing to remove 31.8% of
the trees. This results in the need for 194 inches of replacement trees. The applicant has not
proposed a tree replacement plan, and staff recommends that such a plan be submitted as a
condition of approval.
Landscaping
The ordinance requires two trees to be planted on each single family lot, one of which is required
to be located in the front yard. As proposed, the landscaping plan generally meets these
minimum requirements.
PARK DEDICATION
There are no park and trail plan components identified on this parcel. Therefore, it would appear
that cash -in -lieu of parkland dedication would be appropriate. The cash -in -lieu amount is based
on 8% of the value of the land with the minimum cash contribution being $3,500 per dwelling
unit and the maximum at $8,000 per dwelling unit. The Park Commission will review this
proposal at a future meeting and give the Council a formal recommendation.
APPLICATION REVIEW
The subdivision regulations state that the Planning Commission and City Council shall deny
approval of a plat based on one or a combination of the following findings:
(a) That the proposed subdivision is in conflict with the general and specific plans of the
City, or that the proposed subdivision is premature, as defined in Section 820.28.
(b) That the physical characteristics of this site, including but not limited to topography,
vegetation, soils, susceptibility to flooding, water storage, drainage and retention, are such
that the site is not suitable for the type of development or use contemplated.
(c) That the site is not physically suitable for the proposed density of development or does not
meet minimum lot size standards.
(d) That the design of the subdivision or the proposed improvements are likely to cause
substantial environmental damage.
(e) That the design of the subdivision or the type of improvements are likely to cause serious
public health problems.
(f) That the design of the subdivision or the type of improvements will conflict with public or
private streets, easements or right-of-way.
If the City does not make these findings, and the proposal is consistent with the Comprehensive
Plan, City ordinances, and other City policies, the preliminary plat should be approved.
RECOMMENDATIONS
The proposed plan is an improvement over the previous plan reviewed by the Planning
Commission in September. Subject to the changes and conditions noted below, staff believes the
plat meets the City's Comprehensive Plan, Zoning Ordinance, and Subdivision Ordinance. The
rezoning is in compliance with the Comprehensive Plan.
If the Planning Commission finds that the above criteria for denial are not met, Staff
recommends approval subject to the following conditions:
1) The Applicant shall enter into a development agreement with the City, which shall
include the conditions described below as well as other requirements by City ordinance
or policy.
2) The Applicant shall install all improvements shown on the plans received by the City on
November 25, 2013. The design of all improvements shall be reviewed and approved by
the City Engineer prior to commencing construction.
3) The Applicant shall provide a letter of credit prior to any site construction in an amount
recommended by the City Engineer to ensure completion of the improvements identified
in the approved plans.
4) Prior to final plat approval, the Applicant shall provide detailed construction plans for
review by the City Engineer.
5) The Applicant shall provide park dedication in an amount determined by the City Council
following recommendation by the Park Commission.
6) No lawn or landscape irrigation systems shall be permitted to be connected to the City
water system. The Applicant shall provide details of alternative measures prior to final
plat approval, unless the Applicant confirms no irrigation systems will be installed.
7) The ghost plat concept plan depicting this development's impact on the possibility to
develop on the property to the west shall be revised so that the location of the road
provides adequate depth for the lots along the wetland.
8) The property shall be placed within a stormwater taxing district.
9) An upland buffer planting plan is required.
10) A tree replacement plan is required.
11) All comments of the City Engineer shall be addressed.
12) All comments of the City Attorney shall be addressed, and the Applicant shall abide by
the City Attorney's recommendations related to title issues and recording procedures.
13) The Applicant shall provide Homeowner's Association documents for City review. This
document shall describe responsibilities for maintenance of stormwater improvements,
buffer yards, and lawn irrigation systems.
14) The Applicant shall obtain necessary approvals and permits from the Elm Creek
Watershed, Hennepin County, the Minnesota Pollution Control Agency, the Minnesota
Department of Health, the Metropolitan Council, and other relevant agencies.
15) The application for final plat shall be submitted to the City within 180 days of
preliminary approval or the preliminary plat shall be considered void, unless a written
request for time extension is submitted by the applicant and approved by the City
Council.
16) The Applicant shall pay to the City a fee in an amount sufficient to reimburse the City for
the cost of reviewing the preliminary plat, construction plans, and other relevant
documents.
POSSIBLE ACTIONS
A. Motion to recommend approval of the requested preliminary plat and rezoning with the
list of conditions.
B. Motion to recommend denial of the requested preliminary plat and rezoning.
C. Motion to table. If made, this motion should be supported with direction to the applicant
on specific identified issues, so the applicant can revise their plans for submission to the
City prior to the next Planning Commission meeting.
D. Motion to approve the rezoning and table the preliminary plat.

We have reviewed the revised preliminary plat and plans dated November 25, 2013, for the Fawn
Meadows subdivision. The plans propose to construct street and utility improvements to serve 11
single family homes. We have the following comments with regards to engineering matters.
Sheet C101 Existing Conditions
1. Topography should be surveyed data not LIDAR data as noted.
Sheet C202 Preliminary Plat
1. All street horizontal curves should have a minimum radius of 275 -feet to meet a 30 mph
design speed.
2. The westerly exterior perimeter drainage and utility easements shown on Lot 1, Block 1, and
Lots 1 and 4, Block 2 shall be 10 -feet in width not the 5 -feet shown.
3. The drainage and utility easement shown on the common lot line between Lots 3 and 4,
Block 1 shall be 20 -feet in width and centered on the common lot line. It will be necessary to
realign the sanitary sewer shown between these two lots. The realigned sanitary sewer shall
be centered on the easement.
Sheet C301 Grading Plan
1. Retaining walls are not permitted in perimeter drainage and utility easements. The plans
should be revised to relocate the proposed retaining walls on Lot 1, Block 1 and Lots 3 and 4,
Block 2.
2. The grading plan should show final contours on Block 1.

3. The construction access shall be over the existing roadway easement and not through the
Reserve subdivision. The construction access shown on Daisy Circle shall be removed and
the plans revised to show the roadway easement as the construction access.
4. The Stormwater Management Plan submitted did not address previous comments dated
November 19, 2013. Future submittals shall include an updated Stormwater Management
Plan that addresses these previous comments.
5. The City does not allow irrigation from the municipal water system. Future submittals should
identify how water will be supplied for irrigation.
Sheet C401 Utility Plan
1. The sanitary sewer should be extended to the west lot line of the plat for future service to the
west.
2. The construction by others of the trunk sanitary sewer north of Block 1 is complete. The
Fawn Meadows plans should be updated to reflect as -built alignments and elevations of this
sanitary sewer.
3. Future submittals shall include profile views of all utilities and streets. Street horizontal and
vertical curves shall meet a 30 mph design speed.
4. FES #100 is in conflict with the maintenance access and should be relocated to provide an
unobstructed 12 -foot wide maintenance access.
Sheet C501 Ghost Plat
1. The ghost plat shows lots with no real buildable area north of the east -west road alignment.
The problem is primarily due to the existing sanitary sewer and associated easement. The
sanitary sewer easement location should be verified and confirmed. The sanitary sewer is
constructed and as -built sewer alignments should be shown on the ghost plat. The ghost plat
should be revised to show adequate buildable areas on all lots as well as a road right-of-way
that meets a 30 mph design speed. This may require realigning the roadway in the Fawn
Meadows plat and moving it southerly.
