NOW, THEREFORE, BE IT RESOLVED by the Mayor and the Council ofthe Borough ofCarteret, County of Middlesex, State of New Jersey, as follows: 1. The proposal from GME Associates for professional land surveying and engineering services for Block 192, Lots 1,2 and 3, located in the Borough, at a total cost not to exceed $4,600.00 is hereby approyed. 2. This action is approved as an award of a professional services contract pursuant to NJ.S.A 40A:ll-5(1)(a) awarded pursuant to the Borough's Fair and Open Process as authorized by law. 3. A copy of this Resolution be fonyarded to the Borough's Purchasing Department and CME Associates. Any engineering andlor land surveying services beyond the scope outlined above will be considered extra. Said fees will be based on the hourly rate or a fixed fee mutually agreed upon in writing. . The fees on the hourly rate schedule are subject to change by January 1 of every year. . The terms of this contract will remain in effect for a period of one year from the date of this proposal. Invoices will be progress billed on a monthly basis on accordance with the percentage of work qompleted. Payment will be expected within 30 days net. If the client falls to make any payment for services within sixty (60) days after receipt of invoices, the amounts due shall include a charge at the rate of 1 1/2% per month from said sixtieth day, and, in addition, CME may, after giving seven (7) days written notice, suspend services under this agreement until all amounts due for services are paid in full. All documents, including drawings and specifications prepared by CME pursuant to this Agreement, are instruments of services and any reuse by others on extensions of the project will require a written consent by CME. The above fee estimates are based on information provided to us by the Borough, Should the scope of the project change requiring additional professional fees, we will detail same in writing and seek authorization prior to proceeding.
