Jr4 -0 RESOLUTION GRANTING CONDITIONAL USE PERMIT TO THE BIG WOODS SALOON WHEREAS, Larry Thomas (Applicant) has applied for permission to construct an outdoor volleyball area adjacent to the Big Woods Saloon at 44/z/S" , ;;� s ; and WHEREAS, the Medina Code of Ordinances permits such use only with a conditional use permit; and WHEREAS, the proposal has been reviewed by the Planning Commission and City Council for compliance with ordinance stan- dards. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Medina, Minnesota that the proposed outdoor volleyball area is consistent with the City's zoning ordinance and will not impede the development of adjacent property and that a condition- al use permit for same is hereby granted, subject to the follow- ing conditions: 1. The area used for volleyball shall be no larger than 9312 square feet and shall be surrounded by an opaque fence with permanent footings. 2. The hours the volleyball area may be used shall be limited to 2:00 p.m. to dusk daily. 3. There shall be no outdoor lighting of the volleyball area. 4. There shall be no music or other sound broadcast outdoors or audible in the volleyball area. 5. There shall be a minimum of three employees on the site at all times. 6. The sole entrance to the volleyball area shall be through the main building and there shall be two exterior gates in the volleyball area fence which shall be exits only. 7. There shall no outside storage of materials on the site. 8. The main building shall meet all requirements of the Medina fire code. 9. There shall be no living quarters in the main building. 10. Paved parking shall be provided on site for a minimum of 20 vehicles. BE IT FURTHER RESOLVED by the City Council of the City of Medina, Minnesota that the conditional use permit shall not be effective until the following have occurred: a) The fence has been constructed; b) The parking lot and driveway have been repaired; and c) The main building has been painted. A violation of any of the above conditions shall be deemed to be a violation of the Medina zoning ordinance. DATED: r i (, / 5 , 1986.
