Yt _ ,5 �f RESOLUTION APPROVING PLANS AND SPECIFICATIONS, ORDERING IMPROVEMENT AND ACCEPTING BID FOR THE BITUMINOUS SURFACING OF TAMARACK DRIVE WHEREAS, by Resolution No. 86- , adopted the day of , 1986, the City Council ordered the preparation of plans and specifications, called for a public hearing on the improvement and ordered advertising for bids for the bituminous surfacing of Tamarack Drive from County Road 24 to the southerly limits of the City; and WHEREAS, said plans and specifications were prepared by Bonestroo, Rosene, Anderlik & Associates, Inc.; and WHEREAS, 10 days' published notice of the hearing through two weekly publications of the required notice was given and the hearing was held on the 6th day of May, 1986, at which all persons desiring to be heard were given an opportunity to be heard thereon; and WHEREAS, pursuant to an advertisement for bids for the project, bids were received, opened and tabulated in accordance with law, the bids complying with the advertisement being those shown in Exhibit A, attached hereto; and n W EREAS, it appears that ill get, to Ae'Cu rn locus of u `'1a(e , Minnesota is the lowest responsible bidder. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Medina, Minnesota as follows: 1 The plans and specifications prepared by Bonestroo, Rosene, Anderlik & Associates, Inc., a copy of which are attached hereto as Exhibit B, are hereby approved. 2. The bituminous surfacing of Tamarack Drive from County Road 24 to the southerly limits of the City is hereby ordered. 3. It is the judgment of the City Council that the improvement has no relationship to the City's comprehensive plan. 4. The Mayor and City Clerk are herety author zed and directed to enter into a contract with e /c m , no It 6 in the name of the City of Medina for the bituminous surfacing of Tamarack Drive from County Road 24 to the southerly limits of the City, according to the plans and specifica- tions therefor approved by the City Council. 5. The City Clerk is hereby authorized and directed to return forthwith to all bidders the deposits made with their bids, except that the bid deposits of the lowest and next lowest bi ders s all be retained until a contract with P 40,16 DO u m , nn u S has been signed.
