CITY COUNCIL
MINUTES
JANUARY 2, 1979
INITIATION:
1. CALL TO ORDER:
Mayor Tyrell called the regular meeting of the City Council to
order at. 7:30 p.m. on Tuesday, January 2, 1979, in the Council
Chamber of the City Hall.

5. CONSENT CALENDAR:
Item B was removed from the Consent Calendar. On motion by Council-
man Gillanders, seconded by Councilman Atkins, Items A, and C through
H were approved as recommended.
A. APPROVAL OF MINUTES: Regular Meeting of December 19, 1978
Approved as written.
C. RESOLUTION NO. 79 -1773: OPPOSING PROPOSED METROPOLITAN PLANS
FOR DESEGREGATION
Adopted Resolution No. 79 -1773 A RESOLUTION OF THE CITY COUNCIL,OF
THE CITY OF TEMPLE CITY DECLARING ITS POSITION ON LOCAL CONTROL. OF
EDUCATION AND PROPOSED METROPOLITAN PLANS FOR DESEGREGATION.
City Council received communication from Reverend Edwin Linberg,
Temple City Christian Church, stating there are no detailed plans
at the present time, nor a court order or legislative action which
mandates when such a plan be implemented with regard to the Metro-
politan plan. City Council concurred their action was to oppose
the concept of a metropolitan plan to achieve desegregation.
D. ORDINANCE NO. 78 -472: 2nd read. RELATING TO FEES FOR PLANNING
DEPARTMENT SERVICES
Held second reading by title only and adopted Ordinance No. 78 -472
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY AMENDING
SECTIONS 9205 AND 9252 OF THE ZONING CODE OF THE CITY OF TEMPLE CITY.
E., RESOLUTION NO. 79 -1776: ADOPTING FEE SCHEDULE FOR PLANNING
DEPARTMENT SERVICES

F. AFFIRMATIVE ACTION POLICY
Adopted an Affirmative Action Policy Statement in keeping with
the City's past practice of nondiscrimination in all aspects of
employment.
G. RESOLUTION NO. 79 -1774: EMPLOYMENT OF PERSONNEL
Adopted Resolution No. 79 -1774 A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF TEMPLE CITY APPOINTING PERSONNEL.
H. RESOLUTION NO. 79 -1775: WARRANTS & DEMANDS
Adopted Resolution No. 79 -1775 A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF TEMPLE CITY ALLOWING CLAIMS AND DEMANDS IN THE SUM OF
$85,535.53, DEMAND NOS. 11098 THRU 11191.
Consent Calendar Item B
City Manager Koski presented background information, stating final
inspection of the work completed by Pacific Tennis Courts, Inc. was
conducted by Ericksson, Peters and Thoms, Landscape Architects, and
staff on December 4, 1978. The work was found to be complete and
in accordance with the plans and specifications. The project was
not completed within the 90 days construction period and if a
penalty is imposed, staff recommends a period of 26 days which is
the additional time taken by the contractor, excluding the allowable
concrete curing and surfacing period. The landscape architects
have requested additional compensation in the amount of $1,379 for
extended inspection services necessitated by the contractor's delay.
Staff recommends the amount of $1,379 for additional inspection time
be deducted from the contractor's final payment.
Councilman Atkins moved to approve staff recommendations, Items 1
through 4 as set forth in memo dated December 15, 1978, seconded
by Councilman Gillanders and carried.
Rick Davidson, Pacific Tennis Courts, Inc. protested the charges
for additional inspection time in the amount of $1,379 stating they
were exhorbitant.
In answer to question from Council, City Attorney Martin advised
the $1,379 additional compensation requested by the landscape
architect may be deducted from the contractor's balance and held
for a reasonable period of time until the matter is resolved.
Councilman Gillanders moved to hold the payment for additional
inspection time to Ericksson, Peters and Thoms in the amount of
$1,379 until Tuesday, January 9, 1979, 5 p.m. to allow Pacific
Tennis Courts, Inc. the opportunity to negotiate with the landscape
architect, seconded by Councilman Atkins and carried.

NEW BUSINESS:
6. JOINT POWERS AGREEMENT - ANIMAL CONTROL
City Manager Koski presented draft of the Joint Powers Agreement
comprising surrounding cities contracting with the San Gabriel
Valley Humane Society for animal control and /or shelter and pound
activities, the purpose for which is to exercise powers jointly
by providing a mechanism whereby animal control services can be
rendered to each of the cities. The Agreement has been reviewed
and approved by the City Attorney. An initial payment of $1,000
per city for the cost of a study is required under the one -year
agreement. The authority also wishes at this time to have the
cities appoint their delegate and alternate to represent their
cities.

Councilman Atkins moved to authorize the City's participation in
the Joint Powers Authority and authorize the Mayor and City Clerk
to sign, seconded by Councilman Merritt and carried.
Councilman Dennis moved to appoint Mayor Tyrell delegate to the
Authority, City Manager Koski as alternate, seconded by Councilman
Merritt and carried.
7. COMMUNICATIONS:
There were no communications.

RECESS TO CRA:
City Council recessed at 7:40 p.m. to meet as the Community Redevelopment
Agency, all members being present and approved the minutes of the regular
meeting held December 19, 1978. Minutes are set forth in full in the
records of the Agency.
RECONVENE AS CITY COUNCIL;
9. FACTION ON REQUEST BY CRA:
There was no action to be taken.
10. MATTERS FROM CITY OFFICIALS:
A. League of California Cities City Managers' Spring Conference,
Monterey, February 7 -9, 1979
Councilman Atkins moved to authorize City Manager's attendance at.
the 1979 Spring Meeting of City Managers to be held in Monterey,
California, February 7 -9, 1979, and approve attendant expenses,
seconded by Councilman Dennis and carried.
B. California Contract Cities Association - Legislative Seminar,
January 16 -18, 1979
Councilman Atkins moved to authorize attendance of Councilmen who
desire to attend the llth Annual Legislative Orientation Tour to
be held January 16 -18, 1979, Sacramento and approve attendant
expenses, seconded by Councilman Dennis and carried.
C. CETA - Public Service Employment Subgrant
Councilman Dennis moved to approve the CETA contract - Public
Service Employment Subgrant for the period January 1, 1979 through
September 30, 1979, seconded by Councilman Merritt and carried.
D. City Manager Koski advised Al Grogan, Chairman of the Temple
City Communications Committee was in attendance and indicated the
committee is prepared to assist the Council by participating in a
street lighting district study.
City Council concurred in initiating the study and requested
Mr. Louis Gilbertson and Mr. Everett Greenberg be invited to join
the committee for the purposes of reviewing alternatives to funding
the street lighting district.
E. Councilman Gillanders commented on news bulletins reporting
Iranian students were demonstrating in Beverly. Hills that day, and
expressed the belief the United States government should revoke their
visa and deport them. Council concurred and requested the City
Attorney prepare an appropriate letter to be sent to our federal
legislators by City Council.

F. Councilman Atkins commented on the Fiesta Floats winning
four awards, including the Sweepstakes and Grand Prize, and
requested the Mayor send a letter of congratulations on behalf
of the City Council.
11. ADJOURNMENT:
On motion by Councilman Dennis, seconded by Councilman Gillanders,
meeting adjourned at 8:06 p.m. Next regular meeting of the City
Council will be held Tuesday, January 16, 1979, 7:30 p.m. in the
Council Chamber of the City Hall.
