CITY OF MEDINA
RESOLUTION NO. t3 C - .'
RESOLUTION GRANTING CONDITIONAL
USE PERMIT TO LEONARD AND CAROLE GREEN
WHEREAS, Leonard and Carole Green (Applicants) own property
located at 2800 Hunter Drive, which is zoned rural residential;
and
WHEREAS, Applicants have requested permission to operate a
dog kennel at the property; and
WHEREAS, Section 826.21 of the Medina Code of Ordinances
permits such a use within the rural residential district only
upon the City Council granting a conditional use permit; and
WHEREAS, the Planning Commission and City Council have
reviewed the proposal for compliance with ordinance standards.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Medina, Minnesota that the proposed dog kennel is consis-
tent with the City's zoning ordinance and will not impede the
development of adjacent property and that a conditional use
permit for same is hereby granted, subject to the following
conditions:
1. The kennel shall be operated as a breeding and boarding
kennel only for registered purebred Miniature Schnauzer
dogs.
2. There shall be a maximum of 15 runs, which shall not exceed
100 square feet in size.
3. The runs and dog kennel structure shall be located no less
than 150 feet from all property lines and shall be designed
to minimize the noise of barking dogs, including the use of
fencing or covering.
4. No dogs shall be permitted to remain in the outside runs
between the hours of 10:00 p.m. and 7:00 a.m.
5. The total number of dogs of breedable age kept on the
property shall not exceed 15. Any number of puppies six
months or less in age shall be permitted so long as they are
the offspring of dogs legally on the property.
6. The Applicants shall maintain accurate records regarding the
date, number, sire and dam of each litter whelped or main-
tained on the property, which records shall be open to
inspection by the city staff at reasonable times.
7. The hours of operation of the kennel shall be limited to
8:00 a.m. to 6:00 p.m. daily.
8. A11 waste materials shall be disposed of in accordance with
the ordinances of the City of Medina and the Minnesota
pollution control agency in order to prevent creation of a
nuisance.
9. The Applicants shall take immediate steps to abate any noise
nuisance on the property, which shall include but not be
limited to 10 minutes of continuous barking.
10. No dogs shall be sold or used for experimental purposes.
11. The Applicants shall submit a site plan of their property
which is drawn to scale, shows all structures, fences and
dog runs and is acceptable to the Medina zoning administra-
tor.
12. A11 dogs shall be maintained in accordance with the stan-
dards of the Minnesota Purebred Dog Breeders Association.
BE IT FURTHER RESOLVED by the City Council of the City of
Medina, Minnesota that a violation of any of the above conditions
shall be deemed to be a violation of the Medina zoning ordinance.
