RESOLUTION GRANTING A
CONDITIONAL USE PERMIT TO
HOLY NAME OF JESUS CATHOLIC CHURCH
WHEREAS, Holy Name of Jesus Catholic Church (Applicant) has applied for
permission to construct a new chapel and appurtenant facilities on its property
at 155 Co. Rd. 24, which property is legally described on Exhibit A; and
WHEREAS, the Medina Code of Ordinances permits such improvements only upon
the issuance of a conditional use permit by the city council; and
WHEREAS, the proposal has been reviewed by the Planning Commission, Heritage
Preservation Commission and City Council for compliance with all requirements of
the Medina Code of Ordinances.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Medina,
Minnesota that the proposed new chapel and appurtenant facilities are consistent
with the city's ordinances and will not impede the development of adjacent property
and that a conditional use permit for same is hereby granted, subject to the
following conditions:
1. The Applicant shall submit to the Medina zoning administrator a landscape plan
for the property showing the size, number and species of planting material,
which complies with the landscape performance stantards for commercial/industrial
uses and which includes trees on the southern side of the proposed south parking
lot in the area where it adjoins the propsed driveway.
2. The Applicant shall close the parking lot on the northern side of Co. Rd. 24,
seed the area with grass and surround it with fence posts installed 5'0" on
center. Access to this area shall be from Holy Name Road only. The Applicant
shall use this area only for special events, which shall not exceed four in
number per year. During all special events, Applicant shall hire at its sole
expense an off -duty, licensed, uniformed police officer for traffic control. The
fencing plan shall be submitted by Applicant to the Medina zoning administrator and
all actions associated with closing the northern parking lot shall be completed
no later than 120 days from issuance of the Rectory permit.
3. The Applicant shall submit a drainage plan which shows the precise location of
the berm, retains the pond on the southern side of Co. Rd. 24, meets all re-
quirements of the Minnehaha Creek Watershed District and is in all respects
satisfactory to the city engineer.
4. The Applicant shall submit a lighting plan which provides for lighting of the
parking areas as needed during evening hours, security lighting all evening and
is in all respects satisfactory to the zoning administrator.
5. The Applicant shall install an additional traffic lane along the west side of
Brockton Lane from Co. Rd. 24 to the church parking lot entrance. The minimun road
way width shall be 38 feet. Road work must be completed and surfaced by no later
than October 15, 1986.
6. The Applicant shall ensure that the west access to its western parking lot be "in
only" and the east access "out only".
7. The Applicant shall remove the unused farm road on Co. Rd. 24 between Brockton
Lane and church building within 30 days after the issuance of the Church building
permit.
8. The Applicant shall obtain from the City of Plymouth prior to issuance of a
building permit by the City of Medina a letter confirming the continued availability
of water and sewer to the site.
9. Hardsurface coverage on the site shall not exceed 30 percent.
10. The Applicant shall cause the existing rectory well and septic systems to be
closed in accordance with all applicable laws and regulations.
11. The Applicant shall convey to the City of Medina right-of-way along Co. Rd. 24
and Brockton Lane as is shown on the map prepared by the zoning administrator and
city engineer, which map is attached hereto as Exhibit B.
12. The City of Medina recommends that the Applicant proceed with execution of
its plans in the following sequence:
a) The southern portion of the new parking lot be contructed and useable
before construction begins on the chapel.
b) Constuction begin on the new rectory.
c) Construction begin on the new chapel.
d) The existing rectory be razed.
e) The northern end of the new parking lot be constructed.
13. Resolution No. 82-14, adopted by the City of Medina on July 20, 1982, is
hereby reconfirmed and incorporated herein by reference as fully as if set
out in its entirey, except with regard to such matters as are specifically
or by fair implication inconsistent with conditions 1 through 12 of this
resolution.
14. That the Church enter into a development contract to insure the construction
of the project in accordance with the plans approved- with a bond or a letter
of credit. That the church reimburse the City for all engineering, legal and
administrative costs incurred by the City to date and to be incurred by the
City in the future in furtherance of the project, said costs to date to
include the following:

BE IT FURTHER RESOLVED by the City Council of the City of Medina, Minnesota
that a violation of any of the above conditions shall be deemed to be a violation
of the Medina zoning ordinance.
