RESOLUTION NO. O 6 -- 41/
Resolution Granting Preliminary Plat Approval to
Dennis Peterson and Phillip Johnson
Whereas, Dennis Peterson and Phillip Johnson (Applicants) have
requested preliminary plat approval for property located on
Tamarack Drive and legally described on Exhibit. A attached
hereto; and
Whereas, the planning commission and city council have reviewed
the preliminary plat submitted by the Applicants, a copy of which
is attached hereto as Exhibit B.
Now, Therefore, Be It Resolved by the city council of the City of
Medina, Minnesota that preliminary plat approval is granted to
Dennis Peterson and Phillip Johnson, subject to the following
conditions:
1. The final plat shall indicate drainage and ponding
satisfactory to the city engineer;
2. The Applicants shall enter into a private road
which is acceptable to the city attorney;
3. The road shall comply with current city standards;

4. The Applicants shall pay to the city park fees in amount to
be determined by the city staff for all lots;
5. The final plat shall show dedication of the Tamarack Drive
right-of-way required by the city engineer;
6. The easement required for the private road along the
northern boundary of the property shall range in width from
30 to 60 feet depending upon the city's ability to obtain or
verify the existence of a 30 foot easement along the
southern boundary of the Art Peabody subdivision;
7. The Applicants shall pay to the city for administrative
expenses the amount determined by the city staff to
represent the actual cost to the city of review of the plat;
8. The Applicants shall submit a current abstract of title or
registered property abstract covering all land within the
subdivision for review by the city attorney; and
9. The Applicant shall submit a final plat to the city within
180 days of the date of adoption of this resolution, which
final plat shall in all material respects conform to the
preliminary plat, except that it shall incorporate all
changes and modifications required by this resolution.
