HomeMy Public PortalAbout1986-046Member -J ;114,,,r,c.1( introduced the following resolution and moved its adoption: CITY OF MEDINA RESOLUTION NO. l( -- 4 6 Resolution Granting Preliminary Approval to Wirtjes Construction Co. for Windance Subdivision Whereas, Wirtjes Construction Co. (Applicant) has requested preliminary approval of a plat to be known as Windance, which is located at 3000 Tamarack Drive on property legally described as: The Southwest 1/4 of the Northeast 1/4 of Section 14, Township 118, Range 23, except the South 367 feet of the West 357 feet thereof, Hennepin County, Minnesota; and Whereas, the planning commission and city council have reviewed the preliminary plat submitted by the Applicant, a copy of which is attached hereto as Exhibit A. Now, Therefore, Be It Resolved by the City Council of the City of Medina, Minnesota that preliminary approval is granted to the Applicant for Windance plat, subject to the following conditions: 1. The final plat shall show drainage and ponding easements which are satisfactory to the city engineer; 2. It is acknowledged that the existing structure on proposed Lot 3, Block 1 is non -conforming and that it will be made to conform at the time of issuance of a building permit for said lot; 3. The final plat shall show dedication of right-of-way along Tamarack Drive to the satisfaction of the city engineer; 4. The Applicant shall obtain approval of the plat by the Elm Creek Watershed District and final city approval shall be subject to the conditions of approval imposed by the District; 5. The city engineer shall verify the adequacy of soils within the subdivision from the amended Hennepin county soils map; 6. The Applicant shall pay to the city park fees in an amount to be determined by the city staff for all lots except proposed Lot 2, Block 1; 7. Trappers Trail shall be constructed to city specifications for a public road and the intersection of Trappers Trail and Tamarack Drive shall be lowered to the satisfaction of the city engineer; 8. The private covenants recorded against the lots in the subdivision shall reflect the limitations on animal struc- tures on proposed Lot 3, Block 1 and proposed Lot 5, Block 2; 9. The Applicant shall pay to the city for administrative expenses the amount determined by the city staff to represent the actual cost to the city of review of the plat; 10. The Applicant shall submit a current abstract of title or registered property abstract covering all land within the subdivision for review by the city attorney; and 11. The Applicant shall submit the final plat to the city within 180 days of the date of adoption of this resolution, which final plat shall in all material respects conform to the preliminary plat, except that it shall incorporate all changes and modifications required by this resolution.
