CALL TO ORDER:
CITY OF TEMPLE CITY
CITY COUNCIL
MINUTES
JANUARY 16, 1979
Mayor Tyrell called the regular meeting of the City Council to
order at 7:31 p.m. on Tuesday, January 16, 1979, in the Council
Chamber of the City Hall.
2. INVOCATION:
The invocation was given by Dr. Edwin Linberg, Temple City Christian
Church, 9723 Garibaldi Avenue.
3. The Pledge of Allegiance to the Flag was led by Mayor Tyrell.

Councilman Atkins moved to excuse Councilman Dennis who was out of
town on official business, attending the Contract Cities Legislative
Tour in Sacramento, seconded by Councilman Merritt and carried.
5. CONSENT CALENDAR:
On motion by Councilman Merritt, seconded by Councilman Atkins, Items
A through E on the Consent Calendar were approved as recommended.
A. APPROVAL OF MINUTES: Regular Meeting of January 2, 1979.
Approved as written.
B. LIVE OAK AVENUE IMPROVEMENT PROJECT - APPROVE AGREEMENT FOR
ENGINEERING SERVICES
Approved Agreement and authorized Mayor and City Clerk to sign.
C. RECOMMENDATION FROM PLANNING COMMISSION - Meeting of January 9
PROPOSED AMENDMENT TO GENERAL PLAN: CASE NO. 79 -1
Set Public Hearing February 6, 1979.
D. RESOLUTION NO. 79 -1777: EMPLOYMENT OF PERSONNEL
Adopted Resolution No. 79 -1777 A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF TEMPLE CITY APPOINTING PERSONNEL.
E. RESOLUTION NO. 79 -1778: WARRANTS & DEMANDS

THE CITY OF TEMPLE CITY ALLOWING CLAIMS AND DEMANDS IN THE SUM OF
$70,560.42, DEMAND NOS. 11192 THRU 11291.
UNFINISHED BUSINESS:
6. PUBLIC HEARING: 7 :30 p.m. TENTATIVE TRACT NO. 35986 - 9704 & 9710 LONGDEN
City Manager Koski presented background information, stating the
Planning Commission, at their regular meeting held December 12, 1978,
adopted Resolution No. 78 -827PC recommending approval of Tentative
Council Minutes, January 16, 1979 - Page 2
Tract No. 35986. The subject site consists of .9 acre and is
located on the south side of Longden Avenue, east of Kauffman
Avenue, with a frontage of 132 ft. An 8 -unit condominium project
is proposed, each unit containing 1,340 sq. ft., with 2 -car garage,
and an additional 4 open parking spaces. The Planning Commission
certified filing a Negative Declaration of Environmental Impact.
City Council, at their regular meeting held December 19, 1978,
set public hearing on this matter for January 16, 1979.
In answer to Councilman Merritt's question whether the Covenants,
Conditions and Restriction would restrict use of the four parking
spaces, City Manager Koski advised Item 5 of the Planning Commission
resolution requires the C, C and R's be approved by the City
prior to filing the Final Map.
There being no further staff report, Mayor Tyrell declared the public
hearing open and invited anyone wishing to speak to come forward.
Mr. Jack Weber, J. B. Weber Development Co., 5926 Temple City Blvd.,
stated the four parking spaces would be designated as guest parking;
that he had no further statement to make but would be happy to answer
any questions Council may have.
Pearl Jacoby, 6245 Golden West Avenue, inquired whether the six ft.
masonry or block wall along the perimeter of the property would be
constructed prior to construction of the buildings. Mr. Weber
advised he planned to provide the wall before construction commenced.
There being no one else come forward, Councilman Atkins moved to
close the public hearing, seconded by Councilman Gillanders and
carried,
Councilman Atkins moved to amend the draft Negative Declaration to
include the comments of those testifying by incorporating a copy
of the minutes into the report; that the City Council has reviewed
the Negative Declaration and is adequate and provides reasonable
information on the project, seconded by Councilman Gillanders and
carried,
Councilman Atkins moved to approve Tentative Tract No. 35986, subject
to all conditions set forth in Planning Commission Resolution
No. 78- 827PC, seconded by Councilman Gillanders and carried.
NEW BUSINESS:
None.
7. COMMUNICATIONS:
A. Request to Paint House Numbers on Curbs - Jr. Pee Wee
Football Team
City Manager Koski presented request from the Jr. Pee Wee Football
Team for permission to paint house numbers on curbs as a fund
raising project to finance a trip in December 1979 to represent
Temple City in a bowl game.
Councilman Merritt moved to authorize issuance of permit subject
to the required procedures and authorize a fee not to exceed $2
to be charged for such services, seconded by Mayor Tyrell and carried
B. Chamber of Commerce - Request to Conduct Sidewalk Sale, January 2
City Manager Koski presented request from the Chamber of Commerce
for permission to conduct a Sidewalk Sale Saturday, January 27,
9:30 a.m. to 5 p.m., to include permission to hang a banner January 19
across Las Tunas east of Temple City Boulevard and to post street
placards January 21.
Councilman Atkins moved to approve Chamber request as set forth in
their letter dated January 16, seconded by Councilman Gillanders
and carried.

C. Senate Constitutional Amendment No. 2
Mayor Tyrell advised the City has received several letters from
our representatives in the Senate and Assembly in response to
Resolution No. 79 -1773 opposing the proposed Metropolitan Plan
for Desegregation, enclosing a copy of SCA 2, coauthored by
Senators Montoya and Richardson, regarding pupil assignment.
Mayor Tyrell felt the City should write a letter indicating
its support.
Councilman Gillanders moved an appropriate letter be prepared by
the City Attorney supporting SCA 2, seconded by Councilman Atkins
and carried.
City Council recessed at 7:45 p.m. to meet as the Community Redevelopment
Agency, Mr. Dennis being absent; approved minutes of the regular meeting
held January 2, 1979 and adopted resolution approving warrants & demands.
Minutes are set forth in full in the records of the Agency.
RECONVENE AS CITY COUNCIL:
9. ACTION ON REQUEST BY CRA:
There was no action to be taken.
10. MATTERS FROM CITY OFFICIALS:
A. Christmas Tree Lots - Refund of Deposit
On motion by Councilman Atkins, seconded by Councilman Gillanders,
Council approved refund of deposit to Larry Cude, Treeland U.S.A.,
and Kare Youth League Trees, all locations having been inspected
and determined to be clear of debris as of January 2, 1979.
B. Request to Attend Planning Commissioners Institute,
February 21-23, 1979, Monterey
Councilman Atkins moved to approve request from Planning Commissioner
Abraham to attend subject conference and authorize attendant expenses
in the amount of $260 for registration, subsistence and travel
expenses, seconded by Councilman Gillanders and carried.
C. Public Nuisance Case 78 -46 - 9044 Olive Street
City Manager Koski advised pursuant to Resolution ordering abatement
of subject nuisance adopted by City Council at their regular meeting
held December 19,1978, staff has made inspection. Some progress has
been made, however, staff contacted the tenant this afternoon who
has requested an extension of one week, within which time he assures
he will clean up the property.
Councilman Gillanders moved to authorize the City Manager to abate
the public nuisance at 9044 Olive Street by private contract if the
property has not been cleaned by January 31, 1979, seconded by
Councilman Atkins and carried.
D. Councilman Atkins reported the San Gabriel Valley Association of
Cities meeting scheduled for January 18 has been postponed and re-
scheduled for January 25 at the Brookside Country Club.
E. Mayor Tyrell provided a copy of resolution adopted by Rancho
Palos Verdes opposing new state law which permits any unincorporated
territory adjacent to a city to annex without the consent of the city
to the City Attorney and requested his opinion.

11. ADJOURNMENT:
On motion by Councilman Atkins, seconded by Councilman Gillanders,
meeting adjourned at 7:57 p.m. The next regular meeting of the
City Council will be held Tuesday, February 6, 1979, 7:30 p.m. in
the Council Chamber of the City Hall.
