February 27, 1979
The Council of Bal Harbour Village met Tuesday, February 27, 1979 at
9:30 A. M. in the Village Hall.
Present: Messrs. Beatty, Davis, Krez, Printup and Taplin
Also present were Fred Maley, Village Manager, Mary T. Wetterer, Village
Clerk, and Alan Gold, Village Attorney.
On motion of Mr. Davis, seconded by Mr. Beat

Mr. Maley said that Florida Power and Light Company had advised him
that if their company takes over our residential street lighting system they
would not use our concrete poles. A test fixture will be installed on Bal
Bay Drive to determine the amount of light produced by a different lighting
element. It was moved by Mr. Beatty, seconded by Mr. Davis, and voted that
this item be deferred until next month.
Mr. Maley reported that the village had complied with the Competitive
Negotiations Act and from six respondants, four architects came to look at
the Village Hall in regard to the expansion for the Tourism Department. He
said that he did not have sufficient time to personally examine some of their
work and had no recommendation to make at this time. Mr. Krez was appointed
to work with Mr. Maley on selecting the architect. It was moved by Mr. Davis,
seconded by Mr. Beatty and voted that the selection be withheld for sixty days.
Mr.. Gold said he would give an opinion on the use of Tourism money for this
additional space.
Mr. Gold explained that he would have to withdraw as special counsel
to Dade County on the Balmoral tax matter as his firm is legal counsel for
the Balmoral loan documents. He said he believes Bal Harbour needs repre-
sentation in the suit and would like to recommend John Ferrell, who is a
former assistant county attorney. It was moved by Mr. Davis, seconded by
Mr.. Beatty and voted that Mr. Gold would be relieved of his responsibility
in this case. It was moved by Mr. Davis, seconded by Mr. Krez and voted that
Mr. Maley would contact Mr. Ferrell to see if he would be willing to handle
this case for us.
Mr. Ralph Gimel, President of the Bal Harbour Resort Association re-
commended expansion of the space for the Tourism Department in this building
rather, than leasing space outside of the Village Hall. He also brought the
coucil up to date on the cost and results of the Christmas -New Years Festival.
Mr. Maley submitted Advertising Matching Fund Contracts from Singapore,
Americana, Sea View, Beau Rivage, Regency, Ivanhoe and Coco's Restaurant.
On motion of Mr. Davis, seconded by Mr. Taplin and voted the contracts were
approved.
Mr. Maley reported that we were holding $15,000 from Sims Contract
until all sprinkler systems had been fixed and sod replaced.
Mr. Davis said he has had complaints about debris and ndse at the Bus
Stop in front of the Admirality Apartments. It was moved by Mr. Davis,
seconded by Mr. Beatty and voted that Mr. Gold prepare a Resolution to Dade
County asking that the Bust Stop be removed.
After discussion it was agreed by the council that portions of east
side of the park wall behind the apartments would be painted on request.
The council discussed the Resolution of the Kenilworth owners re-
garding tour busses being parked on Collins Avenue, contractors disrupting
traffic and the malfunctioning of traffic signals. Mr. Maley reported that
Dade County had reset three of the lights and the other two were being worked
on. Also the matter of the contractors and busses blocking traffic had been
taken up by the Chief of Police with those involved.
Mr. Beatty was authorized to represent Bal Harbour at the testimonial
dinner honoring Dan Sullivan of the Crime Commission.
On motion of Mr. Davis, seconded by Mr. Taplin, the meeting was ad-
