HomeMy Public PortalAbout1986-050Member /Ve itdt1 introduced the following resolution and moved its adoption: CITY OF MEDINA RESOLUTION NO. cY1_.�� RESOLUTION GRANTING VARIANCES TO PADDY AND ANNE THEIS TO PERMIT THE CONSTRUCTION OF A SECOND ACCESSORY STRUCTURE ON LOTS 5-7, BLOCK 9, INDEPENDENCE BEACH WHEREAS, Paddy and Anne Theis (Applicants) have applied for two variances to build an accessory structure on their property, where is legally described as Lots 5-7, Block 9, Independence Beach, Hennepin County, Minnesota; and WHEREAS, the proposed accessory building would be the second detached accessory building on said property and would be located 23 feet from the right-of-way of Walnut Street; and WHEREAS, Section 825.09 of the Medina City Code restricts the number of detached accessory buildings on said property to one; and WHEREAS, Section 826.35 of the Medina City Code requires a front yard setback of 30 feet for all such buildings; and WHEREAS, the Medina City Code allows the city council to grant variances from the strict interpretation of zoning require- ments in the case of demonstrated hardship and if granting the variances will not violate the spirit and intent of the ordi- nance; and WHEREAS, the Applicants appeared before the planning commis- sion on May 13, 1986 and the city council on June 17, 1986 in regard to this request. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Medina, Minnesota that the following variances be granted to the Applicants for the reasons that the accessory structure cannot be attached to the existing garage or to the house due to unstable ground and the setback of the accessory will be consis- tent with the existing setback of the house: 1. A variance is granted from Section 825.09 of the Medina City Code to permit a second detached accessory structure on the Applicant's property. 2. A variance is granted from Section 826.35 of the Medina City Code to permit the second detached accessory structure to be built within 23 feet of the right-of-way of Walnut Street. BE IT FURTHER RESOLVED by the City Council of the City of Medina as follows: 3. The variances granted hereby shall be valid for a period of one year from the date of this resolution. 4. Construction of the accessory structure shall be in substan- tial compliance with the plans and specifications submitted by the Applicants and reviewed by the planning commission and city council. 5. Construction of the accessory structure shall be in full compliance with the city's building code and all other relevant ordinances of the city. 6. It is hereby declared that a violation of any of the forego- ing conditions upon which the variances are granted is a violation of the Medina City Code. DATED: duL4 J , 1986.
