HomeMy Public PortalAboutORD14918 BILL NO. 2011-136 SPONSORED BY COUNCILMAN: Scrivner ORDINANCE NO. 1 1 I y AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, VACATING AND DISCONTINUING A PORTION OF ALAMEDA DRIVE. WHEREAS, it has been shown to the Council of the City of Jefferson, Missouri, that the owner of land adjacent to and abutting upon a portion of Alameda Drive in the City, has petitioned the City Council to vacate a portion of said roadway; and WHEREAS, it has further been shown that it would not inconvenience the public or the citizens of the City to discontinue a portion of Alameda Drive for public use as described in Section 1 of this Ordinance; and WHEREAS, it has further been shown that it would not inconvenience the public or the citizens of the City to discontinue a portion of the roadway for public use as described in Section 1 of this Ordinance, subject to a reservation in the City of an easement in that portion of vacated property for the maintenance, repair, location and relocation of all sanitary sewer, surface water sewer or public utility facilities now existing within said roadway. NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE CITY OF JEFFERSON, MISSOURI, AS FOLLOWS: Section 1. The Council of the City of Jefferson, Missouri, hereby declares it necessary, reasonable, and proper to discontinue of Alameda Drive and forever vacate the following described property in said City: ALAMEDA DRIVE All of the third tract and part of the second tract of Alameda Drive, as described in Book 314, page 376, Cole County Recorder's Office, more particularly described as follows: A strip of land 60 feet wide across part of the South Half of Section 4, Township 44 North, Range 12 West, in the City of Jefferson, County of Cole, Missouri, the centerline of said 60 foot strip being more particularly described as follows: From the Southeast corner of said Section 4; thence S86'1 9'00"W, along the Section Line, 1788.03 feet to the southeast corner of a tract described by Quit-Claim Deed of Record in Book 240, Page 939, Cole County Recorder's Office; thence NO3°43'31"W, along the east line of said tract and along the east line of another tract described by Deed of Record in Book 240, page 938, Cole County Recorder's Office, 700.95 feet to the northeast corner thereof; thence S86°14'26"W, along the north line of said tract, in Book 240, page 938, 230.0 feet to the POINT OF BEGINNING for the centerline of this description; thence NO3 043'31"W, 332.53 feet to the intersection of the westerly extension of the northerly line of the tract described in Book 604, page 391, Cole County Recorder's Office and the point of Termination. ALSO: All that land that lies within a cul-de-sac having a radius of 50 feet, the center point of said cul-de-sac being more particularly described as follows: From the Southeast corner of said Section 4;thence S86 019'00"W, along the Section Line, 1788.03 feet to the southeast corner of a tract described by Quit-Claim Deed of Record in Book 240, Page 939, Cole County Recorder's Office; thence NO3 043'31"W, along the east line of said tract and along the east line of another tract described by Deed of Record in Book 240, page 938, Cole County Recorder's Office, 700.95 feet to the northeast corner thereof; thence S86°14'26"W, along the north line of said tract, in Book 240, page 938, 230.0 feet; thence NO3°43'31"W, 80.40 feet; thence S86'1 6'29"W, 20.00 feet to the center point of said cul-de-sac. Section 2. All that portion of the above vacated property is hereby retained as a perpetual easement for the construction, maintenance, repair, relocation, and operation of existing sanitary sewers, surface water drainage, and all public utility facilities. Section 3. The statutory right of reversion in the owners of the abutting property is hereby confirmed, as is provided by the laws of the State of Missouri, and the Mayor and the Clerk of the City are hereby authorized to execute all necessary instruments required to confirm the reversionary rights of the owner of property abutting on the area vacated, as described in Section 1 of this ordinance, in the property vacated, subject to the easement retained in Section 2. Section 4.
