SUBJ: Planning Department Updates for August 4, 2010 City Council Meeting
Ordinance Updates
A) Staging Point System — The Planning Commission held a Public Hearing on June 8 and
recommended approval with a number of changes. The City Council reviewed the
ordinance on July 6 and July 20 and has directed staff to make a few changes. Staff plans to
provide the updated ordinance at the August 17 City Council meeting.
B) RR-UR text amendment — The Planning Commission held a Public Hearing at the July 13
meeting and recommended approval, and the City Council approved the ordinance at the
July 20 meeting.
C) Re -zonings — as a result of the new zoning ordinances created by the City and because of
changes to the future use of a number of properties in the Comprehensive Plan, the City
needs to rezone a number of properties. 251 properties are proposed to be rezoned, and staff
has divided these into four Public Hearings which will be held at the August 11 Planning
Commission meeting.
D) Driveway setback regulations — during the review of the Lennar project, staff has noted an
inconsistency between the 5 -foot setback in the R-2 zoning district, and the requirement that
driveways be setback 10 feet from property lines. The Planning Commission recommended
that staff consider amendments to the driveway setback requirement.
E) Private Recreation Zoning District — staff believes that this ordinance is not essential for
the City's zoning ordinances to be consistent with the new Comp Plan. As a result, staff is
recommending that this ordinance be placed lower in the priority list.
Land Use Application Reviews
A) Enclave of Medina Subdivision — 3212 Hunter Drive — Lennar has submitted for
preliminary plat and Comp Plan Amendment for the Holasek property. The plat currently
identifies 135 single family homes and 41 townhomes. The applicant has requested to shift
the MUSA to the south to include an additional 6.5 net acres and is excluding 6.5 net acres
of the wooded area from development. A Public Hearing was held at the July 13 Planning
Commission meeting, and the Commission raised a number of concerns with the plan. The
Commission tabled the matter and urged the developer to update plans consistent with their
comments. Staff has been in contact with the developer, who is working on revised plans.
B) Hunter Ridge Farm Plat — 1382 Hunter Drive — Ron Carlson has requested subdivision of
an existing 13.9 acres parcels into two lots. The request contests the Hennepin County Soils
Survey in order to show adequate suitable soils for a subdivision. Staff has determined that
the application is incomplete for review at this time, and the application will be scheduled
for a Public Hearing when it is complete.

C) Fortuna Farms Plat — 1425 Tamarack Drive — Helmuth von Bluecher has requested
subdivision of an existing 44.2 acre parcel into three lots. The request contests the
Hennepin County Soils Survey in order to show adequate suitable soils for a subdivision.
Staff has determined that the application is incomplete for review at this time, and the
application will be scheduled for a Public Hearing when it is complete.
D) Hennepin County PUD Amendment — 1600 Prairie Drive — Hennepin County has requested
Final PUD Plan approval to construct the 397 -foot wind turbine at its Public Works facility.
Staff has began a preliminary review. If it is determined that the conditions of the PUD
approval are met, staff will prepare a PUD agreement for City Council approval.
E) Appeal of Administrative Decision — 2590 Keller Road — The City Council heard the
property owner's and contractor's appeal of the denial of a permit to construct a pair of
4'x4' monuments within the City right-of-way adjacent to 2590 Keller at the January 5
meeting and adopted a resolution ordering the removal of the improvements on February 3.
Staff provided an additional notice, and the monuments have not been removed. Staff will
begin discussing options and prepare for a hearing at a meeting in August for the Council to
determine what action to take.
F) Bradley Leawood 3rd Addn Plat — 3415 Leawood Drive — the City Council approved a
resolution for preliminary plat on July 6. The City will await an application for Final Plat.
G) Holy Name Cemetery — The City Council approved resolutions for the lot combination,
CUP/Site Plan, Interim Use Permit and easement vacation. Staff is working with the
applicant to get all necessary documents recorded correctly.
H) Wrangler's Restaurant — 32 Hamel Road — the Council approved resolutions at the July 21
meeting. Staff has been in contact with the applicant regarding recording of the plat and
requirements for submitting building permits. The City Council granted until September 11,
2010 for the applicant to final the plat.
Additional Projects
A) Zoning Enforcement (Hamel Station tree removal) — the City Council approved the
agreement with the developer related to the remediation of the violations of the tree
preservation ordinance and the shoreland overlay district. Staff is working to execute the
agreement and then the developer can begin work.
B) Zoning Enforcement (General) — Staff continues enforcement on a number of matters, and
has issued a number of orders to property owners of vacant lots in subdivisions to mow
weedy lots. A number of signs placed within the right-of-way are also being removed, but
staff is being selective during election season, as "non-commercial" signage is protected
during this time.

39 6. Public Hearing — Lennar "The Enclave of Medina" at 3212 Hunter Drive (PIDs 12-118-
40 23-43-0002 & 13-118-23-12-0001) — Comprehensive Plan Amendment, Rezoning,
41 Preliminary Plat, and Variance to reduce the width of the right-of-way within the
42 development. 134 single family homes and 41 townhomes are proposed on
43 approximately 109 gross acres (68.59 total net acres).

1 Nolan reprieved himself from the application due to his family having property immediately
2 north of the land use application. Martin also reprieved because her law firm represents the
3 Nolan family and would have interest on his behalf.

5 Grittman presented the project and identified the issues raised with the proposed project.

7 The 1st issue is the proposed density and if the Commission is comfortable with the number
8 of units.

10 The 2nd issue is the project is predominately single family homes, with 41 townhomes.
11 Grittman said part of the application included a comprehensive plan amendment to expand
12 the MUSA line in exchange for an environmental area on the east portion of the property.
13
14 The 3rd issue is the application proposes an R-2 district within an area guided for low density
15 residential uses which is in conflict with the zoning ordinance requirements.

17 The 4th issue is how the Planning Commission and Council feel about the potential for two
18 family homes in the subdivision.

20 The 5th issue is if the density bonus should apply to the proposed design. If not, the applicant
21 would be required to either relocate the amenity or reduce the number of townhome units to
22 39.

24 The 6th issue is the 70 foot building separation between townhomes is too close. It compares
25 to typical face-to-face dimensions of 110-120 feet in urban single family subdivisions. He
26 explained the zoning ordinance doesn't address concerns staff has related to the townhome
27 layout.

29 The 7th issue is the proposed single access cul-de-sac to the 41 townhome units. The single
30 access is in conflict with Chapter 8, Section 820.29, Subd.2.(g) of the Subdivision Ordinance.
31 All streets are proposed to be private.

33 The 8th issue is more procedural. While the zoning ordinance includes language referring to
34 private street use and allows townhome developments in the R-3 District, there isn't a formal
35 process for approving such development apart from a PUD zoning. In discussions with the
36 City Attorney and the development review committee staff members, the intent of the
37 ordinance would allow the project to go through the process without a PUD.

39 The 9th issue is the Planning Commission and Council should consider guest parking for the
40 townhomes and the issue of one access point.

42 The 11th issue is the proposed landscape plan for the townhome development is inconsistent
43 with the zoning ordinance requirements.

45 The 12th issue is the small garage sizes (proposed at 368 square feet). Staff recommends a
46 minimum garage size of 440 square feet.
