HomeMy Public PortalAbout1986-054Member Se `r moved its adoption: introduced the following resolution and CITY OF MEDINA RESOLUTION NO. �1. -S 4 RESOLUTION GRANTING A CONDITIONAL USE PERMIT TO B&D MACHINE, INC. WHEREAS, B&D Machine, Inc. (Applicant) has applied for permission to construct a commercial building at Kilkenny Lane for use by the existing business and addition of an anodiz- ing shop; and WHEREAS, the Medina city code permits the use of such property as proposed only upon the issuance of a conditional use permit; and WHEREAS, the Applicant appeared before the planning commis- sion on June 10, 1986 and the city council on July 1, 1986 in regard to this matter. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Medina, Minnesota that the Applicant's proposed use of the subject property is consistent with the ordinances of the city and will not impede the development of adjacent property and that a conditional use permit for the use is hereby granted, subject to the following conditions: 1. The Applicant shall obtain a permit from the Metropolitan Waste Control Commission for the disposal of the chemicals used in connection with the anodizing shop; 2. Occupancy of the portion of the building which will not be utilized by the Applicant shall be subject to administrative review by the zoning administrator. 3. The Applicant shall submit a landscaping plan which is acceptable to the zoning administrator. 4. The hours of operation of the Applicant's business shall be limited to 7:00 a.m. to midnight. 5. The Applicant shall remedy any electrical interference problems in the area caused by its operation at its sole expense. 6. The building exterior shall be reviewed by the zoning administrator for compliance with the performance standards of the Medina city code. 7. It is acknowledged that the site can accommodate only nine parking spaces and that the parking demand generated by the uses on the site cannot exceed that number. 8. Site drainage shall be reviewed by the city engineer. 9. Lighting and signs for the site shall be approved by the zoning administrator. 10. There shall be no exterior storage on site and the trash receptacle shall be screened with a material which is compatible with that of the building. 11. The Applicant shall submit a letter to the zoning adminis- trator detailing the nature of the proposed business. 12. The Applicant shall combine the parcels upon which the structure is located. BE IT FURTHER RESOLVED by the City Council of the City of Medina that the following variances be granted from the require- ments of Section 826.57 of the Medina City Code in connection with the construction of the proposed building: a) The front yard setback of the building be reduced from 50 feet to 40 feet; b) The rear yard setback of the building be reduced from 30 feet to 15 feet; c) The side yard setback of the building be reduced from 30 feet to 15 feet; and d) The setback of the parking area from the street be reduced from 50 feet to 25 feet; and that the reasons for granting such variances be noted as the location of the property on a cul-de-sac and consistency with other small properties in the vicinity.
