AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, AMENDING THE CITY
CODE, CHAPTER 32, ASSIGNING SIDEWALK DEFERRAL APPEALS TO THE
PLANNING AND ZONING COMMISSION.
BE IT ENACTED BY THE COUNCIL OF THE CITY OF JEFFERSON, MISSOURI, AS
FOLLOWS:
Section 1. Chapter 32 (Streets and Sidewalks), Section 103 (Sidewalks
Required), Subsection E, is amended as follows:
Section 32-103.Sidewalks Required.
E. Appeal of Denial of Deferral.
I. The denial of a deferral by the Director may be appealed to the G45,Gaunei-I Planning
and Zoning Commission.
a. An applicant aggrieved by the decision of the Director may file a written appeal
to the Ci�Ga,„aR" Planning and Zoning Commission, addressed to the City
Clerk,within 10 days of the decision of the Director;
b. Upon receipt of the appeal,the Planning and Zoning Chairman lvtayer shall
schedule a hearing on the appeal.
C. The burden of proof at the hearing shall be upon the applicant to show that the
applicant is eligible for the relief requested. (Ord.No. 14621, §1, 12-21-2009).
2. This decision of the Planning and Zoning Commission shall be final.
Section 2. This Ordinance shall be in full force and effect from nd after the
date of its ppssage and approval. ae�
