RESOLUTION GRANTING A VARIANCE
TO WILLIAM NELSON TO REDUCE THE
FRONT YARD SETBACK ON LOT 5,
BLOCK 16, INDEPENDENCE BEACH
WHEREAS, William Nelson (Applicant) has applied for varianc-
es to reduce the setbacks from 30 feet to 10 feet on the north,
east and south sides of Lot 5, Block 16, Independence Beach,
Hennepin County, Minnesota; and
WHEREAS, Section 826.35 of the Medina City Code requires
front and back yard setbacks of 30 feet in the urban residential
district; and
WHEREAS, the Medina city code allows the City Council to
grant such variances from the strict interpretation of the zoning
requirements in the case of demonstrated hardship and if granting
the variances will not violate the spirit and intent of the
ordinance; and
WHEREAS, the Applicant appeared before the Planning Commis-
sion on July 8, 1986 and the City Council on July 15, 1986 in
regard to this request.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Medina, Minnesota that a variance be granted to reduce
the front yard setback on the south side of the property (towards
Ash Street) from 30 feet to 15 feet because of the configuration
and orientation of the lot and due to drainage problems on the
lot.
BE IT FURTHER RESOLVED by the City Council of Medina as
follows:
1. The variance hereby granted shall be valid for a period of
one year from the date of this resolution.
2. Construction of a house on the subject property shall be in
compliance with all other relevant codes and regulations of
the City.
3. It is hereby declared that a violation of any of the forego-
ing conditions upon which the variance is granted is a
violation of the Medina City Code.
