CALL TO ORDER: I Mayor Tyrell called the regular meeting of the City Council to order at 7:34 p.m. on Tuesday, February 6, 1979, in the Council Chamber of the City Hall. 2. INVOCATION: The invocation was given by Father John Keese, St. Luke's Catholic Church, 9451 E. Broadway. 3. The Pledge of Allegiance to the Flag was led by Mayor Tyrell. 4. ROLL CALL: Present: Absent: Also Present: Councilmen- Atkins, Dennis, Gillanders, Merritt, Tyrell Councilmen -None City Manager Koski, City Attorney Martin, Assistant City Manager Pucci, Planning Director Dragicevich, Parks and Recreation Director Kobett, Lt. Jeanne Robertson, Temple Station, and Steve Johnston, Temple City Times 5. CONSENT CALENDAR: Item B(2). was removed from the Consent Calendar. On motion by Councilman Atkins, seconded by Councilman Gillanders, Items A, B(1)., and C through F were approved as recommended. A. APPROVAL OF MINUTES: Regular Meeting of January 16, 1979 Approved as written, Councilman Dennis abstaining. B. RECOMMENDATION FROM PARKS & RECREATION COMMISSION - (1) Approved request from Temple City American Little League to conduct a Jog -A -Thon at Live Oak Park, March 9, 1979,7 -8 p.m. C. ACCEPTANCE OF WORK: STREET IMPROVEMENTS - RESURFACING OF LEMON AVENUE, OAK AVENUE TO TEMPLE CITY BOULEVARD Accepted the work performed; authorized payment in the amount of $8,380.42 to Vernon Paving; authorized filing of Notice of Completion and release of the 10% retention at the end of the 35 -day lien period. D. STUDENT AND THE LAW: CANCELLATION OF AGREEMENT - St. Luke's Approved cancellation of the Agreement between City and St. Luke's Catholic School for the Student and the Law Program. E. RESOLUTION NO. 79-1779: EMPLOYMENT OF PERSONNEL Adopted Resdltition No. 79 -1779 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY APPOINTING PERSONNEL. F. RESOLUTION NO. 79- 1780: WARRANTS & DEMANDS Adopted Resolution No. 79 -1780 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY ALLOWING CLAIMS AND DEMANDS IN THE SUM OF $139,389.66, DEMAND NOS. 11292 THRU 11405. Council Minutes, February 6, 1979 - Page 2 CONSENT ITEM B(2) - PROPOSED LOS ANGELES COUNTY TENNIS COURT FEE AND RESERVATION SYSTEM Councilman Atkins stated county golf courses have a fee and reservation system and he has no objection to the same method for tennis courts. Mayor Tyrell stated he had received the county proposal for review from Supervisor Schabarum and has two objections: 1) the cost for someone to operate the fee and reservation system will not be off - set by the fees received; and 2) juniors would be unable to use the facilities for financial reasons. Mayor Tyrell also felt such a system would lead to persons seeking free tennis courts and place a burden on City -owned courts. Councilman Atkins moved to deny Parks and Recreation Commission recommendation and to support the proposed county fee and reservation system for county -owned courts, seconded by Councilman Merritt. Motion failed on a roll call vote: ROLL CALL: AYES: Councilmen- Atkins, Merritt NOES: Councilmen- Dennis, Gillanders, Tyrell Councilman Dennis moved to concur with the Parks and Recreation Commission recommendation to oppose the proposed fee and reservation system, seconded by Mayor Tyrell and carried on a roll call vote: ROLL CALL: AYES: Councilmen- Dennis, Gillanders, Tyrell NOES: Councilmen- Atkins, Merritt UNFINISHED BUSINESS: 6. PUBLIC HEARING: 7:30 p.m. PROPOSED AMENDMENT TO GENERAL PLAN - CASE NO. 78 -1 City Manager Koski presented background information, stating the Planning Commission, at their regular meeting held January 9,.1979, adopted resolution recommending an amendment to the General Plan for the area generally located south of Lower Azusa Road, between Temple City Boulevard and Ellis Lane, which is currently zoned R -4, Limited-Commercial -Heavy Multiple residential. The General Plan shows the site as suitable for manufacturing uses, no interest has been expressed to develop for commercial or industrial uses, recently a 4 -unit apartment was completed and a new 4 -unit apart - ment-is under construction. There also is a. tentative proposal for an additional multiple residential development as a condominium. The property has an area of 4,2 acres, there are-19 parcels involved with a total of 24 units, the site has 720 ft. frontage on Temple City Boulevard and 835 ft, frontage on Ellis Lane. A draft Environ- mental Impact Report was prepared and published in accordance with the California Environmental Quality Act of 1970, as amended. Pro- perty owners involved have been notified. City Council, at their regular meeting held January 16, 1979, set public hearing for February 6, 1979. There being no further staff report, Mayor Tyrell declared the public hearing open. No one came forward to speak to the issue and Councilman Merritt moved to close public hearing, seconded by Councilman Atkins and carried. Councilman Atkins moved that the City Council certify that the Environmental Impact Report has been completed in conformance with the California Environmental Quality Act and the State guidelines and that the City Council has reviewed and considered the information contained in the report; that the final Environmental Impact Report is adequate and provides reasonable information; that each and every adverse environmental impact contained 'in the report is overruled and counterbalanced by mitigation of such adverse effects is not Council Minutes, February 6, 1979 - Page 3 feasible under the circumstances, seconded by Councilman Gillanders and carried. Councilman Atkins moved to adopt Resolution No. 79 -1781 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY RECLASSIFYING CERTAIN' PROPERTY AND AMENDING THE GENERAL PLAN IN CONNECTION THEREWITH, seconded by Councilman Gillanders and carried. NEW BUSINESS: None. 7, COMMUNICATIONS: 1 A. Council received and filed a communication from the Temple City Chamber of Commerce Board of Directors in which they re- affirmed their support of enforcement of parking in restricted areas. B. 35th Annual Camellia Festival Committee - Request to use Facilities February 23, 24, and 25, 1979 City Manager Koski presented a request from Jim Durfee, Chairman of the 35th Annual Camellia Festival, for use of bleachers, light standards for hanging banners, street parking ban as needed, use of Temple City Park, all as set forth in their letter dated January 18, 1979. Councilman Atkins moved to approve, subject to necessary permits, legal requirements and certificate of insurance, seconded by Councilman Gillanders and carried. C. Claims for Damages - 1) Automobile Club of Southern California - Subrogation Rights 2) Yolanda Martinez, 1235 Charlotte, San Gabriel 3) Frances Fox, 429 Las Tunas, Arcadia City Manager Koski presented claims for damages as set forth in staff memo dated February 6, 1979; 1) for accident on November 1, 1978 at Temple City Boulevard and Las Tunas Drive while signal lights were being repaired by Signal Maintenance Co.; 2) a fall on the sidewalk at Workman and Temple City Boulevard January 22, 1979; and 3) a fall on the sidewalk near Temple City Park February 4, 1979, respectively. Councilman Gillanders moved to deny the claims for damages and refer the claims to JPIA for further processing, seconded by Councilman Merritt and carried. 8. TIME FOR THOSE IN THE AUDIENCE WHO WISH TO SPEAK: Mar Lou Swain, President, Temple City Chamber of Commerce, stated the merc ants had received notification of a tax assessment for litter control and recycling this morning. The assessment, based on- retail sales, number of employees, and /or location and type of business is due February 28 and has come as a total surprise to most merchants. In answer to question from City Council, Assistant City Manager Pucci advised the City received notification that grants were available for litter control purposes and that it was determined the City would not be eligible for funds; however, nothing in the notification indicated the source of the funding. Council directed the City Attorney to prepare a letter to the appropriate legislators opposing the assessment. RECESS TO CRA: City Council recessed at 8 p.m, to meet as the Community Redevelopment Agency, all members being present; approved request to conduct "Country Council Minutes, February 6, 1979 - Page 4 Fair" in a portion of the Agency parking lot on Rosemead Boulevard; approved request for 2 handicapped parking spaces in front of K -Mart; approved reconciliation and acknowledged claim from EGS and authorized Executive Director to sign Certificate of Completion for Parcel B -1(c); and adopted resolution approving warrants and demands. Minutes are set forth in full in the records of the Agency. RECONVENE AS CITY COUNCIL: 9. ACTION ON REQUEST BY CRA: Councilman Gillanders moved to approve and confirm the action of the Community Redevelopment Agency to allow the merchants in the Rosemead Boulevard Redevelopment Project area to conduct a "Country Fair" subject to the approval of all the businesses, their responsi- bility for permits and fees necessary for safety inspection by the County Engineers, a certificate of insurance on file in the City Clerk's office naming the City of Temple City and the Temple City Community Redevelopment Agency as additionally insured in the amount of $5,000,000, and a Performance Bond or cash in the amount of $5,pOO on deposit with the City Clerk as a guarantee against damage to the public parking facilities, seconded by Mayor Tyrell and carried. 10. MATTERS FROM CITY OFFICIALS: A. City Treasurer's Seminar - San Diego, April 17 -20, 1979 Councilman Merritt moved to approve the City Treasurer's attendance to subject seminar and authorize necessary expenses, seconded by Councilman Dennis and carried. B. California Parks and Recreation Society Conference - San Diego, March 2 -5, 1979' Councilman Merritt moved to approve Commissioners Burlingame and Crump and Director Kobett attendance to subject seminar and authorize necessary expenses, seconded by Councilman Dennis and carried. C. San Gabriel Valley Humane Society - .Poundmaster Contract City Manager Koski presented communication from San Gabriel Valley Humane Society indicating they will continue poundmaster services contingent upon an increase in boarding fees from a flat $8 to $4 per day. Councilman Dennis moved to approve extension of the agreement with an increase in animal boarding fee to $4 per day, seconded by Councilman Atkins and carried, Mayor Tyrell abstaining. D. Temple City Communications Committee City-Manager Koski distributed copies of the January 24 meeting of the Temple City Communications Committee, advising the committee recommends to-theCity Council that street lights be converted to high pressure sodium where financially advantageous. Council concurred with the Communications Committee recommendation and instructed staff to contact Southern California Edison in order to get -on their waiting list to replace the Edison owned lamps, and requested-staff report back with a recommendation on those specific lights which would be converted. E. Councilman Atkins. advised the next meeting of the San Gabriel' Valley Association of Cities will be held Thursday, February 15 at the Cask and Cleaver, the program to be,Carl Forbes, Chief Engineer with the California Department of Transportation.. Council Minutes, February 6, 1979 - Page 5 Councilman Atkins also directed Council's attention to a thrust being made in Sacramento toward increasing the highway speed limit in California to 65 mph and requested Council's support. City Council referred the matter to the Traffic Commission for their review and comment.. F. Councilman Gillanders advised that during the recent legislative tour in Sacramento there was much talk of bail out monies to the cities and funding by an increase in sales tax by one penny with the revenue being split 40 -40 -20 between special districts, counties and cities. ADJOURNMENT: On motion by Councilman Dennis, seconded by Councilman Gillanders, meeting adjourned to a Study Session at 8:30 p.m. Next regular meeting of the City Council will be held Tuesday, February 20, 1979, 7:30 p.m, in the Council Chamber of the City Hall.
