HomeMy Public PortalAboutMinutes - 3/27/1959297 Wellsburg, Iowa March 27, 1959 u The Town Council of the Town of Wellsburg, Iowa, met in special session in the Council Chambers in the Town Hall at 7:30 o'clock P.M. on the above date. There were present Mayor L. G. Groninga in the chair and the following named Councilmen: Lester Huisman, Charles Starr, Neil O'Kones and Mayo Tjaden. Absent: H. L. Luwe. The Mayor announced the purpose of the meeting being pursuant to publication of notice concerning the adoption of the Resolution of Necessity for the proposed street improvements in the Town of Wells- burg introduced in a meeting of this Council held on the 23rd day of February, 1959, said notices being both by publication in the Wells- burg herald on the 5th and 12th day of March, 1959, and on March 11 notice given by mail to all property owners within the assessment area by the said Town of Wellsburg which said notices were entitled "Notice of Hearing on Resolution of Necessity for Street Improvements in Wellsburg, Iowa," and that this meeting is for the specific purpose of considering objections to the final adoption of this Resolution. It appearing to the Mayor that publisher's Affidavit and Affidavit of Mailing of the "Notice of Hearing on Resolution of Necessity for Street Improvements in Wellsburg, Iowa", are on file and that the hearing thereon should proceed. The 14ayor called for objections to the adoption of the Resolution of Necessity for Street Improvements in Wellsburg, Iowa, either in writing or orally and having called for objections in writing and there being none previously filed or presented on his request, he invited any oral objections regarding the adoption of said Resolution of Necessity and the following objections were lodged, to -wit: 1. Harm C. and Antje Hunger objected that the property assessment was to high for benefit received. 2. Alberdena Geerdes, through her son, Clarence Geerdes, objected to the improvement extending to only a part of )+th Street rather than:all of 4th Street. 298 3. Henry Anderson objected that if part of 4th Street was to be improved, all of 4th Street should be improved and that while he was not against curb and gutter of said Street that the Town had ordered sidewalk in ten years ago which said walk would now be torn up and that it would be wrongful to now require that they be torn up. 4. Dick D. Huisman objected that the entirety of 4th Street rather than only portions of it should have been improved. 5. Aise Rust objected that the entirety of 4th Street rather than merely portions of it should be improved. b. Meint Tjaden objected that the cost of the project and the assessment was inproportionate to the benefit received by adjacent property. The Mayor asked for further oral objections and none were heard nor made. The Council then proceeded to consider objections on their merits. It was moved by Lester Huisman and seconded by Charles Starr: "That the Council after consultation with the project engineer, Hollis Ryken, give further consideration to the proposal of enacting a Resolution amending the Resolution of Necessity directed towards the proposition of substantially lowering the assessments proposed under the preliminary assessment schedule to all adjacent property and that independent of any present determination to amend the Resolution of Necessity that each and all of the oral objections of Harm C. and Antje Bunger, Alberdena Geerdes through her son, Clarence Geerdes, Henry Anderson, Dick D. Huisman, Aise Rust and Meint Tjaden be and the same are hereby overruled as to each and every person and in each and every particular." Motion submitted. Ayes - four; Nays - none; Absent - H. L. Luwe. Whereupon the Mayor declared the motion carried and the objections to the Resolution of Necessity overruled. Councilman Lester Huisman moved and Councilman Charles Starr seconded the motion: "That the Council adjourn this meeting to 8:00 o'clock P.M., April 9, 1959, and that at such time the Town Council meet in special session in the Council Chambers in the Town Hall of Wellsburg, Iowa, for its further and final consideration of the adoption of the Resolution of Necessity proposed, for the construction of 299 30" integral concrete curb and gutter, all as heretofore introduced, proposed and passed the �3rd day of February, 1959• Motion submitted. Ayes - four; Plays - none; Absent - H. L. Luwe.
