RESOLUTION NO. 98-54
A RESOLUTION OF THE TOWN COUNCIL OF THE TOWN OF
TRUCKEE AWARDING AND AUTHORIZING A CABLE TELEVISION
FRANCISE FROM DECEMBER 19, 1998 THROUGH SEPTEMBER 18, 1999
WHEREAS, the Town of Truckee has received cable service fi:om Weststar Communication
One since its incorporation under a franchise agreement issued by Nevada County prior to
incorporation; and
WHEREAS, the Town and the County have jointly retained consulting services and are in
the process of negotiating a franchise which will be consistent with current practices and procedures
in the industry; and
WHEREAS, it is necessary to create a new short-term franchise to comply with certain
requirements that now exist under the laws of Nevada County;
NOW THEREFORE, BE IT RESOLVED BY THE TOWN COUNCIL OF THE
TOWN OF TRUCKEE, that:
1. The Town of Truckee hereby awards to Weststar Communication One a cable
television franchise serving the customers within the municipal boundaries of the Town;
2. Such Franchise shall extend for a period of nine (9) months fi:om December 19, 1998
to September 18, 1999;
3. The Town franchise shall be on the same terms and conditions as that granted by the
County of Nevada for the unincorporated area for the same time period, including compliance with
Chapter II of the Nevada County Code-Franchises provided however, that:
a. Nothing in that Chapter or any action of Nevada County should serve to grant
a franchise for a term longer than that agreed to herein; and
b. Wherever the Nevada County Code provisions regarding cable television
franchise procedures for an obligation of, or duty to, Nevada County, that provision shall be
deemed and construed to extend to the Town of Truckee during the interim franchise period.
4. A letter agreement signed by the appropriate official of Weststar Communication One
and the Town Manager shall confirm this award of franchise.

The foregoing Resolution was introduced at a Regular Meeting of the Town Council of the Town
of Truckee, held on the 17~ day of December, 1998, by Councilmember McCormack who moved
its adoption, which motion being duly seconded by Councilmember Drake and upon roll call was
adopted by the following vote:

Councilmembers Drake, Florian, McCormack, Schneider, and Mayor Susman
