V, - 4 O RESOLUTION GRANTING FINAL PLAT APPROVAL FOR WINDANCE Whereas,Donald A.Stotts and Arlene B. Stotts and Wirtjes Construction Inc. (Applicants) have requested final approval of a plat to be known as Windance, which is located at 3000 Tamarack Drive on property .legally described as: The Southwest 1/4 of the Northeast 1/4 of Section 14, Township 118, Range 23, except the South 367 feet of the West 357 feet thereof, Hennepin County, Minnesota; and Now, Therefore, Be It Resolved by the City Council of the City of Medina, Minnesota that final plat approval is granted to the Applicant for Windance, subject to the following conditions: 1. It is acknowledged that the existing structure on proposed Lot 3, Block 1 is non -conforming and that it will be made to conform at the time of issuance of a building permit for said lot; 2. The Applicant shall conform to the conditions imposed by the Elm Creek Watershed District as set forth in its conditional approval letter dated the 9thday of July , 1986, a copy of which is attached hereto and made a part hereof by reference; 3. The Applicant shall pay $8,477.50 to the City Clerk for Park dedication fees for all lots except Lot 2, Block 1, Windance, Hennepin County; 4. Trappers Trail shall be constructed to city specifications for a public road and the intersection of Trappers Trail and Tamarack Drive shall be .lowered in accordance with reasonable engineering standards as set forth by the City Engineer; 5. The Applicant shall record restrictive covenants against Lot 3, Block 1 and Lot 5, Block 2, Windance, Hennepin County which prohibit the construction thereon of structures which are used or intended for the use of sheltering animals; 6. The Applicant shall pay to the city for administrative expenses the amount determined by the city staff to represent the actual cost to the city for review of the plat; and No 7. The Applicant shall execute a development contract in a form approved by the City Attorney and provide a performance bond in the amount of $ 111 ,000.00 to guarantee completion of the contract. MN 55343 Phone 612/544-8572 July 9, 1986 Mr. Jim Filipi North Star Engineering Co. 3025 Harbor Lane, Suite 207 Plymouth, Minnesota 55442 Dear Mr. Filipi: On behalf of the Elm Creek Watershed Management Commission, the Hennepin Conservation District will comment on the plans for the Windance development in Medina. The site is a residential development, located on Tamarack Road in Medina. It is not located within or adjacent to either an upland storage area or a flood plain. New construction includes a road servicing each of the large lots. The HCD evaluated the site in terms of erosion control because of its steeper slopes. The greatest risk of erosion is along the grading of the road through the site. The developer correctly showed the placement and construction of silt fences acting as check dams for sediment. Also, the developer showed the correct use of vegetative filter strips in order to catch any sediment during construction on each lot. The HCD recommends approval of the plan at the July meeting of the ECWMC with the condition that the silt fences be maintained until vegetation is established.
