RE: Fence located at 515 and 517 Butler Avenue, Tybee Island
Dear Ms. Gallup:
It has been brought to the attention of our department that your newly constructed fence at 515 and 517 Butler
Avenue is in violation of the City of Tybee Island Land Development Code Section 3-050, which I have
attached to this letter. Specifically, there is a shrub and the newly constructed fence that both violate the
maximum height of any obstruction within 25 feet of the right-of-way intersection.
In order to ensure compliance with our Land Development Code, there are two options for you at this point. The
first would be to lower both the shrub and the fence to three feet or below in height all points within the 25 feet
line from the intersecting line, which does not require the relocation of the fence. The other option would be the
removal of both the fence and the shrub within the 25 feet line completely, which effectively would then
relocate both to a location within your property that is not within the specified right-of-way line. Unfortunately,
this is a public safety issue at this point and will need to be corrected on your part no later than June 20, 2010. If
this does not take place, then the matter will be turned over to the City Marshal for proper enforcement.

Sec. 3-050. Obstruction to visions at street intersections.
Intersection requirements are intended to ensure better vehicle safety on the public roads of the city.A clear sight triangle
gives motorists a view of other oncoming motorists when approaching a road intersection.
On corner lots within all zoning districts, no fence, shrubbery, wall or other obstruction to the traffic sight vision, utility
poles, light poles, or sign standards, shall exceed a height of three feet within a triangular area formed by the intersection of the
right-of-way lines of two streets and a diagonal line which intersects the right-of-way lines at two points, each 25 feet from the
intersection of the right-of-way lines. In the case of a rounded corner, 25 feet from the point of intersection of their tangents,
provided however, the standards for signs, lights, or similar objects which are located at least 12 feet above the finished grade
shall be permitted.

I have been asked about the newly erected fence at the NW corner of 6th St &Butler. It appears to violate the
following section of our code. Would you check on it and let me know if it is in compliance?

This is a photo of the fence. By my estimate the fence is about 4 1/2 feet tall. It certainly blocks the view of
oncoming traffic on Butler.
