Presents the following Ordinance Seconded by Councilman
AN ORDINANCE OF THE BOROUGH OF
CARTERET ADOPTING AMENDMENTS' TO
THE WEST CARTERET COMMERCIAL
REDEVELOPMENT PLAN
(
WHEREAS, the Local Redevelopment and Housing Law, NJ.S.A. 40A:12A-I et seq.,
as amended and supplemented (the "Redevelopment Law") provides a process for
municipalities to participate in the redevelopment and improvement of areas in need of
redevelopment; and
WHEREAS, on October 28, 2004, the Borough Council adopted resolution number 04-
335 requesting that the Borough Planning Board (the "Planning Board") determine
whether certain real property located within the Borough constitutes an "area in need of
redevelopment" pursuant to the Redevelopment Law; and
WHEREAS, on January 27, 2005, the Borough Council adopted resolution number 05-
45 specifying that that proposed redevelopment study area be comprised of Block 372,
Lots I through 17, inclusive, on the Borough's Tax Map (collectively, the
''Redevelopment Area"); and
WHEREAS, on April 27, 2005, the Planning Board adopted a resolution of findings and
conclusions to recommend to the Borough Council that the Redevelopment Area be
designated an "area in need, .ofredevelopment" by the Borough; and
WHEREAS, on Jlme 2, 2005, the Borough Council, following the recommendation of
the Planning Board, . adopted resolution number 05-188 dete:rmin1ng that the
Redevelopment Area' constitutes an "area in need of redevelopment" under the
Redevelopment Law; and
WHEREAS, on August II, 2005, the Borough Council adopted resolution number 05-
245 directing Beacon Planning and Consulting Services ("BPCS") to prepare a
redevelopment plan; and
WHEREAS, BPCS prepared a redevelopment plan (the "Original Redevelopment Plan",
for the Redevelopment Area, dated October 2005, entitled "West Carteret Conunercial
Redevelopment Plan"; and
WHEREAS, on November 30, 2005, the Planning Board adopted a resolntion of
findings and conclusions endorsing and recommending final adoption of the Original
Redevelopment Plan; and
WHEREAS, on December 15,2005, the Borough Council, pursuant to Section 7 of the
-Redevelopment Law (NJ.S.A. 40A:12A-7) and based on the recommendation of the
Planning Board, adopted ordinance number 05-63 approving and adopting the Original
Redevelopment Plan; and
\VHEREAS, in furtherance of redeveloping the Redevelopment Area, on December 6,
2007, the Borough Council adopted resolution number 07-304 authorizing and directing
the Planning Board to prepare amendments to the Original Redevelopment Plan (the
"Amended Redevelopment Plan", a copy of which is attached hereto as Exhibit A); and

WHEREAS, on December 19, 2007, the Planning Board adopted a resolution of findings
and conclusions endorsing and ,recommending final adoption of the Amended
Redevelopment Plan.
NOW THEREFORE, BE IT ORDAINED AND ENACTED, by the' Borough Council
ofthe Borough ofCarteret, Middlesex County, New Jersey, as follows:
Section 1. The recommendations of the Planning Board as set forth in its
December 19, 2007 resolution are hereby accepted.
Section 2. The Amended Redevelopment Plan is hereby adopted as the
official redevelopment plan for the Redevelopment Area.
Section 3. The zoning district map of the Borough's Land Development
Ordinance is hereby amended to reflect the applicability of the Amended Redevelopment
Plan to the Redevelopment Area and the Borough's Land Development Ordinance as it
affects the Redevelopment Area is hereby superseded by the Amended Redevelopment
Plan to the extent set forth therein.
Section 4. Ally and all ordinance or resolutions of the Borough, or provision
thereof, inconsistent with the provisions of this Ordinance shall be and are hereby
repealed as to the extent of any such inconsistencies.

Section 5. If any section, subsection, part, clause or phrase of this Ordinance
or the Amended Redevelopment Plan shall be declared invalid by judgment of any Court
of competent jurisdiction, such section, subsection, part, clause or phrase shall be deemed
to be severable from the remainder of this Ordinance or the Amended Redevelopment
Plan, as applicable.
Section 6. This Ordinance shall take effect upon final passage and publication
in accordance with applicable law.
