HomeMy Public PortalAboutORD14926 BILL NO. 2011-147 SPONSOR: Councilman Scrivnner ORDINANCE NO. /q-4--/,,�(2 AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, VACATING AND DISCONTINUING AN EASEMENT ON LOT 40, THE TRAILS OF KAUFFMAN HILLS, SECTION THREE. WHEREAS, it has been shown to the Council of the City of Jefferson, Missouri, that the owner of land of Lot 40, The Trails of Kauffman Hills, Section Three in the City, has petitioned the City Council to vacate an easement; and WHEREAS, it has further been shown that it would not inconvenience the public or the citizens of the City to discontinue an easement on Lot 40, The Trails of Kauffman Hills, Section Three for public use as described in Section 1 of this ordinance. NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE CITY OF JEFFERSON, MISSOURI, AS FOLLOWS: Section 1. The Council of the City of Jefferson, Missouri, hereby declares it necessary, reasonable, and proper to discontinue an easement on Lot 40, The Trails of Kauffman Hills, Section Three and forever vacate the following described property in said City: LOT40, THE TRAILS OF KAUFFMAN HILLS, SECTION THREE EASEMENT VACATION DESCRIPTION Part of a Storm and Sanitary Sewer easement being a part of Lot 40 of The Trails of Kauffman Hills Section 3, as per Plat Book 12, page 593, Cole County Recorder's Office, in the City of Jefferson, Cole County, Missouri, more particularly described as follows: From the southeasterly corner of said Lot 40 of The Trails of Kauffman Hills Section 3; thence N26 002'34"W, along the easterly line of said Lot 40, 15.00 feet to the POINT OF BEGINNING forthis description;thence S63 057'26"W, 29.61 feet to a point on the westerly line of said Storm and Sanitary Sewer easement; thence N43 025'47"W, along the westerly line of said Storm and Sanitary Sewer easement, 130.26 feet; thence S61°43'14"E, 80.39 feet; thence S4601 1'25"E, 62.85 feet to the point of beginning. Containing 2,517 sq. ft. Section 2. All that portion of the above vacated property is hereby retained as a perpetual easement for the construction, maintenance, repair, relocation and operation of existing sanitary sewers, surface water drainage, and all public utility facilities. Section 3. The statutory right of reversion in the owners of the abutting property is hereby confirmed, as is provided by the laws of the State of Missouri, and the Mayor and the Clerk of the City are hereby authorized to execute all necessary instruments required to confirm the reversionary rights of the owner of property abutting on the area vacated, as described in Section 1 of this ordinance, in the property vacated.
