NOW,THEREFORE,BE IT DULY RESOLVED BY THE CITY COMMISSION OF THE CITY OF OPA-LOCKA, FLORIDA: Section 1. The recitals to the preamble are hereby incorporated by reference. Section 2. Description: On June 30, 2009 the Miami Dade County Board of Commissioners authorized the amending of the Office of Economic Development FY 2009 Action Plan. With the recapturing of these unexpended funds, OCED then allocated additional monies to various identified projects from its Community Advisory Committee Fund Reserve Allocations. The Sherbondy Park Pool/Gymnasium project was assigned$75,000 from the Opa-locka CAC Reserve Fund. Financial Impact: Approval of this resolution creates a positive impact for the City. Implementation Time Line: The award letter indicates that the approving resolution to accept these new funds must be submitted by Friday,July 24, 2009. Legislative History: See Resolution No. 09-7432 Recommendation(s): Staff Recommends Approval 1 Analysis: The Sherbondy Park Improvement Project is one of the most significant planned capital projects in the City. Rehabilitating this park into a modern facility will provide a great outlet for the community, athletic and recreational functions and activities for residents of all ages. Its completion will greatly improve the quality of life for all residents. The acceptance of these new monies will expedite this process. Burgess lit Resolution No.R-914-09 County Manager 4 ' Subject: Resolution Amending the FY 2009 Action Plan to Reprogram Multi-Year Community Development Block Grant(CDBG), Home Investment Partnership Program and Rental Rehabilitation Funds RECOMMENDATION It is recommended that the Board of County Commissioners (BCC) authorize the Mayor or Mayor's designee to amend the FY 2009 Action Plan to recapture unexpended funds from current and prior year projects and reallocate $4,713,093.22 of FY 2000, FY 2001, FY 2002, FY 2003, FY 2004, FY 2005, FY 2006, FY 2007, FY 2008 and FY 2009 Community Development Block Grant (CDBG) funds and $5,475,940.79 in Home Investment Partnership Program (HOME) and Rental Rehabilitation (RR) funds as indicated in the attached Exhibit 1. The $4,713,093.22 in recaptured and reallocated CDBG funds includes $269,746 in additional FY 2009 entitlement funds received by US HUD. SCOPE Exhibit 1 includes information on each project by Commission District. These projects may benefit more than one Commission District or in some cases may have a countywide benefit. FISCAL IMPACT Approval of this resolution does not create a negative fiscal impact to the County. A total of $4,713,093.22 in multi-year CDBG funds and $5,475,940.79 in HOME and RR funds are recommended for. recapture from activities that: 1) are no longer viable, 2) are completed and have unexpended balances, or 3) have expired contracts. The recaptured funds are recommended for reallocation to complete affordable housing, capital improvement and economic development projects in the Neighborhood Revitalization Strategy Areas (NSRAs), and other eligible geographic areas throughout Miami-Dade County. The reprogramming of funds to activities that achieve their intended goals and objectives within certain timeframes reduces the County's risk of having CDBG and HOME funds deobligated by the federal government. BACKGROUND The BCC approved the FY 2009 Action Plan on October 21, 2008 through Resolution R-1127-08. Activities funded throughout the year are monitored for progress and compliance. Funds from completed activities or those activities that are no longer feasible have been identified for recapture and recommended for reallocation to meet the needs of on-going initiatives. HOME and RR ($5,475,940.79) As stated previously, staff is recommending the recapture of funds from projects that cannot be carried out, are completed and have unexpended balances, or have expired contracts; in addition, there is one project, Cielo Apartments, which has not been cancelled or completed but is part of the recommendation for recapture and reallocation. Pursuant to RR guidelines, projects located within entitlement jurisdictions must have a 25 percent match from the entitlement. The developer has been unable to receive a match l Honorable Chairman Dennis C. Moss and Members, Board of County Commissioners Page 2 and has requested that the project be allocated CDBG. Staff is recommending the swapping of RR funds with CDBG funds as this is still deemed a viable project. At the request of St. Johns CDC, staff is recommending the recapture of HOME CHDO funds from St. John Townhomes, St. John Village Homes II, and St. John Courts, II. All projects are homeownership projects which are not feasible under current market conditions. In addition to the HOME CHDO funds being recaptured from St. Johns CDC, staff recommends the recapture of HOME CHDO funds from Codec, Inc. These recaptured HOME CHDO funds are recommended for reallocation to the two next-in-line projects that applied for funds in the 2009 RFA. These two projects are being developed as rental properties by St. Johns CDC. Six separate activities are recommended for funding. Three of the projects being recommended are next-in- line projects from the FY 2009 RFA process that are ready to start. All allocations to capital housing projects are subject to a Subsidy Layering Review(SLR). The allocations are as follows: • St.John CDC,St John Apartments Rehabilitation ($408,482) The St. Johns Apartments have received prior year HOME and Surtax funds for the purpose of rehabilitating a 35-unit apartment located in Overtown. This is a currently County funded project under construction and has a funding gap as stipulated in the FY 2009 RFA application of$408,482. In order to comply with OCED's mandate of finishing what we started, HOME CHDO set aside funds are being recommended to complete this project. • St.John CDC,St.John Village Apartment($1,083,000) This 16-unit apartment building has received prior year HOME CHDO set aside funds for the purpose of rehabilitation. The units are currently vacant and will be targeted to very low-income families and the elderly. In order to comply with OCED's mandate of finish what we started, HOME CHDO set aside funds are being allocated to the project. • UDG II, LLC,The Atrium at Spring Garden ($1,880,000) The Atrium is a multi-family homeownership development. The building has 14 set-aside units for low- and moderate-income families and received Surtax funding in 2005. The developer applied for funding in 2009 and is considered a next-in-line project as it did not receive funding under this past cycle. However, construction on the project started and reached approximately 30 percent completion until it ceased due to a lack of funds. Since the project began construction using local Surtax funds, the allocation of federal funds after construction begins requires US HUD approval. Accordingly, upon approval of the re-allocation by the BCC, this project will be submitted to US HUD. Should US HUD not approve the allocation of federal HOME funds, OCED will return to the BCC with a new funding recommendation. • Miami-Dade Community Action Agency(CAA)-Housing Assistance Grant($1,000,000) The purpose of this program is to provide relocation assistance (such as the payment of security and utility deposits)to low-income families who cannot afford these upfront costs when relocating to another residence. In the past, the program has also assisted mobile home park residents who have been displaced by redevelopment. The program was previously administered by the Department of Human Services but is now administered by CM. • Section 8 Homeownership($739,488.44) The Section 8 Homeownership program is administered by OCED and provides second mortgage assistance to Section 8 voucher holders. The eligible homeowner is only required to pay 30 percent of their monthly adjusted gross income while the Section 8 voucher contributes the rest. • Brownsville Villas Affordable Rental Apartments,Brownsville Limited ($364,970.35) Brownsville Villas is a FY 2009 RFA next-in-line housing project. The developer, Brownsville Limited, requested $1,207,040 for the rehabilitation of 64 units (4 units across 16 buildings) in the Brownsville area. The remaining balance of CDBG reallocation funds available to fund this project is $364,970.35. Although the recommended amount is less than what is being requested, the developer will be able to rehabilitate the buildings which are most in need. In addition, the developer Honorable Chairman Dennis C. Moss and Members, Board of County Commissioners Page 3 can also apply for future funds to complete the remaining buildings. At which time, the underwriting process will review how much is still needed to complete the work. Community Development Block Grant Funds ($4,713,093.22) The total amount of CDBG funds recommended for recapture is $4,713,093.22 which includes $925,000 of reprogrammed funds from the Community Advisory Committee Reserve (CAC) and $269,746 in additional FY 2009 entitlement funds received by US HUD. Community Advisory Committee(CAC)Fund Reserve Allocations CAC balances are not being recaptured, but are in fact being allocated from the CAC Reserves (FY 2009 and prior year unexpended balances)to activities identified by each CAC as follows: • $100,000 from the FY 2008 Opa-Locka CAC Reserve Fund to fund the City of Opa-Locka for its Sherbondy Park Pool/Gymnasium project ($75,000) and the Opa-Locka CDC for the HURT Building ($25,000). • $100,000 from the FY 2009 Goulds CAC Reserve Fund to fund the Business and Technology Corporation Carrie P. Meek Center ($50,000), the Neighbors and Neighbors Farmer's.Market ($10,000), and the remaining$40,000 will be allocated to a"Project To Be Determined"within the next 60 days. • $100,000 from the FY 2008 Goulds CAC Reserve Fund to fund the Association for Development of the Exceptional (ADE) South Facility Expansion project ($50,000) and the South Dade Air Conditioning and Refrigeration Job Creation Program ($50,000). • $100,000 from the FY 2008 Melrose CAC Reserve Fund to fund the Dynamic CDC for economic development and technical assistance ($25,000), the Latin Chamber of Commerce for Micro Enterprise Assistance ($50,000), and Neighbors and Neighbors for economic development technical assistance ($25,000). • $100,000 from the FY 2009 Melrose CAC Reserve Fund to fund the Dynamic CDC for economic development and technical assistance ($50,000), and to Camacol for the Revolving Loan Fund for Business Development ($50,000). • $100,000 from the FY 2008 South Miami CAC Reserve Fund to fund the City of South Miami Murray Park Aquatic Center. • $100,000 from the FY 2009 South Miami CAC Reserve Fund to fund the City of South Miami Murray Park Aquatic Center. • $100,000 from the FY 2008 Perrine CAC Reserve Fund to fund the County's Park and Recreation Department for the rehabilitation of Ben Shavis Park. • $100,000 from the FY 2009 Perrine CAC Reserve Fund to fund the Black Economic Development dba Tools for Change Micro Enterprise Assistance and Peer Lending Program ($25,000), Partners for Self Employment dba Micro-Business USA Micro Enterprise Assistance and Peer Lending Program ($25,000), the South Dade Air Conditioning and Refrigeration Job Creation Program ($25,000), and the remaining $25,000 will be allocated to a project"To Be Determined" by the CAC within the next 60 days. • $25,000 from the West Little River CAC to fund Cliff's Restaurant for the rehabilitation of the business' property. Additional Reserve Allocations It should be noted that of the seven CDBG activities recommended for redistribution of funds, four will expend these funds by no later than September 30, 2009. • $2,221,000 to the County's Community Action Agency for the Ophelia Brown Head Start Center (formerly known as the Opa-Locka Head Start). These funds are replacing Capital Outlay Reserve funds previously appropriated for this project. • $392,093.22 to OCED for the Homebuyer Assistance Program, which will provide second mortgage assistance to eligible homebuyers • $300,000 to OCED for the completion of the West Little River Right of Way (ROW) capital improvement project. 3 Honorable Chairman Dennis C. Moss and Members, Board of County Commissioners Page 4 • $200,000 to OCED for the Individual Development Account (IDA) program. The program was previously administered by the Housing Finance Authority (HFA) and provided matching funds to persons saving to purchase a home. Due to the high cost of homes in Miami-Dade County, many program participants were not able to save enough funds for a down payment on a home. As a result, the program was modified while under the purview of HFA from "saving for a home" to "saving to start a business" and to pay the related education costs. The program has been transferred to OCED and will be coordinated with the South Florida Workforce and the Miami Dade Chamber of Commerce so that a new plan to target potential participants can be developed. • $180,000 to OCED to administer the Miami Dade County/State of Florida Enterprise Zone Program. The Enterprise Zone program encourages investments and provides tax incentives to businesses locating or expanding in designated low- to moderate-income areas. In FY 2008-09, it was decided that the newly created Office of Economic Development Coordination (OEDC) should administer the program. It has been decided that the program will remain in OCED and as such the funds required to administer the program will be allocated to OCED. • $200,000 to the Miami-Dade Park and Recreation Department for infrastructure capital improvement projects located in NRSAs. • $295,000 to Cielo, LTD for the completion of Cielo Apartments, an 18-unit garden apartment complex. These CDBG funds, as noted earlier in this memorandum, are replacing previously allocated RR funds. TRACK RECORD/MONITORING Most of the entities being recommended for the reallocation of CDBG funding have successfully delivered the products and/or services per their contractual agreements with OCED. Others are in the process of completing their projects and the additional funds in this item will assist in meeting their objective in a timely manner. OCED through its planners, contracts officers, and project managers will work to monitor and manage the projects mentioned above to ensure successful completion and compliance with Federal guidelines and County policies. Background and Relevant legislation During the May 13,2009, Housing and Community Development Committee meeting,the Office of Community and Economic Development(OCED) Director explained that the United States Department of Housing and Urban Development(US HUD)has raised issues with the Miami-Dade County's CDBG balance exceeding 1.5 times its annual allocation. The OCED Director also stated that the Department needed to move roughly$20 million within the next five months. Committee members were also told to expect a recommendation to recapture$3.5 million of CDBG funding within the next month. Policy Change and Implication This resolution recaptures and reallocates$5,475,940.79 in HOME and RR funds and the resolution also recaptures and reallocates$4,713,093.22 in CDBG funds. Questions On handwritten page 1 of the cover memorandum it states that Rental Rehabilitation funds are being recaptured from Cielo Apartments(Cielo)pursuant to RR guidelines that require projects within entitlement jurisdictions to have a 25%match. This resolution will authorize the award of$295,000 in CDBG funds to Cielo to the RR funding. When was Cielo initially awarded RR funding? According to OCED staff, the funding for the Cielo Ltd project which is located in the City of Miami Beach was allocated through the FY 2008 Action Plan (Resolution R-1222-07). Rental Rehabilitation funds preceded the HOME Investment Partnership Program. The Rental Rehabilitation Program (RRP) was authorized by Congress as part of Section 17 of the United States Housing Act of 1937 which was enacted into law in Section 301 of the Housing and Urban-Rural Recovery Act of 1983, Pub. L. No. 98-181, 97 Stat 1153. Section 17 is codified at 42 U.S.C. 14370. The regulations for the program are codified at 24 CFR Part 511. RR funds help support the rehabilitation of eligible real property to be used primarily for residential rental purposes. In addition, RR funds are administered in the same manner as HOME Investment Partnership Program funds and are subject to all of the HOME Investment Partnership Program restrictions.
