A RESOLUTION OF THE CITY COMMISSION OF THE
CITY OF OPA-LOCKA, FLORIDA, AUTHORIZING THE
CITY MANAGER TO MAKE PAYMENT TO PAWA
ARCHITECT AND ENGINEERS INC., IN THE AMOUNT
OF TWELVE THOUSAND EIGHT HUNDRED DOLLARS
($12,800.00) FOR ADDITIONAL DESIGN SERVICES
REQUIRED TO COMPLETE THE CURTISS
DRIVE/PERVIZ AVENUE ROADWAY REHABILITATION
PROJECT, PAYABLE FROM ACCOUNT NO. 44- 541804
WHEREAS, on October 24, 2007, the City Commission of the City of Opa-locka ("City
Commission") adopted Resolution No. 07-7167, amending the existing Agreement for
professional design services with PAWA Architects and Engineers Inc. ("PAWA") by expanding
the scope of work for the Curtiss Drive/Pervis Avenue roadway rehabilitation project in an
amount not to exceed $147,200.00;
WHEREAS, in order to complete the Curtiss Drive / Pervis Avenue project, it was later
necessary to reproduce technical drawings required for the construction; and
WHEREAS, PAWA reproduced the technical drawings and performed additional design
services required to complete the project; and
WHEREAS, the additional design services resulted in the total project cost increasing to
$160,000.00; and
WHEREAS, during fiscal year 2007-2008, the City Manager submitted payment to
PAWA., for the additional design services required to complete the Curtiss Drive/ Pervis Avenue
project in the total amount of Twelve Thousand Eight Hundred Dollars ($12,800.00); and
WHEREAS, in order to reconcile the City's audit findings, the City Commission desires
to ratify the action taken by the City Manager during fiscal year 2007-2008 by submitting
payment to PAWA for the additional design services provided required to complete the Curtiss
Drive /Pervis Avenue project.
NOW, THEREFORE, BE IT DULY RESOLVED BY THE CITY COMMISSION
OF THE CITY OF OPA-LOCKA, FLORIDA:
Section 1. The recitals to the preamble are hereby incorporated by reference.
Section 2. The City Commission of the City of Opa-locka hereby ratifies the action
taken by the City Manager during fiscal year 2007-2008 by making payment to PAWA
Architects and Engineering, Inc. in the total amount of Twelve Thousand Eight Hundred Dollars
($12,800.00), for additional design services required to complete the Curtiss Drive/Pervis
Avenue roadway rehabilitation project, payable from Account No.44-541804.

Request: APPROVAL OF A RESOLUTION RATIFYING THE DECISION OF THE
CITY MANAGER TO EXPAND TWELVE THOUSAND EIGHT
HUNDRED DOLLARS ($12,800.00) AND PAY PAWA ENGINEERS INC.
FOR ADDITIONAL DESIGN SERVICES DURING THE
CONSTRUCTION OF THE CURTISS DRIVE/PERVIZ AVE ROADWAY
REHABILITATION PROJECT
Description: On October 24, 2009, the City of Opa-locka amended the existing professional
design services and construction management agreement with PAWA in amount not to exceed
147,200 (Resolution # 07-7167) for additional work given the award by Miami Dade County of
new funding to address unforeseen site conditions. In order to reconcile the City's audit findings
and ratify the action taken during fiscal year 2007-2008 to complete these professional services it
became necessary to reproduce as-built drawings not previously anticipated at the time the
original resolution at an extra cost of$12,800.
Financial Impact: The $12,800.00 expense for professional design services was budgeted under
City approved allocation for Capital Projects in the fiscal year 2007-2008.

Analysis: Given the time constraints and in order to avoid unnecessary delays with the
construction work and potential claims by the contractor which was mobilized on site, this extra
professional design service was authorized subject to ratification by the City Commission

WHEREAS, the original Curtiss Drive Roadway was conceived as phased construction due
to limited funding; and
WHEREAS, the first phase was to complete Curtiss Drive west only; and

and a portion of Pcrviz Avenue,which did not include drainage,in addition to roadway ranging from
NW 151'Street to Harem Avenue adversely impacted by construction; and
WHEREAS, city staff worked with OCED to obtain additional funding to expand the

WHEREAS, the expansion of the existing Curtiss Drive Roadway Improvements on the east
side will include new drainage, sidewalks,valley gutters, new roadway, sodding and planting, in
addition to repairing.

TECHNICAL SERVICES`DURING ESIGN AND BID(-PHASES:
1.1 Provide design_services for the project listed above. The design services
shall include;. Schematic, Design Development, and the production of
Construction Documents.
1.2, Assist the City with the bidding of the project. Initiate, organize and proctor
pre-bid conferences. Attend bid openings and evaluate bids. Analyze bids
and recommend the successful bidders. Submit bids to Agencies for
approval and final acceptance. Recommend final award of contracts.

2.0 TECHNICAL SERVICES DURING CONSTRUCTION PHASE:
2.1 Assist the City with the execution of the Contract Documents and the
issuance of Notice to Proceed (NTP). Organize and Officiate pre-
construction meetings and weekly/monthly construction meetings. Review

requests. Prepare change orders and. work orders for contractor(s).
Approve or reject payment applications for contractors.
2.2 Provide Resident Engineers and Inspectors. Prepare daily inspections log.
Prepare minutes for construction meetings.
The professional services fee for item 2.0 will be a fixed amount of Thirty Thousand

3.0 Additional.Services:
Budgetary requirements for services above and beyond the basic services, such
services include Public hearings, Meetings arising as a result of non project
issues. Design and inspection services for owner authorized changes or changes
due to"Acts of God"or unforeseen conditions.
The budgetary requirements for item 3.0 will be assessed and authorized during
items 1.0 and 2.0. -
Terms and Conditions: As per The Professional Services Agreement dated April
29th 2004, between the CITY OF OPA-LOCKA and PAWA Architects.S. Engineers, Inc.
Construction Phase fees will be payable in equal installments using art estimated
construction duration. •
Duration of Project Services: Three (3) months.
