CAVANAUGH AND EUGENIO DABROWSKI FOR A LOT COMBINATION/SUBDIVISION WHEREAS, W.J. Cavanaugh and Eugenio Dabrowski (Applicants) have requested approval of a combination/subdivision at the intersection of Maple and Cedar Streets on property legally described as: Lots 11-16, Block 2, Independence Beach, Hennepin County, Minnesota ; and WHEREAS, the City Council has previously granted preliminary approval of the lot combination/subdivision, based upon the plan attached hereto as Exhibit A; and WHEREAS, the City Council has reviewed the Applicants' lot combination/subdivision for compliance with the ordinances of the City and with conditions of preliminary approval; and WHEREAS, Lots 12-16, Block 2, Independence Beach are tax -forfeit parcels which have been purchased by W.J. and Jeannine Cavanaugh (Purchasers) on a contract from the State of Minnesota; and WHEREAS, said contract was paid in full on August 15, 1986 and the County Auditor's Certificate of Payment in Full of Land Sold has been sent by Hennepin County to the Minnesota Department of Revenue; and WHEREAS, it is anticipated that a deed will be issued by the Minnesota Department of Revenue to the Purchasers by August 22, 1986. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Medina, Minnesota that the lot combination/subdivision for W.J. Cavanaugh an Eugenio Dabrowski is hereby granted final approval, subject to the following conditions: 1. The Applicants shall pay to the City a sewer connection charge of $6,777.00, which represents the remaining unpaid 1.5 units; 2. The Applicants shall remove debris from the property to the satisfaction of the zoning administrator; 3. The Applicants acknowledge that the City shall issue build- ing permits only for structures which comply with the building envelopes illustrated by City staff on the property survey, a copy of which is attached hereto as Exhibit B; 4. The Applicants shall convey to the City easements for utility purposes which are satisfactory to the City Engi- neer, specifically including the easements over Lots 15 and 16 needed to provide service to Lots 12 and 13 (Parcel B); 5. The Applicants shall pay to the City the sum of $ to cover the planning, engineering, legal and administrative expenses incurred by the City in reviewing this lot combina- tion/subdivision, and the Applicants shall pay any addition- al costs incurred hereafter by the City for those purposes; and 6. The Applicants acknowledge that final approval of the lot combination/subdivision is contingent upon receipt by the City Attorney of evidence of a deed having been issued by the Minnesota Department of Revenue to the Purchasers.
