CALL TO ORDER: Mayor Tyrell called the regular meeting of the City Council to order at 7:33 p.m. on Tuesday, February 20, 1979, in the Council Chamber of the City Hall. 2. INVOCATION: The invocation was given by Dr. Marshall Ketchum, First Methodist Church, 5957 N. Golden West Avenue. 3. The Pledge of Allegiance to the Flag was led by Mayor Tyrell. 4. ROLL CALL: Present: Absent: Also Present: Councilmen- Atkins, Dennis, Gillanders, Merritt, Tyrell Councilmen -None City Manager Koski, City Attorney Martin, Assistant City Manager Pucci, Planning Director Dragicevich, Parks and Recreation Director Kobett, Lt. Jeanne Robertson, Temple Station, and Steve Johnston, Temple City Times 5. CONSENT CALENDAR: Item B was removed from the Consent Calendar for consideration as a separate item. Item F was deferred to some future date. On motion by Councilman Atkins, seconded by Councilman Gillanders, Items A, C, D, E, G and H were approved as recommended. A. APPROVAL OF MINUTES: Regular Meeting of February 6, 1979 Approved with correction to Item 10 -F, MATTERS FROM CITY OFFICIALS, reflecting that Councilman Gillanders made the statement. C. RECOMMENDATION FROM TRAFFIC COMMISSION: MODIFICATION OF GREEN CURB ZONE - WEST SIDE OF CAMELLIA, NORTH OF LAS TUNAS DRIVE Approved recommendation that the green curb zone on the west side of Camellia Avenue, north of Las Tunas Drive, be changed from a 15 minute parking zone to a 30 minute parking zone. D. COMMUNITY REDEVELOPMENT AGENCY ANNUAL REPORT - JULY 1, 1977 to JUNE 30, 1978 Accepted report and instructed the City Manager to file with the Housing and Community Development Department. E. REQUEST TO MAINTAIN AVIARY: 9428 BLACKLEY STREET Instructed Planning Department to investigate the matter and submit their findings March 6, 1979. G. RESOLUTION NO. 79 -1782: EMPLOYMENT OF PERSONNEL Adopted Resolution No. 79 -1782 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY APPOINTING PERSONNEL. H. RESOLUTION NO. 79 -1783: WARRANTS & DEMANDS Adopted Resolution No. 79 -1783 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY ALLOWING CLAIMS AND DEMANDS IN THE SUM OF $84,228.02, DEMAND NOS. 11406 THRU 11519. Council Minutes, February 20, 1979 - Page 2 CONSENT ITEM B - AGREEMENT FOR TENNIS COURTS: CITY AND TEMPLE CITY UNIFIED SCHOOL DISTRICT Councilman Gillanders called for a roll call vote. Councilman Atkins moved to approve agreement with the Temple City Unified School District and adopt Resolution No. 79 -1784 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY APPROVING THE APPLICATION FOR GRANT FUNDS UNDER THE ROBERTI - Z'BERG URBAN OPEN -SPACE AND RECREATION PROGRAM, seconded by Councilman Merritt and carried on a roll call vote: ROLL CALL: AYES: Councilmen - Atkins, Dennis, Merritt, Tyrell NOES: Councilmen - Gillanders UNFINISHED BUSINESS: None. NEW BUSINESS: 6. PROPOSED ORDINANCE RELATING TO THE BUILDING CODE City Manager Koski presented proposed ordinance amending the Building Code to make it optional for residential units to utilize locks which may be key or otherwise operated from the inside. Councilman Atkins moved to introduce Ordinance No. 79 -473 AN ORDINANCE OF THE CITY OF TEMPLE CITY AMENDING PART A, CHAPTER 1 OF ARTICLE VII OF THE TEMPLE CITY MUNICIPAL CODE by title only and waive further reading, seconded by Councilman Merritt and carried. 7. PROPOSED ORDINANCE RE: PURCHASING City Manager Koski presented proposed ordinance with modifications to the purchasing ordinance to facilitate an expedient and cost effective method of purchasing city supplies and services. Councilman Atkins moved to introduce Ordinance No. 79 -474 AN ORDINANCE OF THE CITY OF TEMPLE CITY AMENDING ART ICLE II, CHAPTER 5 OF THE TEMPLE CITY MUNICIPAL CODE by title only and waive further reading, seconded by Councilman Gillanders and carried. 8. COMMUNICATIONS: None. 9. TIME FOR THOSE IN THE AUDIENCE WHO WISH TO SPEAK: John Zubiate, 5620 Welland Avenue, presented a petition signed by 56 tenants of the Romanesque Apartments seeking Council's consideration of rent control for Temple City, and listing numerous compaints of hazardous conditions relating to the tenants health and safety. Mr. Zubiate cited broken protective railings, broken windows, portion of roof collapsed and other areas leaking; no repairs being made by new owners over the past three years, however periodic increases in rents demanded. Teri Toth, 5633 Santa Anita, stated her basic complaint is that the rent increases seem to be discriminatory against children, in that units of the same size have increases in different amounts, those with no children to a lesser degree than the tenants with children. She feels the new owners are trying to force the tenants with children out so that it can become an adults only complex. Robert Nealy, resident manager, stated the notices of rent increases were dated February 1 to be effective February 28 which is not the required 30 day notice, and also the new owners escrow did not close until February 6. Council Minutes, February 20, 1979 - Page 3 In discussion with the complainants, Council advised there are a number of things involved in the setting of rents and the owners of apartments must amortize their costs and make a profit; that the question of rent control is extremely involved and they do not have sufficient information on the problem to consider it at this time, and advised other cities who have taken action in this area have not been successful nor does the city have the staff to administer such a law; that they will refer the question of health and safety to the proper authorities. Council also referred Mrs. Toth to Legal Aid with regard to the question of whether the tenants have received proper notice of rent increase. RECESS TO CRA: City Council recessed at 8:28 p.m. to meet as the Community Redevelopment Agency, all members being present; approved the minutes of the regular meeting held February 6, 1979 and adopted resolution approving warrants and demands. Minutes of the Agency are set forth in full in the records of the Agency. RECONVENE AS CITY COUNCIL: 10. ACTION ON REQUEST BY CRA: There was no action to be taken. 11. MATTERS FROM CITY OFFICIALS: A. PERSONNEL - BUDGET ADJUSTMENT Councilman Atkins moved to authorize three positions as set forth in staff memo dated February 16, 1979 and appropriate additional funds and amend the adopted budget in the amount of $7,499, seconded by Councilman Gillanders and carried. B. CENSUS BUREAU - LOCAL REVIEW PROGRAM Councilman Merritt moved to appoint City Manager as Local Review Liaison for the purpose of reviewing detailed counts of population and housing and advising the Census Bureau of possible errors prior to release of Census information to the public, seconded by Councilman Gillanders and carried. C. VENDORS ALONG PARADE ROUTE - CAMELLIA FESTIVAL, FEBRUARY 24, 1979 City Manager Koski presented communication from the 35th Annual Camellia Festival Committee regarding vendors along the parade route and assembly area on the day of the parade, to include three organizations. Councilman Atkins moved to approve organizations as listed in the Camellia Festival Committee letter dated February 15, 1979, seconded by Mayor Tyrell and carried. In view of the fact only three organizations have completed vendor applications, Councilman Gillanders moved to authorize the City Manager to approve any organization which qualifies and files late, seconded by Councilman Atkins and carried. D. Councilman Dennis advised the March 1 meeting of the League of California Cities will feature a Juvenile Justice Panel and invited any Councilman interested in attending to make reservations. E. Mayor Tyrell stated it is his understanding the legislation has funded libraries and the Flood Control through March 9, 1979. F. In answer to Council's request to prepare a resolution opposing the formula for distributing revenue under AB 301, City Attorney Martin advised AB 301 would be a shift in the existing state sales tax from the state to local agencies. The proposal is an additional 4 to finance city, county, and special district needs and will equal approximately $1.1 billion. The distribution originally was to be based on population; changed to a 40 -40 -20 ratio for county, city and districts respectively; and changed again with the present formula 70% of the SB 154 distribution, 15% population, and 15% Inverse per capita income factor. Mr. Council Minutes, February 20, 1979 - Page 4 Martin recommended a letter to Temple City's representatives in the Assembly and Senate supporting the concept of population as a formula for distribution would be the most constructive form. City Council directed City Manager to prepare the appropriate letter to the City's representatives, to go out over the Mayor's signature. 12. ADJOURNMENT: On motion by Councilman Merritt, seconded by Councilman Atkins, meeting adjourned at 8:45 p.m. Next regular meeting of the City Council will be held Tuesday, March 6, 1979, 7:30 p.m. in the Council Chamber of the City Hall.
