RESOLUTION NO. 09-7906
A RESOLUTION OF THE CITY COMMISSION OF THE
CITY OF OPA-LOCKA, FLORIDA, APPROVING THE
SETTLEMENT AGREEMENT IN THE MATTER OF CITY
OF OPA-LOCKA VS. BELLSOUTH COMMUNICATIONS,
INC., AND AUTHORIZING THE CITY MANAGER TO
ACCEPT PAYMENT FROM SAID DEFENDANT IN THE
TOTAL AMOUNT OF SEVENTY FIVE THOUSAND
DOLLARS ($75,000.00), AS FULL AND FINAL
SETTLEMENT OF ALL CLAIMS AND DISMISSAL
WHEREAS, on or about June 25, 2009, the City of Opa-locka ("City") sued Bellsouth
Communications, Inc., in the 1 1th Judicial Circuit in and for Miami-Dade County, Florida, Case
No.: 09-48376 CA (01); and
WHEREAS, at a mediation attended by the City Manager, City Attorney and city staff,
Bellsouth Communications, Inc., presented a settlement offer in the total amount of Seventy Five
Thousand Dollars ($75,000.00) for full and final settlement of the City's claim; and
WHEREAS,the City Commission of the City of Opa-locka("City Commission") desires
to accept the settlement amount from Bellsouth Communications, Inc., as full and final
settlement of the City's claim.
NOW, THEREFORE, BE IT DULY RESOLVED BY THE CITY COMMISSION
OF THE CITY OF OPA-LOCKA, FLORIDA:
Section 1. The recitals to the preamble are hereby incorporated by reference.
Section 2. The City Commission of the City of Opa-locka hereby accepts the
settlement offer from Bellsouth Communications, Inc., related to Case No.: 09-48376 CA (01),
in the 1 1th Judicial Circuit in and for Miami-Dade County, Florida, in the total amount of

Seventy Five Thousand Dollars ($75,000.00) for full and final settlement of the City's claim and
dismissal.
Section 3. This resolution shall take effect immediately upon adoption.
PASSED AND ADOPTED this 9 day of SEPTEMBER , 2009.
