HomeMy Public PortalAbout09-7912 Evaluation and Appraisal Report Sponsored by: City Manager RESOLUTION NO. 0 9-791 2 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF OPA LOCKA, FLORIDA, ADOPTING THE CITY OF OPA-LOCKA REVISED EVALUATION AND APPRAISAL REPORT(EAR)OF THE CITY'S COMPREHENSIVE PLAN; PROVIDING FOR TRANSMITTAL OF THE EVALUATION AND APPRAISAL REPORT TO THE SOUTH FLORIDA REGIONAL PLANNING COUNCIL IN ACCORDANCE WITH 163.3191, FLORIDA STATUTES WHEREAS, Section 163.3191, Florida Statutes, requires that municipalities adopt an Evaluation and Appraisal Report("EAR") once every seven years; and WHEREAS,the EAR evaluates how successful a community has been in addressing major community land use planning issues through implementation of its comprehensive plan; and WHEREAS,in 2007,the City of Opa-locka("City")hired Florida International University ("FIU")to prepare its Evaluation and Appraisal Report; and WHEREAS,the Local Planning Agency has reviewed the Evaluation and Appraisal Report, held an advertised public hearing, provided for participation in the process, and rendered its recommendations to the City Commission of the City of Opa-locka("City Commission"); and WHEREAS, on December 10, 2008, the City held an advertised public hearing to receive public comments on the proposed Evaluation and Appraisal Report, thereby providing for public participation in the comprehensive plan process; and WHEREAS,on December 10,2008,the City Commission,adopted Resolution No.08-7402, authorizing the City Manager to transmit the Evaluation and Appraisal Report to the South Florida Regional Planning Council for preliminary review and comments; and WHEREAS, on September 9, 2009, after receiving comments and recommended changes Resolution No. 0 9—7 91 2 from the South Florida Regional Planning Council, the City held an advertised public hearing to receive public comments on the revised 2007 Evaluation and Appraisal Report,thereby providing for public participation in the comprehensive plan process; and WHEREAS, the City Commission desires to adopt the revised 2007 Evaluation and Appraisal Report. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF OPA-LOCKA, FLORIDA: Section 1. The recitals to the preamble herein are incorporated by reference. Section 2. The City Commission of the City of Opa-locka hereby adopts the revised 2007 Evaluation and Appraisal Report to the City's Comprehensive Plan,attached hereto as Exhibit"A". Section 3. The City Commission of the City of Opa-locka hereby approves the transmittal of the revised 2007 Evaluation and Appraisal Report to the South Florida Regional Planning Council in accordance with Section 163.3191, Florida Statutes. Description:, Comprehensive planning is a process that determines community goals and aspirations in terms of community development. The outcome of comprehensive planning is the Comprehensive Plan which dictates public policy in terms of transportation, utilities, land use, recreation, and housing. Comprehensive plans require a first step process which includes the preparation of an Evaluation and Appraisal Report(EAR). In 2007, the City of Opa-locka ("City")hired Florida International University ("FIU") to prepare its Evaluation and Appraisal Report, and the Local Planning Agency has reviewed the Evaluation and Appraisal Report.The City Commission, after considering the review agency comments and the recommended changes as of April 6, 2009, hereby approves and adopts the revised 2007 EAR and authorizes transmittal of the EAR to the South Florida Regional Planning Council for sufficiency review in accordance with Section 163.3191 and Rule 9J-11.009. Financial Impact: The adoption and transmittal of the EAR and a finding of sufficiency by the review agency will promote new development; facilitate the creation of a Community Redevelopment Area, and cause a substantial increase in Ad Valorem tax throughout the City of Opa-locka. Implementation Time Line: Immediately, upon approval of this resolution. Legislative History: Resolution 08-7402; Resolution 07-9193; Recommendation(s): Staff is recommending the adoption and transmittal of the 2007 Evaluation and Appraisal Report with the revisions needed according to the recommendations and comments of the review agency, the local governments, and the agencies listed under Florida's Administrative Code, Rule 9J-11.009.
