The Pledge of Allegiance to 4. ROLL CALL: Dr. Pard Keyser, Westminster Live Oak Avenue. the Flag was led by Mayor Tyrell. Present: Councilmen - Atkins, Dennis, Gillanders, Merritt, Tyrell Absent: Councilmen -None Also Present: City Manager Koski, City Attorney Martin, Assistant City Manager Pucci, Planning Director Dragicevich, Parks and Recreation Director Kobett, Lt. Jeanne Robertson, Temple Station, and Steve Johnston, Temple City Times 5. CONSENT CALENDAR: 1 1 Item E was removed from the Consent Calendar for consideration as a separate item. On motion by Councilman Merritt, seconded by Councilman Gillanders, Items A through D, and F through H were approved as recommended. A. APPROVAL OF MINUTES: Regular Meeting of February 20, 1979 Approved as written. B. ORDINANCE NO. 79 -473: 2nd read. RELATING TO THE BUILDING CODE Waived further reading and adopted. C. CONSENT ITEM E - RECOMMENDATION FROM PARKS & RECREATION COMMISSION - Meeting of February 21 - SURVEY RE: USE OF TENNIS COURTS (LIVE OAK PARK) Mayor Tyrell, called for a roll call vote. Councilman Gillanders moved to approve recommendation of the Parks and Recreation Commission that tennis courts at Live Oak Park be programmed as set forth in memo dated February 26, 1979 and on file in the City Clerk's office, seconded by Councilman Merritt and carried on a roll call vote: ROLL CALL: AYES: Councilmen- Atkins, Dennis, Gillanders, Merritt NOES: Councilmen - Tyrell UNFINISHED BUSINESS: 6. REQUEST TO INCREASE NUMBER OF BIRDS IN AVIARY: 9428 BLACKLEY STREET City Manager Koski presented background information, stating the City received a request from Mr. James MacLaren, 9428 Blackley Street, for a permit to maintain an aviary on his property. A field inspection conducted on January 4 and again on February 27 revealed the owner has four structures used as bird aviaries, two of which are vacant. The main aviaries house approximately 150 birds. Sanitary conditions were found to be satisfactory; however, the required construction specifications are not met. City Council, at their regular meeting held February 20, 1979 set this matter for consideration March 6, 1979 and property owners in the immediate vicinity have been notified. Mr. James MacLaren, 9428 Blackley Street, stated he has maintained the aviaries in excess of 20 years; he feels they have been used for the good of the community in that children have visited his home to view the birds as a science project; the birds make no noise, nor do they fly; and, in addition, the birds have been used for boy scouts to achieve their merit badges. Mr. MacLaren was given a copy of staff recommendations and asked whether he has any objection to any of the recommendations. He stated he is willing to do anything Council may wish. In answer to question from Councilman Dennis, Mr. MacLaren stated he had received letter from the Los Angeles County Health Department, copy of which Council re- ceived from a complaining neighbor; however the letter was in reference to an inspection they made regarding trees and shrubs in the rear yard which were a nesting place for rats, that he had used a rat control and the problem no longer esists, though it had nothing to do with the birds. A number of MacLaren's neighbors were in the audience and his immediate neighbors to the east and west stated they would not wish to have a view- obscuring fence along their property lines, Councilman Gillanders moved to approve request to maintain an aviary at 9428 Blackley Street subject to recomuiendations of the staff 1, 2, 4 and 7 in memo dated March 1, 1979 and on file in the City Clerk's office, and that applicant improve loft #1 and demolish loft #3, and that all structural work be completed within 60 days, seconded by Mayor Tyree and carried. Council Minutes, March 6, 1979 - Page 3 NEW BUSINESS: None, 7. COMMUNICATIONS: 1 A. Automobile Club of Southern California - Request for Resolution relating to Territorial Insurance Rates Gary Acker, 5941 Edmond Circle, Huntington Beach, representing the Automobile Club of Southern California, requested Council's con- sideration of a resolution supporting territorial rating, stating the State Insurance Commission is holding hearings on this subject and if a statewide rate is adopted it would increase insurance rates for Temple City residents by 13 %. Councilman Gillanders moved to adopt Resolution No. 79 -1787 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY SUPPORTING TERRITORIAL RATING, seconded by Councilman Atkins and carried. 8, TIME FOR THOSE IN THE AUDIENCE WHO WISH TO SPEAK: Flora Moses, 10665 Hallwood Drive, requested clarification of use of the pudic parking lots, stating she works in Temple City and parks her car in the parking lot on Temple City Boulevard and has been asked to remove it. City Manager Koski advised the south section of the parking lot is unrestricted and available for all -day parking on a first come first served basis. The north section of the parking lot is restricted to two -hour limit. He further explained that some people who arrive at 9 a,m, or later are parking in the restricted area which limits the availability of parking spaces for shoppers. This problem should be alleviated if Council approves an interim parking control officer which is on the agenda and yet to be discussed, CESS TO CRA: City Council recessed at 8:13 p.m. to meet as the Community Redevelopment Agency, all members being present; approved the minutes of the regular meeting held February 20, 1979 and adopted resolution approving warrants and demands. Minutes of the Agency are set forth in full in the records of the Agency. RECONVENE AS CITY COUNCIL: 9. ACTION ON REQUEST BY CRA: There was no action to be taken. 10. MATTERS FROM CITY OFFICIALS: A. The City Council received and filed a report from Captain Hansen of Sheriff's Temple Station regarding the transporting of hazardous materials through the community. B. Parking Control Officer Interim Program City Manager Koski advised that pursuant to Council direction, staff has requested parking control assistance from the Sheriff's Department, and has negotiated the use of an off -duty deputy for approximately 3 hours per day until the end of March at an estimated cost of $600. During the interim period, determination can be made of the effective- ness of part -time enforcement and an accurate estimate of the amount of revenue available to support the program, Councilman Gillanders moved to approve an off -duty deputy for approxi- mately 4 hours per day for an interim period to the end of March at an Council Minutes, March 6, 1979 - Page 4 estimated cost of $800 and to appropriate additional funds and amend the adopted budget accordingly, seconded by Mayor Tyrell and carried. C. Councilman Dennis advised that at the League of California Cities meeting held March 1, 1979, staff asked members to support the 70/15/15 formula for distribution of the 1% sales tax to local govern- ments. He has written a letter to the President of the Los Angeles County Division of the League opposing their rationale in supporting this formula, a copy of which will be in circulate for Council review. Council expressed concern that an organization alleging representa- tion of cities should be unresponsive to the needs of the cities. Councilman Atkins will bring this matter to the attention of the Executive Board of the San Gabriel Valley Association of Cities. D. Mayor Tyrell advised there is a new bill introduced this week in the legislature relating to rape reform and he will write to our local representatives requesting their'support. 11. ADJOURNMENT: On motion by Councilman Merritt, seconded by Councilman Dennis, meeting adjourned at 8:23 p.m. Next regular meeting of the City Council will be held Tuesday, March 20, 1979, in the Council Chamber of the City Hall.
