RESOLUTION GRANTING A CONDITIONAL
USE PERMIT TO PRO -TECH AUTO REPAIR
WHEREAS, Pro -Tech Auto Repair (Applicant) has applied for
permission to expand an auto repair business at 3575 Hickory
Drive; and
WHEREAS, the Medina city code permits the operation of the
business at said location only upon issuance of a conditional use
permit; and
WHEREAS, representatives of the Applicant appeared before
the Planning Commission on August 12, 1986 and the City Council
on September 2, 1986 in regard to this matter.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Medina, Minnesota that the Applicant's proposed use of
the subject property is consistent with the ordinances of the
City and will not impede the development of adjacent property and
that a conditional use permit for the use is hereby granted,
subject to the following conditions:
1. Parking shall be provided for four service bays (20 cars),
which shall be paved and marked. The area currently black -
topped shall be upgraded within one year of the date of this
conditional use permit. The additional paving shall be
completed within two years thereof;
2. The Applicant shall provide screening along the southerly
property line which shall be to the satisfaction of the
zoning administrator;
3. The Applicant shall install landscaping which is in compli-
ance with the approved plan and with additional screening;
4. Any additions to the building shall be constructed only in
compliance with the performance standards established in the
City's zoning ordinance;
5. The hours of operation of the business shall not exceed 7:00
a.m. to 7:00 p.m. daily;
6. There shall be no outside storage on the site;
7. The number of cars parked outside the building shall not
exceed 20 at any one time. All cars shall be parked on the
paved area and there shall be no cars on site which are
unlicensed and inoperative;
8. The Applicant shall submit drainage plans for review by the
zoning administrator or city engineer;
9. The existing building shall be brought into compliance with
the City's performance standards in accordance with the
timetable established in the zoning ordinance; and
10. Outside lighting shall be shielded to prevent glare on
adjacent properties.
BE IT FURTHER RESOLVED by the City Council of the City of
Medina that a variance be granted from the 30 foot side yard
setback required under Section 826.57 of the Medina Code of
Ordinances to permit parking within 10 feet of the south property
line for a distance of 156 feet and to within 0 feet of the south
property line for a distance of 114 feet because of the narrow-
ness of the lot.
