At The Brewster Town Office Building, 2198 Main Street, Brewster, MA MEETING MINUTES of October 11 , 2017 Present : Paul Ruchinskas , Peter Johnson, Elizabeth Taylor, Diane Pansire, Faythe Ellis, Roland Bassett, and William Klein . Absent : Barbara Burgo Also Present : Finance Committee liaison Chuck DeVito , Town Administrator Mike Embury, Coastal Committee members Abigail Archer and Mary O ' Neil, and former Coastal Advisory Group member Chris Powicki, Brewster Conservation Trust Advisor Mark Robinson, and Paul Snider . The Chair called the meeting to order at 4 : 45 pm Recording or Taping Notification : "As required by the Open Meeting Law we are informing you that the Town will be videotaping andlor audio taping this public meeting. In addition, if anyone else intends to either video or audio tape this meeting they are required to inform the chair°. " We request that all cell phones be turned off or to vibrate. 11 . Discussion and votes to approve draft language for CPC Town Meeting articles 4 and 9 .1 Chair Ruchinskas reviewed Articles 4 and 9 on the Town Meeting Warrant dated November 13 , 2017 . Article 4 deals with two budget transfers and was approved by the Board of Selectmen by a vote of 5 - 0 on 9/2/ 17 and Finance Committee by a vote of 7 - 0 on 10/4/ 17 . Motion made by Roland Bassett to approve language in Article 4 as presented . Peter Johnson seconded. VOTE : 7-0 -0 Article 9 deals with the purchase of the Meetinghouse Road parcel and the most that will be coming from CPC funds is $ 432 , 000 and up to $ 18 , 000 for closing related costs from Free Cash, The Board of Selectmen voted to approve 5 - 0 and the Finance Committee 6- 0 with one abstention on Article 9 . Motion made by Roland Bassett to approve the language in Article 9 . Peter Johnson seconded . VOTE : 7-0 -0 CPC Meeting Minutes of October 11, 2017 Page 1 of 5 2 . Discussion and possible vote on the $ 195 , 000 open space/recreation funding request for the acquisition of 375 Paines Creel, Road and discussion and possible vote of the draft language for Town Meeting article 8 . Peter Johnson recused himself from this discussion and left the room, as he is a Trustee of the Brewster Conservation Trust . Chair Ruchinskas reviewed the article on the acquisition of 375 Paines Creek. This article is a draft and may be changed by the Open Space Committee . The percentage of open space and the recreation uses are not known at this time once the parking lot is approved . The Recreation Commission has voted to approve the purchase of this property as long as it is used for beach parking . Town Administrator Mike Embury reviewed the Executive Summary in the Article and this parcel was pursued due to the priority in the town survey regarding beach usage . There will be a public hearing on this purchase before Town Meeting on November 9 , 2017 at the Universalist Church on Main Street . A conservation restriction and an easement are being developed to give access to the Brewster Conservation Trust ' s adjacent parcel . Engineering will be developed once its purchase is approved at Town Meeting and there are some environmental issues . This parcel is the only one being considered for Paines beach parking . The Compact, a non-profit conservation organization, is working with the Brewster Conservation Trust and currently purchased the property to take it off the market in order for the town to have time to purchase it . Coastal Committee members Abigail Archer and Mary O 'Neil described the planning process to develop a coastal adaptation strategy . Horsley-Witten helped with a management plan in developing a strategy regarding coastal issues with a consensus statement and guiding principals . The next step is to develop a coastal plan. Through a grant from Coastal Zone Management the Coastal Committee worked on a vision statement and this is outlined in the Executive Summary of the Article and was read at the meeting . The six main goals identified by the Coastal Committee are : ( 1 ) to maintain and expand beach access for everyone year-round; (2) to protect and maintain the natural beauty of the areas ; (3 ) to seek long-term solutions based on the best available science and that realistically accomplishable ; (4) to Tool, at the whole ecological system; (5 ) to recognize the changing needs of coastal management and to remain flexible and adaptive ; and (6) all decisions to be consensus based. It is important to plan over different time models . What will the coast look like in 20 years with predicted sea level rise of 1 foot, 40 years with predicted sea level rise at 2 feet and 60 years with predicted sea level rise of 4 feet. Also briefly reviewed were potential storm surge scenarios . The Coastal Committee will be working on the next phase that will be the planning stage . It is hoped to have this completed in a year or two . There was discussion about the parking available at Paines Creek Beach and why this lot is being considered for purchase by the town for parking . It is expected a conservation restriction on the lot and easement granted to the Brewster Conservation Trust for access to an adjacent parcel and the development will be limited to an unpaved parking lot . The town would like to own this property so that it can maintain and control it, particularly for liability considerations . CPC Meeting Minutes of October 11, 2017 Page 2 of 5 Concerns about approving this project now were outlined ( 1 ) this app came in after the closing of CPC applications with scant details, (2) there is no urgency as this parcel is not available for development, (3 ) concerns about allowing parking on this parcel from an environmental standpoint . It was felt that this project should go forward at a slower pace and that there should be more public input into the project . It was felt that this should go before the Coastal Committee for their review and input as to the best use of this property . This parcel has not come before the Coastal Committee . The Coastal Committee is an advisory committee to the Board of Selectmen and does not have regulatory powers . There was a brief review of the process and public engagement starting with the November 9 , 2017 public hearing . It was the town ' s hope to have this parcel available for the next beach season, but it is not certain that this timeline can be accomplished. It is felt that money for design could not be approved unless the town owned the parcel and public input to be considered during the design phase . Currently there are only 8 to 10 parking spaces available at Paines Creek and there are problems with people parking in places they should not to get to the beach . This is a concept and the parcel could allow for a potential parking and/or a shuttle and parcels of property like this do not come up very often. There is no purchase and sale agreement as of yet . Town Meeting will vote and make the determination as to whether to purchase this parcel with the restrictions outlined . If the Community Preservation Committee votes not to support this article, it will be up to the Board of Selectmen as to whether to fund the purchase from the Town ' s Free Cash . Whether the CPC supports this article needs to be made today . The Compact through the Brewster Conservation Trust offered this parcel to the town for much less than they purchased it for and there was concern expressed about how long this offer would be honored . The Compact is not a property holding organization and purchased this for access to an adjacent parcel that has access to a marsh . They have not considered developing this for parking at this time and if they did consider developing it, would most likely accommodate a very small parking area. The timeline is very short and concern was expressed about the Paines Creek neighborhood being able to weigh in and would like to see this article moved to the Spring Town Meeting , The Recreation Commission ' s vote was predicated on this parcel being a parking lot for beach access . There was a CPC majority consensus to put this article on this fall ' s Town Meeting Warrant . (4 in favor for the Fall Town Meeting and 2 in favor for Spring Town Meeting) . The CPC is to fund this parcel purchase from their Open Space and Recreation funds . Percentages were determined to be 50 % from Open Space and 50 % from Recreation . Following discussion the CPC conditions their approval on an Executed P & S Agreement, an executed Conservation Restriction, an Easement, with all regulatory approvals in place for beach parking before execution of the purchase . There will be multiple public meetings on this parcel . Motion made by Roland Bassett to recommend approval of the 375 Paines Creek application CPC Meeting Minutes of October 11, 2017 Page 3 of 5 for $ 195 , 000 to Town Meeting conditional upon an executed Purchase and Sale Agreement between the Town and the contractor of the Brewster Conservation Trust, a conservation restriction , an easement between the Town and Brewster Conservation Trust, and that all regulatory approvals are in place for beach parking to service Paines Creek Beach, with half of the funds from the CPC 30 -percent Reserve fund and half from the CPC Open Space fund. Bill Klein seconded. VOTE : 541 0 It was noted that the Brewster Conservation Trust would hold the conservation restriction. There was discussion about including the parking designation in the warrant article language . Motion made by Roland Bassett to authorize the Chair and Elizabeth Taylor to work with the Town Administrator to add language to Article 8 to clarify the position of the Community Preservation Committee with regard to beach parking. Bill Klein seconded . VOTE : 6-OA Peter Johnson returned to the meeting . 3 . Discussion of outreach and agenda for CPC annual public hearing on November 8 , 2017 on community preservation needs and possibilities for funding in the areas of community housing, historic preservation, open space, and recreation. Chair Ruchinskas reviewed the outreach to the community for projects to be made available at the Spring Annual Town Meeting . There will be a review of the monies that are currently available . Donna will send last year ' s e-mail list to the CPC membership and the Committee will review and revise the list . It was suggested to have the legal ad scroll and to post it on the front page of the website . Anything posted to the fiont page of the website will automatically be posted on the Town' s Facebook page . Though last year ' s public hearing was not well attended, the previous year had a number of participants . Though not known why, it was speculated that people had more projects they wanted funded the previous year . The Committee will be asked to send out the public hearing notice to their contacts . 4 . Acceptance of Cape Rep ' s final report on the Crosby Barn project . The final report of the Cape Rep ' s Crosby Barn project was distributed to the Committee . 5 . Votes to approve minutes of the July 26 , 2017 and September 13 , 2017 meetings . Motion made by Roland Bassett to approve the meeting minutes of July 26 , 2017 as amended. Peter Johnson seconded. VOTE : 7- 0-0 Motion made by Roland Bassett to approve the meeting minutes of September 13 , 2017 as amended .
