CALL, TO, ORDER:: Mayor ProTem Dennis.called the regular meeting of the City Council to order at 7:30 p.m. on Tuesday, March 20, 1979, in the Council Chamber`: of the City Hall. INVOCATION.:. The invocation was given by Reverend David Willett, Temple City Grace. Brethren Church., 5537 N, Temple City Boulevard. 3. The Pledge of Allegiance to the Flag was led by Mayor ProTem Dennis. 4. ROLL CALL: Present: Councilmen- Atkins, Dennis, Gillanders, Merritt Absent: Councilmen - Tyrell Also Present: City Manager Koski, City Attorney Martin, Assistant City Manager Pucci, Planning Director Dragicevich, Parks and Recreation Director Kobett, and Steve Johnston, Temple City Times Councilman Atkins moved to excuse Mayor Tyrell for cause, seconded by Councilman Gillanders and carried. -- Mayor ProTem Dennis introduced Manuel de la Rosa, field representa- tive for Assemblywoman Sally Tanner, who was in the audience. 5 CONSENT CALENDAR: Items D(1) and D(2) were removed from the Consent Calendar for consideration as separate items. On motion by Councilman Gillanders, seconded by Councilman Atkins, Items A through C, and Items E and F were approved as. recommended. A. APPROVAL OF. MINUTES: Regular Meeting of March 6, 1979 Approved as written. B. FINAL MAP APPROVAL - TRACT 35012: 9807 -9823 E. OLIVE STREET 18 -UNIT SUBDIVISION Approved Final Tract Map No. 35012, recommendations 1 through 4 set forth: in staff memo dated March 14, 1978 and instructed the City Clerk to endorse certification on the face of map for Tract No-. 35012. C. REQUEST FOR AUTHORIZATION:TO RECRUIT FOR SUMMER RECREATION PROGRAM Approved recruitment for necessary personnel to conduct the summer recreation program based on the Department's need to recruit compe- tent:part -time staff.. E. COUNTY REGISTRAR REQUEST TO USE LIVE OAK PARK TO CONDUCT ARCADIA SCHOOL DISTRICT ELECTION — APRIL 17 Approved use of facilities from 6:30 a.m. to 8:30 p.m. F. RESOLUTION NO.. 79- 1788: WARRANTS & DEMANDS Adopted Resolution No. 79 -1788 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY ALLOWING CLAIMS AND DEMANDS IN THE SUM OF $56,204.30, DEMAND NOS. 11619 THRU 11714, Council Minutes, March 20, 1979 - Page 2 CONSENT ITEM D. RECOMMENDATIONS FROM TRAFFIC COMMISSI0N - Meeting of March 7, 1979 (1) TEMPLE CITY BOULEVARD, NORTH OF LEMON AVENUE - CURB AND STRIPING MODIFICATIONS Councilman Atkins stated he was concerned that southbound traffic in the #2 lane could be following the curb line and not the broken line and someone making an abrupt stop at the passenger loading zone could be rear ended... He felt the Traffic Engineer could pro- vide a line before the passenger loading zone to deflect traffic out and follow the center line striping. Councilman Gillanders suggested a series of diagonal white lines extending out from the curb would delineate more clearly the passenger loading zone. Councilman Atkins moved to refer the matter back to the Traffic COmmission to consider alternatives which may more clearly delineate the passenger loading zone, seconded by Councilman Merritt and carried. (2) SUPPORT. RETENTION OF 55 MPH SPEED LIMIT Councilman Atkins stated he feels 65 mph is a prudent speed traveling the highways in the western states. State law establishes speed limits on city streets and the same laws can be applied to the freeways. Councilman Gillanders stated he opposes the 55 mph speed limit and feels it is not Council's business to support or reject speed limits on highways which are not in the City's jurisdiction. Councilman Merritt stated he disagrees with Councilman Gillanders and feels it is Council's prerogative to voice its opinion either for or against any measure which affects the citizens of. Temple City whether actually in the City or not. He feels 65 mph on the freeways is not unreasonable. Mayor ProTem stated he supports the retention of the 55 mph speed limit; also that Council should be concerned with anything that affects_ Temple City residents., Councilman Atkins moved to receive and file Traffic Commission recommendation, seconded by Councilman Gillanders and carried. UNFINISHED BUSINESS: None, NEW BUSINESS: - None . . 6. COMMUNICATIONS. A. Chamber of .Commerce re: Proposed Burglar Alarm Ordinance City Manager Koski presented communication from the Chamber of Commerce which included a report from the burglar alarm study group, in which they request if Council holds a study session on this matter, they be notified. Councilman Atkins moved to refer the matter to a future study session., and expressed the Council's appreciation for the Chamber's quick response to Council's request to study the issue, seconded 'by Mayor ProTem Dennis and carried. B. Claim -for Damages - John Mavis, 1534 N. Gordon St., Los Angeles City Manager Koski presented a claim for damages from John Mavis for accident alleged to have occurred January 17, 1979 at a 1 I 9.__MATTERS_FROM CITY OFFICIALS::_ A.. Report on Planning Commission Activities - Meeting of March 13, . 1979 - Council Minutes, March 20, 1979 - Page 3 construction zone at the southeast corner of Rosemead Boulevard and Las Tunas Drive. Councilman G.illanders moved to deny and refer to JPIA, seconded by Councilman Merritt and carried. 7. TIME FOR THOSE IN THE AUDIENCE WHO WISH TO SPEAK: Lucinda Grant, 5434 El Monte Avenue -, advised the operator of the grocery store at Olive and El Monte Avenue is experiencing problems and she has brought him to the Council meeting to enlist the help of Council to resolve them. Richard Fond, 10.657 E. Olive Street, stated he has owned the grocery located at the northwest corner of Olive and El Monte for the past nine mo.nths;. he likes the neighborhood very much, but has had problems with.teenagers - harrassing him, shoplifting, and, he feels, vandalizing his rental property. Mr. Fond stated he has considered returning. to China, however he would prefer to stay here, although he is - not =sure. he can cope with the continuing problems. Council advised Mr.. Fond the Sheriff's Department would be contacted and requested to initiate an investigation and course of action to correct the problem. John. Holcomb, 1032 Woodacre Lane, Arcadia,'. owner of the Romanesque Apartments in Temple City, stated the conditions about which tenants complained recently existed long before he took over the building; that everything listed as needing correction by the Building Depart - ment and Health Department will be taken care of. His purpose in attending the Council meeting is his objection to the statement in the Pasadena:.. Star- News, attributed to the City Manager, that he is handling his rentals unfairly. The article in the paper has damaged his reputation, he feels, and he demanded an apology from the City Manager and .a retraction in the newspaper, and also a letter of apology suitable for framing. Councilman. Dennis advised Mr, Holcomb his name was not known at the time. tenants .presented their complaints to City Council; that many hours have been spent over the years in trying to resolve the physical and social problems associated with that development. Councilman Dennis further. advised Mr. Holcomb that whether the statement in the press was a direct quotation is something not yet determined and if the City Manager personally wishes to do some - thing about it, it is his prerogative. RECESS, TO.: CRA: City Council recessed at 7:.48 p..m. to meet as the Community Redevelopment Agency, Mr. Tyrell being .absent; approved the minutes of the regular meeting held March 6, 1979; approved request for building permit at 8827 -8843 E. Las Tunas Drive; and adopted resolution approving warrants and demands. Minutes are set forth in full in the records of the Agency. RECONVENE AS CITY COUNCIL: 8. ACTION ON REQUEST BY CRA: There was no action to be taken. City Manager Koski advised the subject report is intended as a quick synopsis: of action taken by the Planning Commission in order that Council be aware of zone variances, conditional use permits or zone changes so that, should there be a desire on the part of the Council to appeal, they would have the information within the 10 -day appeal period. Distribution of Agenda and Minutes City Manager Koski advised that pursuant to Council consideration of this matter at their recent study. session, staff has determined the costs for mailing City Council and Commission agenda and minutes is $1,535 annually. He expressed concern regarding the availability and cost of paper as well as staff time': in producing many copies. Councilman Merritt moved to adopt a policy that the agenda and minutes will be provided. without cost and mailed to the Chamber of Commerce, franchisees, newspapers, and all schools desiring a copy. All agenda and minutes will be available at City Hall upon request, seconded by Councilman Gillanders and carried, C. Recommendation from Parks & Recreation Commission - Proposed Park Improvements City Manager Koski presented recomiiiendation from Parks and Recreation Commission, stating the City is still eligible to receive funds from the Urban. Open- Space and Recreation Program and have proposed improvements; .filing ...deadline is May 1, 1979 for state funds not encumbered. .. Funds available after the approved tennis court lighting project at the high school are $12,730 which would require approxi- mately $4,250 matching funds. The Commission recommends redevelopment of the play apparatus at Temple City Park, construction of a shade shelter adjacent to the concession stand at Live Oak Park; retaining services of a licensed architect to prepare necessary plans and specifications for the shade shelter. Councilman Atkins moved to approve Parks and Recreation Commission recommendations 1 through 6 set forth in staff memo dated March 20, and on file in .the ,City Clerk's office, seconded by Councilman Gillanders and carried D. Councilman Atkins advised the San Gabriel Valley Association of Cities meeting, which will be held Thursday, March 22, will be devoting time to the discussion of financing low income housing and directed the audience .. attention to the fact the Temple City COmmllunications Commission will be conducting a lighting district forum. March 22 at the City Hall. E. Councilman .Gillanders .directed Council's attention to the article in .the .Temple City Times regarding parking of overweight vehicles on residential property and stated his position has not changed. 10 ADJOURNMENT.:. On motion by Councilman Gillanders, seconded by Mayor,ProTem Dennis, meeting adjourned at 8:50 p.m. Next regular meeting of the City Council will be held Tuesday, April 3, 1979, 7:30 p.m. in the Council Chamber of the City Hall.
