A Special Meeting of the Bal Harbour Village Council was held at 9 A. M.
Tuesday, May 8, 1979 in the Council Chambers of the Bay Harbor Islands Town Hall,
9665 Bay Harbor Terrace, Bay Harbor Islands, Florida. The meeting was held in
conjunction with the Council of the Town of Bay Harbor Islands, and the Commission
of the City of North Bay Village.

Also present were Fred Maley, Villager, and Alan Gold, Village Attorney
The following members of the Council of the Town of Bay Harbor

The purpose of the meeting was to discuss the disputed water rates and service
provided the respective cities by the City of Miami Beach, and to consider a recent
offer of settlement received from the City of Miami Beach.
Alan Gold and Joe Weil, North Bay Village Attorney, reviewed the offer as
received from Miami Beach City Attorney Robert Shevin. Mr. Warren Silverman, CPA,
commented on the figures presented in the Miami Beach offer, and reported on his
own computations as to water rates for the disputed period, October 1, 1972 to
present. In addition to water rate relief, it was noted that Bal Harbour Village
and Bay Harbor Islands have immediate need for additional water service.
After discussion, it was the unanimous conclusion of the Village Council,
as well as the other Councils present, to:
(a) Reject Miami Beach's offer
(b) Submit Mr. Silverman's minimum figures as our counter-offer, with an
offer of a lump -sum settlement in consideration of Item (c).
(c) With respect to Bal Harbour Village and Bay Harbor Islands, we will
request the cooperation of Miami Beach in negotiating a direct water
service contract with the Water and Sewer Authority, which Authority has
indicated a willingness to service us via a joint service agreement with
Miami Beach.
(d) A statement that failure of such negotiations will result in a petition
for relief before the Water and Sewer Board, and other appropriate
judicial relief.
