1 . Chairman's announcements
The VNA in conjunction with the Board of Health will hold a Child & Adolescent immunization screening on Wednesday
March 29th from 9 : 30 — 11 : 30AM at the VNA offices in South Dennis . Appointments are required . Anyone interested
can call 50&957 -7423 for an appointment .
The VNA in conjunction with the Board of Health will hold a Blood Pressure, Glucose and Cholesterol screening on
Tuesday March 28th from 10 : 00 — 2 : OOPM at the Brewster Ladies Library .
Cape Cod Healthcare has awarded a grant to the Barnstable County Extension for tick testing to anyone who lives in
Barnstable County , Residents may go to WWW . tickrer) ort . com for more information on the program .
The Brewster Historical Society has received permission from the Board of Selectmen to hold a farmers market on
Sundays from June 25th through September 24th from 9 : 004 : OOPM . The Board of Health will discuss potential farmers'
market regulations later in this meeting .
Dr . Scherzo attended the Board of Selectmen ' s meeting on 3/ 13/2017 and learned that the Magistrate at the Division of
Administrative Law Appeals issues a ruling that Brewster and the other 3 towns were not aggrieved parties and
therefore there would be no adjudicatory hearing . The case would not move forward . The Board of Selectmen will sign
a letter to Eversource objecting to the 2017 Operation Plan ,
2 . J . C. Ellis Design . , Inc . — continued variance requests for 49 Swift Lane ( March 1 , 2017 )
Jason Ellis presented this to the Board .
He stated1hat he revised the plans and increased the leaching to be at 100% .
The variances requested are as follows :
1 . To allow the proposed SAS to be 57 feet from the wetland
2 . To allow the proposed SAS to be 5 feet from two lot lines
3 . To allow the proposed SAS to be 6 feet from the foundation
4 . To allow the proposed SAS to be 3 feet from the waterline

He stated that the Conservation Commission had approved the change , the homeowner submitted a letter to the Board
that he indeed owned the property and had permission to ask for the variances, and that the neighbor' s septic system
( to the right of the property ) that the Board questioned at the last meeting is about 50 feet from the property line .
Motion : Finding that there is no increase in flow, no change in ownership and that the new system will provide better
protection , grant the variance requests as revised on the plan dated March 2 , 2017 .

3 . Stephen A . Haas Engineering, Inc. — variance requests for 566 Lower Road ( renewal for variances granted in
2013 )
Stephen Haas presented this to the Board . He stated that the house was built in 1960 . The cesspool system was
upgraded in 1994 to the present location . The owner was planning on selling the property in 2014 at which time a septic
inspector failed the system . They asked for variances at that time which were granted and have since lapsed . They are
before the Board for approval of the following variances :
1 . To allow the SAS to be 17 feet from the foundation
2 . To allow the SAS to be 50 feet from a wetland
This property is a 2 acre lot but the majority of it is wetlands . The proposed area is basically the only place it can go .
Mr . Gallagher asked how many times work had been done on the septic system in the last 20 years . Mr. Haas stated that
it was just the one time in 1994 . He also asked if the wetland line had been re flagged . Mr. Haas stated that it was the
same as the 2014 proposed plan .
Mr . Gallagher* asked why the inspection had failed . Mr. Haas stated that it was too close to groundwater `
Dr . Chaffee asked what the distance to groundwater was . Mr. Haas stated that it was 4 . 2 feet ( adjusted )
Dr. Scherzo asked if he would consider pressure dosing for this lot. Mr. Haas stated that he would have a problem fitting
in the tank and would hbte to introduce another issue into the already complicated system .
Mr . Gallagher stated that he would prefer to wait until the Conservation Commission approves the plan before this
board votes .
Motion : Continue until the April 5 , 2017 meeting .

4 . J . M . O' Reilly & Associates, Inc. — variance request for 46 Main Street
John O' Reilly presented this to the Board . Don Poole and Dawn Sternlieb, owners, were also present . They are
requesting to leave the SAS in its current location .
A one -time waiver was issued last year only so the property could be sold . At that time the Board stated that once
someone had purchased the property, a new inspection would have to be done and new owners would have to apply
for the variance again .

Mr . O ' Reilly stated that the SAS is 172 feet from pond . It is not a great pond but does meet the guidelines . The system

s down gradient from pond . Property does have a wetland on another corner and a marsh on it .
There is no water within 6' of the bottom of the septic system , the estimated groundwater is between 7 - 8 feet . There is
no better spot on the property for the SAS , The house has been vacant since October of 2015 and has had no flow going
in to the septic system . Mr. O' Reilly believes that there is no reason for another inspection to be done .
Mr . Gallagher asked if the barn and shed shown on the plan exist . Mr . O ' Reilly stated that they did and that none of the
accessory buildings will have plumbing .
Mrs . Graczewski asked if the existing tank and chamber under driveway . Mr . Poole stated that they were both beyond
the driveway .
Mr . Gallagher stated that his concerns were relieved since the last time this was heard . He doesn ' t think a re- inspection
is necessary ,
Motion : Finding that the site is limited , there is no increase in flow, distance to groundwater is between 7-8 feet and the
groundwater flow is northerly, approve the variance requests .

5 . Discuss and possibly vote on the Design, Operation and Maintenance of Small Wastewater Treatment
Facilities
There werea few grammatical mistakes that were noted to be fixed along with a few other minor corrections .
The office will make the changes and send the regulation to Town Counsel for review .
6 . Discuss potential farmer' s market regulation
Sherrie McCullough , Assistant Health Director was present . Mrs . Ice gave some information to Board about what was in
their packets . There is no formal draft yet but they would like to start getting into it ,
Mrs , McCullough talked about what she would like to see and what' s happening with surrounding towns .
Dr . Chaffee stated that this is National Nutrition month so this is a good time for this to be promoting fruits and
vegetables . She thinks the board should let Mrs . McCullough finish with the draft regulation .
Mrs . McCullough went over some of her notes . Market would only come to the Board the first initial time , if there are
any manager changes or any other issues then they would have to come back to the Board . Other than that it would be
just like the other renewals .
It was noted that if this can ' t get done before the season starts, the Board could say that it' s their " policy" until such a
time that a regulation is adopted .
The Board spoke about a Farmers market retail permit ( residential kitchen , etc . ) or limited service permit .
Mrs . McCullough will produce a draft and get back to the board .

7 . Review changes and vote on 1/A Monitoring Regulation
Mr . Gallagher stated that he would work on the wording and send it to Mrs . Mason to incorporate into the existing
regulation .
8 . Discuss Planning Board application for 1069, 1073 and 1091 Main Street
Mrs . Ice had the larger plan to show the Board . There were no comments .
9 . Discuss Planning Board application for 0 Underpass Road
Mr . Gallagher stated that there were lots of wetlands in the area . Septic plans would need to be reviewed . It was asked
what type of contractors would be going in there . No one was able to answer that .
10 . Review and approve 3/ 1/2017 minutes
There were a few minor corrections .

11 . Topics the Chairman did not anticipate
It is time for the Animal Inspectors to be nominated .

Mrs; Ice spoke about the change in the well regulations . One change is that DEP is removing from their regulations the
requirement to notify the abutters when a potable well is installed .
Informational items were noted .
