RESOLUTION NO.
RESOLUTION RECONVEYING CERTAIN PORTIONS OF TAX -FORFEITED LANDS
TO STATE OF MINNESOTA BY GOVERNMENTAL SUBDIVISION:
WHEREAS, that portion of parcel PID#12-118-23 23 0024 described
below, to wit:
That portion of Outlot A, Medina Industrial Addition, according
to the plat thereof on file and of record in the office of
the County Recorder in and for Hennepin County, Minnesota;
which lies westerly of a line run parallel with and distant 45
feet easterly of Line 1 described below:
Line 1. Beginning at a point on the west line of Section 12,
Township 118 North, Range 23 West, distant 216.5 feet north
of the west quarter corner thereof; thence run northerly on
said west section line for 200 feet and there terminating.
City of Medina, Munic (80), Plat 60289, Parcel 9000 PID#
12-118-23 23 0024 for reference purposes,
is a parcel which was conveyed by the State of Minnesota,
Department of Revenue, as tax -forfeited land to be used by
the City of Medina, a Governmental Subdivision, exclusively for
well and water tower purposes. Said conveyance was made by
State Deed No. 161866, issued by the State on the 1st day of
October, 1982, but which, due to the fact that said deed was
never recorded and has been lost or destroyed, a new State Deed
No. 166974 was issued by the State on the 19th day of September,1986.
Whereas, the portion described above is not needed by the City
of Medina for well and water tower purposes; and
Whereas, the Right -of -Way Office of the Minnesota Department of
Transportation intends to take said portion described above
by condemnation action through eminent domain proceedings if
said Department cannot obtain a conveyance of temporary easement
for said described portion,
Now, Therefore, Be it Resolved by the City Council of the City
of Medina that said portion of Parcel PID# 12-118-23 23 0024
described above be reconveyed to the State of Minnesota and
that the Mayor and the City Clerk/Treasurer are hereby authorized
to complete the necessary reconveyance forms;
Be it Further Resolved by the City Council of the City of Medina
that the County of Hennepin restrict use of said portion of
Parcel PID# 12-118-23 23 0024 described above to public use by the
Minnesota Department of Transportation, Office of Right -of -Way,
after issuance of appropriate easement conveyance by the State
of Minnesota, Department of Revenue. Said easement conveyance
shall be subject to approval by the Hennepin County Board of
County Commissioners and by the Commissioner of the Minnesota
Department of Revenue. Said easement shall entail the right to

use that portion of Parcel PID#12-118-23 23 0024 described
above for highway purposes, which right shall cease on December 1,
1991, or on such earlier date upon which the Commissioner of
Transportation determines by formal order that it is no longer
needed for highway purposes.
