CALL TO ORDER: 1 CITY OF TEMPLE CITY CITY COUNCIL MINUTES APRIL 3, 1979 Mayor Tyrell called the regular meeting of the City Council to order at 7:30 p.m. on Tuesday, April 3, 1979, in the Council Chamber of the City Hall. 2 The Pledge of Allegiance to the Flag was led by Mayor Tyrell. ROLL CALL: Present: Councilmen- Atkins, Dennis, Gillanders, Merritt, Tyrell Absent: Councilmen -None Also Present: City Manager Koski, City Attorney Martin, Assistant City Manager Pucci, Planning Director Dragicevich, Parks and Recreation Director Kobett, Lt. Jeanne Robertson, Temple Station, and Steve Johnson, Temple City Times 4. CONSENT CALENDAR: Item A was removed from the Consent Calendar, On motion by Council- man Atkins, seconded by Councilman Gillanders, Items B through H were approved as recommended. B. RECOMMENDATIONS FROM PARKS & RECREATION COMMISSION - Meeting of March 21, 1979 (1) REQUEST FOR USE OF FACILITIES AT LIVE OAK PARK - SEQUOIA UNION SCHOOL DISTRICT Approved request from Sequoia Union School District for use of Live Oak Park on April 25 -27, 1979 on a fee -free basis subject to Certificate of Insurance naming the City of Temple City additionally insured, (2) REQUEST FOR USE OF TEMPLE CITY PARK - TEMPLE CITY Y.M.C.A. Approved request from Temple City Y,M.C.A. for use of Temple City Park April 21, 1979, from 1 p.m. to 4:30 p.m. subject to Certificate of Insurance naming the City of Temple City additionally insured, C. 1979 -80 ANIMAL LICENSE RATES: Adopted Resolution No. 79 -1790 establishing license fees for fiscal year 1979 -80. D. ACCEPTANCE OF SANITARY SEWER - TRACT NO. 33529 Accepted Sanitary Sewers for public use, release Sanitary Sewer Agreement between City and subdivider and release Performance Bond in the amount of $10,000. E. REQUEST FOR AVIARY: PERMIT NO. 79 -11, 9082 Rancho Real Set hearing April 17, 1979 on request for permit to maintain more than 12 birds, F. CLAIM FOR DAMAGES: Norma A, Burgos et al Denied claim for damages and referred to JPIA. Council Minutes, April 3, 1979 - Page 2 G RESOLUTION NO. 79 -1791: EMPLOYMENT OF PERSONNEL Adopted Resolution No 79 -1791 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY APPOINTING PERSONNEL H RESOLUTION NO 79 -1792: WARRANTS & DEMANDS Adopted Resolution No. 79 -1792 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY ALLOWING CLAIMS AND DEMANDS IN THE SUM OF $95,119.00, DEMAND NOS 11711 THRU 11797 CONSENT CALENDAR ITEM A: APPROVAL OF MINUTES - Meeting of March 20,1979 Councilman Dennis requested Item 9 -B Distribution of Agenda and Minutes, be changed to reflect Council's wishes to provide without cost copies of City Council minutes to all schools within the City desiring same,. On motion by Councilman Atkins, seconded by Councilman Gillanders, minutes were approved as corrected, Mayor Tyrell abstaining... UNFINISHED BUSINESS: None. NEW BUSINESS: None 5 COMMUNICATIONS: None. 6 TIME FOR THOSE IN THE AUDIENCE WHO WISH TO SPEAK: Mr Geor.e Matson, 9439 Longden Avenue, complained the lights recently installed at t e Longden School baseball diamond are creating a pro- blem shining on the houses on Longden Avenue and also creating a hazard by blinding motorists east bound on Longden Avenue at the signalized intersection of Oak Avenue City Manager Koski advised staff is aware of the problem, the engineer, Parks & Recreation Director, and Little League have inspected and determined the needed adjustment Mayor Tyrell advised Mr Matson the work is being done by volunteers and will be accomplished as soon as possible. Mary Morabito, 10511 Olive Street, objected to a letter she received T om the City advising her it is illegal to park her inoperative vehicle in her driveway and requesting it be removed: She feels it is wrong for the city to tell her what she can do on her own property, that it is an invasion of her constitutional rights. Mrs: Morabito stated she visited the public library and read the California Civil Code on what constitutes a nuisance and restricting her rights on her private property is a public nuisance to her. Mayor Tyrell explained to Mrs Morabito the courts are the proper place to challenge the validity of an ordinance and requested the City Attorney to give his opinion as to the constitutionality of the ordinance in question. City Attorney Martin advised that under the State Constitution, indi- vidual cities have the power to enact laws restricting the rights of individuals in favor of the rights of society; that it is the right of the city to determine what does and what does not constitute a public nuisance The City Council has determined that inoperative Council Minutes, April 3, 1979 - Page 3 vehicles can be a public nuisance which depress property values of a neighborhood and have enacted a police power necessary to protect the property rights of other people in the neighborhood,. Councilman Gillanders explained to Mrs. Morabito that, prior to his election to City Council, when the ordinance was being considered by Council he had opposed the ordinance, and that he still does. Lucinda Grant, 5434 El Monte Avenue, informed Council that she resents outsiders bringing their money into the city as an absentee landlord and coming before the Council and insulting one of the finest men in the community. She wished to go on record as resenting the fact that City Manager Koski had to take that type of abuse. RECESS TO CRA: City Council recessed at 8:09 p.m., to meet as the Community Redevelopment Agency, all members being present and approved the minutes of the regular meeting held March 20, 1979. There being no other business the meeting adjourned. RECONVENE AS CITY COUNCIL: 7 ACTION ON REQUEST BY CRA: There was no action to be taken: 8 MATTERS FROM CITY OFFICIALS: A. City Council received and filed the first quarterly financial statement of the San Gabriel Valley Animal Control Authority. B Hourly Rate Increase for Recurrent Leaders City Manager Koski presented reconunendation that an hourly step increase for recurrent leaders in the amount of 15C be considered for inclusion in the fiscal year 1979 -80 budget to enable the Recreation Department to recruit competitively for the suuuner recreation program Councilman Dennis moved to approve hourly step increase for recurrent leaders as set forth in staff memo dated March 28, 1979, seconded by Councilman Atkins and carried, C, Romanesque Apartments: Status Report re: Health & Building Code Violations City Manager Koski presented a status report on the corrections of health and building code violations that existed at the Romanesque Apartments, advising that some progress has been made but weather conditions have not permitted other repairs and suggesting the matter be continued for 30 days to allow completion of the corrections, Councilman Atkins moved to continue the matter to May 1, 1979, seconded by Councilman Gillanders and carried. D.. Request for Conference Attendance - American Planning Association April 25 -28, 1979, San Diego Councilman Merritt moved to approve the Planning Director's attendance at the American Planning Association, 1979 Calchapter Conference to be held in San Diego, April 25 -28, and authorize attendant expenses, seconded by Mayor Tyrell and carried. E. Parking Enforcement Officer Program Update City Council received a summary of the results of the parking enforce- ment program authorized March 6, 1979 and instructed staff to prepare alternatives to the program for Council consideration Council Minutes, April 3, 1979 - Page 4 F. SCAG 208 Plan - Areawide Waste Treatment Management Plan City Manager Koski presented copy of Southern California Association of Government's Areawide Waste Treatment Management Plan, SCAG is securing commitments for implementation for all agencies and Temple City has been requested to be responsible to maintain street sweeping program, current litter control program and current catch basin and storm drain programs, The City Engineer recommends Council adopt a resolution to commit the City to implement the 208 Plan, Councilman Dennis moved to receive and file the report, seconded by Councilman Atkins and carried. G.. Councilman Merritt advised the Sanitation District is holding a hearing this evening at Memoli Hall on their area rates study. H, Councilman Atkins advised the San Gabriel Valley Association of Cities is preparing a resolution opposing the Southern California Association of Governments. He advised he understands many cities are dropping their membership in SCAG. He further advised they are inviting Don Benninghoven, Executive Director of the League of California Cities to visit Atkins advised a bill was introduced in Sacramento this week requiring registration of rifles and shotguns. City Council instructed staff to prepare a letter to go out over the signature of the Mayor opposing the bill. I.. Councilman Dennis advised he had received a copy of letter written by Lyman Cozad of the League to Hugh McKinley, City Manager of Glendale, which refers to Councilman Dennis' letter in opposition to the League's position on the distribution of 11 sales tax, copy of which will be placed in circulate file. He also advised he had sent a copy of his 'letter opposing the distribution of sales tax to Councilwoman Nel Merle of Palos Verdes and has her support in the revenue and taxation com- mittee... J. Mayor Tyrell introduced Greg Anicich, Administrative Intern, who was in the audience., K. Assistant City Manager Pucci advised Council the Traffic Engineer would like a full year to study the all red interval signal phasing at various intersections in the City. Following brief discussion, Councilman Atkins moved to extend the all red interval signal phasing to include Temple City Boulevard at Lower Azusa Road and Live Oak Avenue, seconded by Councilman Gillanders and carried. 9 ADJOURNMENT: On motion by Councilman Merritt, seconded by Councilman Gillanders, Council adjourned at 8:38 p,.m. to an Executive Session. Council reconvened at 8:53 p.m. On motion by Councilman Gillanders, seconded by Councilman Atkins, meeting adjourned at 8:55 p.m: Next regular meeting of the City Council will be held Tuesday, April 17, 1979, 7:30 p,m .. in the Council Chamber of the City Hall.
