OF BAY HARBOR ISLANDS, BAL
HARBOUR VILLAGE AND NORTH
BAY VILLAGE
A special meeting of the Councils of the three municipalities of the Town of Bay Harbor
Islands, the Town of Bal Harbour Village and the City of North Bay Village was held in
the Council Chambers of the Bay Harbor Islands Town Hall on Tuesday, May 8, 1979, at
9:00 a.m. for the purpose of discussing jointly the situation in connection with the
water rate dispute with the City of Miami Beach. Upon roll calls, the following members
of the indicated Councils responded:

Also present at the meeting were Bay Harbor Islands Councilman -Elect Martin Shapiro, Bay
Harbor Town Manager Anthony Hales, Bay Harbor Town Clerk Linda Toursh, Bal Harbour
Manager Fred Maley, Bal Harbour Attorney Alan Gold, North Bay Village Manager Fred Bowen,
North 3ay Village Attorney Joseph Weil, North Bay Village Clerk Thelma Daunt, secretary
Lee Roemeleyer, and Mr. Warren E. Silverman of the firm of Rachlin & Cohen, the rate
experts for the three municipalities.
At the suggestion of Bay Harbor Islands Mayor Nelson, it was agreed that the attorneys
for Bal Harbour Village and North Bay Village, Mr. Alan Gold and Mr. Joe Weil, would
co-chair this meeting.
Mr. Alan Gold spoke first, stating that he would like to put into perspective the issues
before the Councils at this meeting. The first was the issue of a counter proposal to
the City of Miami Beach on water rates, both retroactive and prospective. He mentioned
the settlement offered by Miami Beach City Attorney Robert Shevin during a recent meeting.
The towns' experts, Rachlin & Cohen, represented by Mr. Warren E. Silverman, had been
asked to study Miami Beach's proposal to determine whether it was fair and equitable
and, if not, to advise as to the proper rates. Mr. Gold directed the attention of the
Council members to the letter from Mr. Silverman which had been distributed to each
person present at this meeting.
The second question before the Councils, Mr. Gold continues, is to determine what a
counter proposal should be, assuming the three communities are not in agreement with
the proposal of Miami Beach.
The third issue is, once the counter proposal is made, what is the position of Bal
Harbour and Bay Harbor Islands to the City of Miami Beach on the water supply question,
whether we will go forward with further discussions with the City of Miami Beach under
a contract proposal, whether we will have further discussions with the Miami -Dade
Water and Sewer Authority, and if we proceed with the City of Miami Beach, what is to
be done about an interim water rate satisfactory to both Miami Beach and the towns until
the matter is settled by the Water and Sewer Board.
Mr. Maley said that the next hearing on the matter of delinquent 1977
Real Estate taxes on the Balmoral Apartments is scheduled for 3:05 P.M., July
2, 1979.
Mr. Beatty, moved that the minutes of Council meetings be sent to the
Council members within one week after each meeting. The motion was seconded
by Mr. Krez and voted.
On motion by Mr. Krez, seconded by Miss Gray, the meeting was adjourned
at 11:55 A. M.

COUNCIL MINUTES
June 26, 1979
The Council of Ba1 Harbour Village met Tuesday, June 26, 1979 at 9:30
A. M. in the Village Hall.
Present: Messrs. Beatty, Printup and Taplin and Miss Gray
Absent: Mr. Krez
Also present were Fred W. Maley, Village Manager, Mary T. Wetterer,
Village Clerk, and Alan Gold, Village Attorney.
On motion of Mr. Beatty, seconded by Mr. Taplin and voted, the minutes
of May 14th and May 29, 1979 were approved as submitted.
Mayor Printup called the Public Hearing on Comprehensive Master Plan
for Bal Harbour. Mr. Maley stated the Public Hearing had been properly ad-
vertised. He explained that the Plan had been drafted by Mr. Joe Rice, P.
E.
and has nine mandatory elements that are all treated in the report. The
report has been submitted to the required other governmental agencies, and
we have received responses from the Division of State Planning, The Department
of Environmental Regulation and the South Florida Regional Planning Council.
A time extension of 120 days has been requested in order to reply to the
comments made by the agencies, and to hold the two Public Hearings required
for the Future Land Use Element, which must be held at separate hearings
after 5:00 P.M., weekdays. Mr. Maley suggested these be held in August or
September. Mr. Rice then explained how the Plan was developed and how some
of the requirements had been treated. Public discussion followed, generally
