Wednesday, October 25 , 2017 at 6 : 30 pm
Brewster Town Office Building
Vice Chair Kari Hoffmann convened the Planning Board meeting at 6 ; 32 pm in the Brewster Town Office Building
with members : Roberta Barrett , Scott Collum , Charlotte Degen , Madalyn Hillis- Dineen and Elizabeth Taylor.
Also present : Ryan Bennett , Town Planner and Lynn St . Cyr, Senior Department Assistant ,
The Chair read the Recording or Taping Notification : "As required by the Open Meeting Law we are informing
you that the Town will be audio and video taping this public meeting . In addition , if anyone else intends to audio or
video tape this meeting he or she is required to inform the chair. "
6 : 32 PM PLANNING DISCUSSION
Reorganization of Planning Board
Motion by Degen to Nominate Hoffmann as Chair. Second by Hillis -Dineen . Vote : 5-0 -1 ( Hoffmann
abstained )
Motion by Hillis -Dineen to Nominate Collum as Vice Chair. Second by Degen . Vote : 6 -0 -0 .
Motion by Degen to Appoint Hillis -Dineen as alternate on Water Quality Review Committee . Second by
Barrett. Vote : 6 -0 -0 ,

Application #2017-16 : Applicant : Open Space Committee . Owner: LA DOLCE VITA NOMINEE TRUST ,
Representative : John M . O ' Reilly of J . M . O ' Reilly & Associates , Inc . for property located on Route 6A , adjacent
to the Eddy School entrance and shown on Assessor' s Map 78 , Lot 121 in the V-B Zoning District , The
Applicant proposes to divide Lot A into two new lots with the new Lot A-2 being owned by LA DOLCE VITA
NOMINEE Trust and Lot A- 1 being owned by the Brewster Conservation Trust .

John O ' Reilly was present on behalf of the Applicant , Brewster Conservation Trust ( BCT) . O ' Reilly noted that
the BCT is the Applicant not the Open Space Committee as stated on the application . O ' Reilly reviewed the
plan submitted to the Board and noted that Lot A- 1 will be owned by BCT who also own Lot B .
The Board inquired about access to the property and the 15 ' easement shown on the plan .
Motion by Degen to Endorse Approval Not Reauired ADDlication #2017 -16 . Second by Taylor. Vote : 6 -
0 -0 .

Harrison Hill Road Subdivision : Applicant : Robert Doeg and Karen Hickey . Representative : John M .
O ' Reilly of J . M . O ' Reilly & Associates . The Applicant requests final release of Lot 2 from the Agreement and
Covenant of the Harrison Hill Road subdivision .

John O ' Reilly was present on behalf of the Applicants , Robert Doeg and Karen Hickey . O' Reilly reviewed the
history of the subdivision before the Planning Board . O ' Reilly stated that the Applicants are selling Lot 2 to the
Brewster Conservation Trust. O ' Reilly stated that an As- Built Plan has been submitted to the Board which
shows Forever Wild Markers and concrete road bounds set under his direction . O ' Reilly
Degen asked what " substantial compliance" meant and O ' Reilly responded that the road was the proper width ,
had appropriate grading and drains and markers were installed .
Motion by Degen to Approve Final Release of Lot 2 from the Harrison Hill Subdivision . Second by
Hillis - Dineen . Vote : 6 =0 -0 .
6 : 50 PRELIMINARY SUBDIVISION PLAN
Application #2017 =15 : Applicant/Owner: Nancy Berbrick , Representative : Donald T . Poole of Outermost
Land Survey , Inc. for property located at 394 Satucket Road and shown on Assessor' s Map 13 , Lot 99 in the
R- L Zoning District , The Applicant has submitted a preliminary plan for a three (3) lot subdivision .

Donald Poole was present on behalf of the Applicant . Nancy Berbrick and daughter Marci were also present .
Poole explained that the Berbricks would like to create two additional lots on Satucket Road . Poole reviewed
access and noted that emergency vehicles have accessed the property .
Degen asked for clarification on the lots to be included in the subdivision and Poole responded that Lot 13 is
not part of subdivision .
Bennett suggested the Board request a list of easements related to the access drive , from the Applicant .
The Board discussed the proposed right of way .
Poole reviewed the waiver requests submitted to the Board and noted that the Applicant was no longer seeking
a waiver related to underground utilities .
The Board discussed the approval of paper roads in order to create appropriate frontage to meet zoning
requirements . Bennett noted that paper roads can create ownership issues later. Collum stated that any
decision issued by the Board would need to include a condition related to ownership because there are no
existing easements .
The Board discussed the waivers requested and Taylor stated that she was comfortable with the waivers but
would like feedback from the Fire Department . Poole responded that the Applicant was not seeking a waiver of
road construction but waiver from strict compliance of road construction . Degen , Hillis- Dineen , Barrett , Collum ,
and Hoffmann all stated they would support the waiver requests .
Motion by Barrett to Take No Action on Preliminary Subdivision Plan Application #2017-15 . Second by
Degen . Votes 6 =0 =0 .
7 : 54 SPECIAL PERMIT ( SIGN )
CONTINUED Aaalication #2017 -12 :, (Continued from September 27 , 2017 ) Applicant/Owner: First Parish
Brewster Unitarian Universalist . Representative : Karena Stroh for property located at 1969 Main Street and

shown on Assessor' s Map 67 , Lot 1 in the R4 Zoning District . Pursuant to Brewster Zoning Bylaw § 179-
20 . 1 . J , the Applicant requests an exception to the allowable square footage ( 16 square feet) for signage for a
Church or Religious Use in order to increase the size of its main sign from approximately 4 . 375 square feet to
12 square feet . This would bring the total square footage of signage on this site to approximately 20 square
feet including the Wayside Pulpit sign which is approximately 8 square feet . ( REQUEST FOR WITHDRAWAL
WITHOUT PREJUDICE RECEIVED )

7 : 57 PM PLANNING DISCUSSION CONTINUED
Approval of Meeting Minutes
The Board reviewed the minutes from the September 27 , 2017 meeting . Motion by Collum to Approve
September 27 , 2017 Meeting Minutes as Amended . Second by Taylor. Vote : 5 -0 =1 ( Barrett abstained )
Hoffmann reminded the Board to review the new Open Meeting Law materials provided by the Town Clerk .
Taylor summarized a workshop she recently attended regarding holding public hearings . She noted that the
Board can require applicants to submit materials with a specific deadline . Degen , who also attended the
workshop , noted that there was a suggestion to provide sign in sheets at all meetings . Taylor stated another
suggestion was to establish a meeting time frame and that meetings should not go beyond two hours . The
workshop also reviewed applications before the Board and when it was appropriate to discuss them . It was
suggested that Board members not in engage in conversations regarding pending applications outside of the
public hearing .
There will be a joint meeting of the Planning Board and Board of Selectmen on December 4"' to interview
applicants for the vacant position on the Planning Board .
Taylor noted that she has been attending the Cape Housing Institute meetings on Thursday nights in Harwich
and there has been a lot of discussion on affordable accessory apartments and the Board should consider
focusing on this bylaw . Bennett noted she had just submitted a grant application to the Office of Energy and
Environmental affairs for technical assistance with affordable accessory apartments .
Degen summarized the recent meeting of the Board of Selectmen .
Motion by Barrett to adjourn . Second by Collum . Meeting adjourned at 8 : 25 pm .
