HomeMy Public PortalAbout07-06-21a The Agenda Meeting of the Mayor and Council of the Borough of Carteret preceding the Regular Meeting, June 28, 2007 was held on Thursday, June 21, 2007, 5:00 P.M., in the Memorial Municipal Building, 61 Cooke Avenue, Carteret, New Jersey. The Following were noted present: Mayor Daniel J. Reiman Councilmember Vincent Bellino " Randy Kmm " Ronald G. Rios Noted absent was Councilmembers Diaz, Naples, and Sitarz. Also noted present was Borough Attorney Robert J. Bergen, Esq. The 2007 Annual Notice was mailed to The Home News Tribune, The Star Ledger and posted on the Bulletin Board on December 27, 2006. The Meeting was opened with a minute of silent prayer and the Pledge of Allegiance led by Mayor Daniel J. Reiman. Minutes for Approval: Minutes of June 7 & 14,2007 will remain on hold. Commendations: June 28, 2007: 1. 2007 CHS Scholarship Awards 2. HRC Grammar School Poster Contest. JUNE 21, 2007 AGENDA MEETING NOTED PRESENT NOTED ABSENT ALSO NOTED PRESENT ANNUAL NOTICE SILENT PRAYER/PLEDGE OF ALLEGIANCE MINUTES FOR APPROVAL TO REMAIN ON HOLD COMMENDATIONS 1 JUNE 21, 2007 RECYCLING AGREEMENT ORDINANCE #07-18 "AUTHORIZING CERTAIN ADMINISTRATIVE DESIGNATIONSf\ PUBLIC HEARING ORDINANCE #07-17 LEASE & AGREEMENT WITH MCIA ZAZZARO BROTHER'S: Recycling Agreement - June 28, 2007. Mayor Reiman said he thought this was previously approved. The Municipal Clerk replied that she was told to have it ready for the next meeting of June 28,2007. Mayor Reiman said that most departments are created by code. He said he was concerned how it was laid out. Basically, the Clerks office is created by Ordinance. The Municipal Clerk said her office IS under Finance and Administration. ORDINANCE #07-18 was introduced and adopted on the First Reading and the Clerk authorized and directed to adveliise same for Public Hearing to be held September 20, '2ill7 , upon MMS&C, by Councilmembers Rios and Bellino. Upon individual roll call vote, Councilmembers Bellino, Krum and Rios voted in the affirmative for the adoption. Noted absent were Councilmembers Diaz, Naples and Sitarz. ORDINANCE #07-18 "AUTHORIZING CERTAIN ADMINISTRATIVE DESIGNATIONS" Public Hearing- The Clerk stated that Ordinance #07-17 was introduced and passed upon First Reading at a Regular Meeting of the Borough Council of the Borough of Cmieret held on June 7, 2007. It was duly published in The Home News Tribune on June 14, 2007, with notice that it will be considered for final passage after Public Hearing to be held on June 21,2007 at approximately 5:00 P.M. The Ordinance was posted on the bulletin board and copies were made available to the general public and according to law, she read the Ordinance by title. 2 JUNE 21, 2007 Upon MMS&C by Councilmembers Rios and Bellino and unanimous PUBLIC HEARING- affirmative vote of the three (3) Councilmembers present, the Mayor OPENED declared the Public Hearing to be opened. There being no comments or objections to the Ordinance the Mayor CLOSED declared the Public Hearing to be closed upon MMS&C by Councilmembers Kmm and Bellino and unanimous affilmative vote of the three (3) Councilmembers present. Upon MMS&C by Councilmembers Rios and Bellino ORDINANCE #07-17 "AN ORDINANCE OF THE BOROUGH OF CARTERET IN THE COUNTY OF MIDDLESEX, STATE OF NEW JERSEY, APPROVING & AUTHORIZING THE ENTERING INTO, EXECUTION & DELIVERY OF A LEASE & AGREEMENT WITH THE MIDDLESEX COUNTY IMPROVEMENT AUTHORITY RELATING TO THE ISSUANCE OF COUNTY-GUARANTEED CAPITAL EQUIPMENT LEASE REVENUE BONDS, SERIES 2007 OF THE MIDDLESEX COUNTY IMPROVEMENT AUTHORITY" was finally adopted. Upon individual roll call vote, Councilmembers Bellino, Kium and Rios voted in the affirmative. Councilmembers Kmm, Naples and Sitarz were noted absent. Endorsing NJDOT Grant Application for Carteret Avenue Rehabilitation - Phase II 3. Directing the Issuance of Various Raffle License. 4. Appointing Kevin Morse-Prosecutor, Term 12/31/09. 5. Approving Various ABC License Renewals for the 2007- 2008 License Term. 6. Appointing The Very Reverend Taras Chubenko - Police Chaplain. Mayor Reiman said he was holding resolution #7 because he wanted to talk about it. He then asked if there were any questions for resolutions one (1) through six (6). Councilmember Rios said he had one question concerning number four (4) - did that expire December 31, 20067 Mayor Reiman said yes that resolution had previously expired but this will allow us to enter into a multi- year contract that is allowed by law. Mayor Reiman said if there were no more questions he would like a motion on the consent Agenda. **Clerk's Note The Resolution entitled "Directing the Issuance of Various Raffle Licenses" was not included in the consent Agenda due to the timing of the application and issuance. 4 Resolutions #07-166 tln'Ough #07-170 were introduced by the Mayor and referred to the Council for action. Upon MMS&C, by Councilmembers Rios and Krum RESOLUTION #07-166 "AUTHORIZING A PROFESSIONAL SERVICES CONTRACT FOR ENGINEERING SERVICES WITH T&M ASSOCIATES- REMEDIAL/POST EXECUTION ACTIVITIES CIVIC CENTER PARK" RESOLUTION #07-167 "ENDORCING FY 2008 NJDOT DISCRETIONARY AID GRANT APPLICATION FOR CARTERE AVENUE REHABILITATION- PHASE II" RESOLUTION #07-168 "APPOINTING A BOROUGH PROSECUTOR" RESOLUTION #07-169 "AUTHORIZING LIQUOR LICENSE RENEWALS" RESOLUTION #07-170 "AUTHORIZING PROFESSIONAL SERVICES CONTRACT FOR ENGINEERING SERVICES WITH T&M ASSOCIATES- CARTERET POND RENOVATIONS, SUPPLEMENTAL CONTRACT ADMINISTRATION & INSPECTION SERVICES" were adopted. REHABILI- TATION - PHASE II RESOLUTION #07-168 APPOINTING A BOROUGH PROSECUTOR" RESOLUTION #07-169 "AUTHORIZING LIQUOR LICENSE RENE\<lALS" RESOLUTION #07-170 "T&M ASSOCIATES CARTERET POND RENOVATIONS " ADOPTED 5 JUNE 21, 2007 RESOLUTION #07-171 "APPOINTING THE RIGHT REVERAND TARAS CHUBENKO - CHAPLIN" ADOPTED PAYMENT OF BILLS Mayor Reiman said that item 7 is of some interest because he has a letter from the Police Benevolent Association-Local #47 which was sent to Father Chubenko. The PBA has decided that he will no longer be the Police Chaplin. This is obviously in retaliation because of the problems between the Church and the Police Union. The Mayor said he found it disgusting that the union would do something demeaning as this. Mayor said he also had a letter from Father Chubenko, to us and then proceeded to read the letter. He said that the position of Police Chaplin is appointed by Mayor and Council and does not expire. He was appointed first by Mayor Sica and has served for almost twenty years in this position. Mayor Reiman said it is his intent to reappoint him with a full swearing in and will present him with a full dress blue uniform. We will also send a very stern response to the union. If they want a local PBA Chaplin they are more than welcome to do so but they are not going to select the city police department Chaplin. RESOLUTION #07-171 was introduced by the Mayor and refelTed to the Council for action Upon MMS&C by Councilmembers Rios and Bellino RESOLUTION #07-171 "APPOINTING THE RIGHT REVERAND TARAS CHUBENKO CHAPLAIN" was adopted. Upon individual roll call vote, Councilmembers Bellino, Ki'um and Rios voted in the affirmative. Councilmembers Diaz, Naples and Sitarz were absent. Upon MMS&C by Councilmembers Rios and Bellino, all bills appearing on the prepared list, properly audited and signed, were ordered to be paid. Upon individual roll call vote, Councilmembers Bellino, Kmm and Rios voted in the affirmative. Councilmembers Diaz, Naples and Sitarz were noted absent. 6 JUNE 21,'2007 BUSINESS'rO BE ADDED: Councilmember Kmm noted Ron McPhee's presence. He wanted Mr. McPhee to know that they were having the Softball Clinic for the children the following week at Cmieret Park. He asked that Mr. McPhee take some pictures. Mr. McPhee asked what time Councilman Ki'um would be there. Councilmember Kmm replied 9:00 A.M. to 2:00 P.M. Monday tln'ough Friday. Mayor said he would like to acknowledge Councilman Krum's taking a week's vacation to devote to the children. Councilmember Bellino said that he had no business to add but noted that he could not be at the next meeting because he was summoned by the FAA to go to Buffalo or Boston. The Borough Attorney said he had nothing to add. At approximately 5:17 P.M., after no fmiher discussion, this meeting was adjourned upon MMS&C, by Councilmembers Rios and Krum and unanimous affirmative vote of the three (3) Councilmembers present.
