HomeMy Public PortalAbout07-12-06a De:arter 6, 2ffJ7 The Agenda Meeting of the Mayor and Council of the Borough of Carteret preceding the Regular Meeting of December 20, 2007, was held on December 6, 2007, 5:00 P.M., in the Memorial Municipal Building, 61 Cooke Avenue, Carteret, New Jersey. The following were noted present: Councilmember Vincent Bellino " Jorge Diaz " Susan Naples " Ronald Rios " Joseph Sitarz Noted absent was Councilmember Randy Krum. Also noted present was Borough Attorney Robert J. Bergen, Esq. The 2007 Annual Notice was mailed to The Home News Tribune, The Star Ledger and posted on the Bulletin Board on December 27, 2006. The meeting was opened with a minute of Silent Prayer and The Pledge of Allegiance led by Mayor Daniel J. Reiman. Minutes for approval: October 16 & November 29,2007. Upon MMS&C, by Councilmembers Rios and Sitarz and unanimous affirmative vote of the five (5) members present, the minutes of October 16 and November 29, 2007 were approved as transcribed and engrossed by the Clerk. 1 !(;EN]}\. RESOLUTIONS: 1. Authorizing Request for Qualifications for Professional Services - 2008. The Mayor commented that this is pursuant to State Statutes - every year we issue a request for Qualifications, at which point they will be due at the end of the year. The Borough Attorney and Law Depaliment will review with various professionals early next year at the 2008 Reorganization Meeting when we appoint the eligible professionals for various contracts. 2. Professional Services - James Clarkin, RE: Tampa v Planning Board and Borough of Carteret. 3. Professional Services - T &M Associates, RE: Traffic Engineering Services, Washington Avenue, Roosevelt Avenue and Holmes St. 4. Creating Handicapped Parking Space -44 Chrome Avenue 5. Authorizing Carteret Planning Board to Conduct a Preliminary Investigation & Make a Recommendation as to Whether the Proposed Kinder Morgan Improvement Area is an Area in Need Of Redevelopment. 6. Professional Services - Genova, Burns & Vemoia, Re: Ongoing Personnel Matters. 7. Authorizing the Transfer of Surplus Funds. 2 De:arter 6, 2007 8. Authorizing & Directing the Carteret Planning Board to Prepare an Amendment to the West Carteret Commercial Redevelopment Plan. 9. Appointing Donald DeKolf Coordinator of Umpires for the 2007 Men's and Women's Softball League. Mayor Reiman said Don DeKolf was appointed administratively earlier in the year but fell through the cracks. Councilmember Rios asked about Resolution #8 and what it was in reference to. Mayor Reiman responded that this is the West Carteret Retail Commercial District on Roosevelt Avenue. Some of the plans are entered into an agreement with Sitar Encore Real-estate which is the primary property owner in the area. They have requested as part of it, to construct a large scale W A W A or Quick-Check size gas station with their food-mart. Our cun-ent plan does not allow for any gas pumps or any gas station as part of the project. So, to have a W A W A gas station with a mini-mart it will also include two fast food restaurants and perhaps a banIe It makes certain amendments to the plan which we prohibit at the moment. DIS0JSSICN Councilmember Naples asked if#2 was an old case. Mayor Reiman replied yes, this is a pending case on the Minue Street Retail Redevelopment Project in West Cmteret. That project includes a portion of Roosevelt Avenue from Pekola Ten-ace to Orchard Street. This was a case filed in 2005 or maybe 2006. Councilmember Naples asked ifthis was one piece of property. 3 DecEni:B: 6, 2ffJ7 DIS0JSSICN CXl\lIThUD Borough Attorney Bergen said it should be winding down, we should have some dispositions. Councilmember Sitarz asked about #3 and doing a punch list on the light over by Brady's Corner. Do you see how close the double line is by the hardware store? Mayor Reiman replied (inaudible) Roosevelt Ave. Councilman Sitarz said if someone parks there... The Municipal Clerk said they did an Ordinance. The Mayor said it is a County road and they lost parking over there. Councilmember Diaz asked if the curb would be painted yellow or red. The Mayor replied that he would prefer not to but we may have to. If we painted all curbs it will kill the streetscape. He said he has been by and has seen cars parked there in the line of traffic. Councilmember Bellino said they should put the bus stop there (inaudible). The Mayor said they would have T&M Associates go out there and do a further review. Councilmember Bellino said he would like to get back to #2. Is that it next to the catch basin on the comer of Roosevelt Ave.? Mayor Reiman replied yes, it goes all the way down to Pekola. This is the Redevelopment Zone and at that point in time we always said we 4 had no (inaudible) - we're in litigation on that. Any fulther questions should be discussed in Closed Session. The Municipal Clerk explained that she never received the bill list from the Annex. The Mayor said they will do the bill list at the next meeting. REPORTS: 1. Clerk's Office - November 2007. 2. Inspection of Buildings - November 2007. BUSINESS TO BE ADDED: Councilman Diaz had nothing to repott. Councilwoman Naples said she spoke to Mr. Neibert in reference to our staff shortage and there was an incident with the weather this moming. Is there anything we can do with the Park workers, they can do some sort of thing where they can call and pull somebody as needed just for the winter. Weare shott in Buildings & Grounds. CounCilmember Bellino replied that she should call the department heads. If it is a necessity then we have to have it. Councilman Rios asked the Borough Attorney where they were with that street, the dead end that borders Industrial Road. The Borough Attomey replied that he directed John DuPont, Borough Engineer, to get a price to do a meets and bounds description, we need a price to do surveying. Councilman Rios said the Mayor tried to reach out to him. He spoke to Grace Strangio of the Assessor's office; she gave him a Memo and a map as far as the property. The Borough Attomey said there is clearly a void between the wall and the backs of their properties. Mayor Reiman said he is not inclined to spend dollars to go out there. We can remove the fence and tell the people they are responsible. Councilman Rios told the Mayor that there is no fence. They are complaining that the derelicts and different people are hanging out there. They are taking drugs and drinking. According to the map and according to Grace she said no. Bob Kately was sending people there and we thought it was a waste of time and money to send them. Mayor Reiman said if we don't own it there is nothing to vacate. It won't be the first time it wasn't filed con-ectly on the tax map. Are we talking about a five (5) foot or ten (10) foot fence? The tax map does not show an easement. Councilmember Rios replied he didn't think it was more than ten (10) feet. The Mayor asked if any ofthe home owners had a fence. 6 D=nter6,2m7 Councilmember Rios replied that he walked through it, he went through the Credit Union because that it the only way in there. There is a fence that runs perpendicular to the Industrial Road Wall. If you walk through there you'll walk through the property owner's back yard. Councilmember Bellino said to put a fence up there with limited access and block it off. The Mayor replied that is the plan. Bob Kately said it is a long term maintenance issue. Councilmember Bellino said there is poison ivy there and all kind of stuff. Mayor said the only problem with that is that we don't have the ability to force the homeowner to maintain it. How many properties are affected by it? If at the end ofthe day they can pick up 500 square feet of extra property in their backyard and it doesn't cost them anything, it's a no brainier. Councilmember Rios said three or four. PUBLIC DISCUSSION Upon MMS&C by Councilmembers Rios and Naples and unanimous affirmative vote of the five (5) Councilmembers present, the public portion of the meeting was opened. OJ:en Upon MMS&C by Councilmembers Rios and Diaz and unanimous affirmative vote of the five (5) members present, the public portion was closed. Mayor Reiman than asked for a motion to go into a Closed Session to discuss litigation. When we come out of Closed Session we may take action on several Resolutions. RESOLUTION #07-296 was introduced by the Mayor and refened to the Council for action Upon MMS&C by Councilmembers Diaz and Rios RESOLUTION #07-296 "RESOLUTION TO GO INTO CLOSED SESSION" was adopted. Upon individual roll call vote Councilmembers Bellino, Diaz, Naples, Rios and Sitars voted in the affilmative. Councilmember Krum was noted absent. At approximately 5:25 P.M., a Closed Session was held. At approximately 5:38 P.M., after no further discussion, the meeting was opened with the Mayor and. Councilmembers Bellino, Diaz, Naples, Rios and Sitarz present. Councilmember Krum was noted absent. Upon MMS&C, by Councilmembers Rios and Sitarz, the following Resolutions were adopted. Upon individual roll call vote, Councilmembers Bellino, Diaz, Naples, Rios and Sitarz voted in the affirmative.
