HomeMy Public PortalAboutORD14902 BILL NO. 2011-98 SPONSORED BY—Councilwoman Carroll ORDINANCE NO. 1'TJArr - AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE AN AMENDMENT TO THE SOLID WASTE CONTRACT WITH ALLIED WASTE SERVICES. BE IT ENACTED BY THE COUNCIL OF THE CITY OF JEFFERSON, MISSOURI, AS FOLLOWS: Section 1. The City Council hereby authorizes and directs the Mayor and City Clerk to execute an amendment to the Solid Waste Contract with Allied Waste Services dated April 3, 2009, the terms of such amendment to be substantially similar to the attached Exhibit A. Section 2. This Ordinance shall be in full force and effect from and after the date of its passage and approval. Passed: �t4��L. �% 1� Approved: , r er Mayor ATTEST: APPROVED AS TO FORM: City Clerl� `� In Brim City Counselor AMENDMENT TO SOLID WASTE AGREEMENT Whereas the City of Jefferson, Missouri (hereinafter called "City") and Allied Services LLC a Delaware limited liability company (hereinafter called "Contractor" are parties to a Solid Waste Agreement dated April 3), 2009 (hereinafter called"agreement"); and Whereas, City and Contractor are agreeable to the following amendments to the Agreement: Now, therefore, it is agreed as follows: 1. Contractor shall not be required to provide yard waste collection. a. Therefore the following sections of the Agreement are hereby deleted in their entirety: 1) Section 2.2 "Exclusivity of Yard Waste Collection: and 2) Section 2.3 Compost Site; and 3) Section 6.8 Yard Waste. optional; and 4) Section 6.9 Compost Site. 5) Section 11 City Facilities Subsection 3. b. Therefor Section 11.3a of the Agreement is amended by deleting the term "or yard waste" as follows, with the deletions shown by strikeout: "Cart" shall mean a container on wheels whose main purpose is to store solid waste (or recyclables where applicable) prior to its removal by the Contractor and which meets accepted industry standards. 2. Contractor shall not be required to provide collection of Christmas trees at no cost to the customer. Therefore Section 12.6 is deleted in its entirety. 3. Contractor shall not be required to provide collection of collection of Household Hazardous Waste and shall in lieu of this responsibility contribute $5,500 to the City's household hazardous waste program. Therefore Section 10 of the Agreement is deleted in its entirety and replaced with the following: "Contractor shall by April P of each year pay the City $5,500 to be used for the City's household hazardous waste agreement."
