Your proposal includes the removal of the wooden structure and associated debris on tidal water-bottoms.Where appropriate, existing rip rap will be relocated to the existing Bank Stabilization project. The Department authorizes the proposed removal of this structure and has no objection to the action provided Best Management Practices(BMP's)are used.No equipment,materials or debris may be placed, disposed of, or stored in jurisdictional areas. All demolition material must be removed and disposed of in an appropriate upland disposal site. . To document my discussions on the deteriorated dock with you, Ray, the Engineer and most recently with Joe Wilson and Lanny Jarrel at yesterday morning's final site inspection: My work was limited to the upland areas. However, I offer the following caution regarding the dock. The 25' buffer that was to be undisturbed has been mulched with pine straw. This pine straw covering is continuous throughout the site from the sidewalk along HWY 80 to the bluff along the creek. A bark walkway through the 25'buffer has been added that leads from the parking lot to a rear building entrance. It is my opinion that these landscape aesthetic improvements make the dock more attractive to site visitors. The dock is dangerous as it has missing planks and no railing. Joe and I accept the Engineer's certification that the site is in substantial conformance with the approved site plans. We do wish to note the following concerns: 1) While the drainage appears acceptable, the location of the trees on the east side will require more maintenance of the swale than if the plans had been followed. Should any future permits be applied for on this east side, modifications to the previously approved design may be required. 2) We recommend that prior to CO the City have confirmation from the Owner of their understanding of the requirement that mulched areas be inspected as necessary and a minimum of every 6 months and replenished as necessary to maintain a 3" thickness. This applies to both the buffer at the rear and upland areas including the overflow parking lot to the west. 3) The locations of stone and straw is not optimum in the overflow parking lot and does not conform to the sketch provided by the Engineer. It is however acceptable although it increases the probability of mulch restoration. I request Joe Wilson provide concurrence or note exceptions to these statements. My invoice will follow late this evening or early in the morning. This walkway is an increase in impervious area of less than 0.05 acres and therefore not measurable within the accuracy of drainage calculations and as such is not an appreciable amount of impervious area. This measured area is 1/100 of an acre. I accept this explanation of the additional impervious area in the front. However, with no asbuilt ground shots there is no assurance that the area draining to the front has not increased. 2. Topo shots were not included for the area to the east where a swale was planned to be. This is because the project installed a thick landscaped area in this location and also there is a retaining wall to the east of the site which will not allow water to migrate to the existing property. We believe that these two factors will suffice in the place of a swale. Thick landscaped areas also produce runoff. Most importantly, the asbuilt shows the retaining wall to be 4' within the adjacent property to the east. The City cannot approve such use of the retaining wall on the property of others to serve as drainage control for this project without suitable agreement by the adjacent property owner. It is my opinion that suitable agreement would be a recorded drainage easement. 3. The adjacent overflow parking area is yet to be stabilized except by silt fence. The property owner has been given an option of grass, rock or pine straw (to be checked and replenished every 6 months)for the site. He is leaning towards placement of rock. As the adjacent overflow parking lot is part of this project, it must be stabilized suitably. (G) N-M neighborhood marina district . The purpose of this district is to reserve those waterfront areas which have value for commercial land uses involving pleasure and commercial watercraft. The N-M district is intended to be used for neighborhood marina facilities with a modest scale of operation. These facilities shall be developed to be compatible with any adjacent residential properties and shall not be detrimental to persons or property on or off the site. (1) General requirements . A site plan shall be submitted to the planning commission for review and to the mayor and council for approval that meets the requirements of article 5 and contains the following information: a. A document indicating the general operating hours of all activities to be included in the marina and what safeguards are to be used to insure that the marina's activities will not become or represent a nuisance or hazard to the surrounding property owners or tenants thereof. Examples of additional subjects to be covered shall include, but not necessarily be limited to, probable flooding, erosion, fire, explosion and subsidence of the proposed buildings and structures. (2) Design standards . The development plan shall comply with the following standards: a. Access shall be located, designed and improved for safety, convenience, efficient circulation, on the property and minimum interference with normal traffic flow on adjoining streets. Driveways and curb cuts intersecting with public rights-of-way shall be marked and shall not exceed a maximum width of 30 feet. Curbs, blockades, bumper blocks or other devices shall be used to control and channel traffic, to separate pedestrian ways from vehicular ways, and to prevent entry to and from adjoining streets except via a designated driveway. b. Yards shall be provided as required for the adjoining districts and shall be landscaped and improved in a manner appropriate to the residential character of the adjacent district; provided, however, that a street front and residential side setback be a minimum of five feet when a six-foot minimum height solid faced and continuous fence, or other structure with no openings shall be erected and maintained.
