HomeMy Public PortalAbout15760 MC-02 Watson to Edgar Rd Sanitary Relief (10024)ORDINANCE NO. 15760 AN ORDINANCE, declaring the necessity for the acquisition of easements and temporary easements in certain real property within The Metropolitan St. Louis Sewer District for the purpose of construction of sewers and related appurtenances in the project known as MC-02 Watson to Edgar Rd Sanitary Relief (SKME-580A) (10024) in the Cities of Shrewsbury, Webster Groves, and Unincorporated St. Louis County, Missouri to serve the needs of residents of the area, and authorizing staff to proceed with further condemnation efforts related to the project, including but not limited to the purchase and/or the filing of all necessary court pleadings or documents to commence and prosecute formal legal proceedings for the acquisition of said easements and temporary construction easements. WHEREAS, there exists within The Metropolitan St. Louis Sewer District an area of the Cities of Shrewsbury, Webster Groves, and Unincorporated St. Louis County, Missouri within the Mackenzie Creek Watershed wherein numerous people live and work; WHEREAS, sewage gathered from such area will have no adequate means of disposition, and will constitute a menace to public health and welfare of the general public and the residents of The Metropolitan St. Louis Sewer District; and WHEREAS, it is the purpose and design of The Metropolitan St. Louis Sewer District to protect the public health and welfare by construction, reconstruction, maintenance or repair of sewers and related appurtenances on, over, and across said area in order to relieve and alleviate these conditions. NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT: Section One. In order to protect the public health and relieve dangerous conditions, it is necessary to appropriate and acquire by the exercise of eminent domain or otherwise easements and temporary construction easements in real property for the construction of sewers and related appurtenances in the project known as MC-02 Watson to Edgar Rd Sanitary Relief (SKME-580A) (10024) hereinafter set forth, said easements being more particularly described below: Parcel #17 A VARIABLE WIDTH SEWER EASEMENT across the tract of land conveyed to H. M. Bogeman Realty Company by Deed recorded in Book 7679, Page 2200 of the St. Louis County Records, situated within Lot 38 of Kenneth Mackenzie’s Subdivision in U.S. Survey 1953, Township 44 North, Range 6 East, City of Shrewsbury, St. Louis County, Missouri, said tract being more particularly described as follows: BEGINNING at a point on the Eastern line of Missouri State Highway 366 (also known as Watson Road, one-hundred feet wide), at the Northernmost corner of the tract of land conveyed to H. M. Bogeman Realty Company, as aforementioned; THENCE along Bogeman Realty Company’s Northeastern line, South 34 degrees 01 minute 34 seconds West, 31.36 feet to a point; THENCE South 43 degrees 28 minutes 46 seconds East, 5.46 feet to a point; THENCE departing Bogeman Realty Company’s Northeastern line, South 42 degrees 05 minutes 19 seconds West, 40.85 feet to a point; THENCE South 66 degrees 21 minutes 52 seconds East, 37.77 feet to a point on the Western line of the Burlington Northern Railroad; thence along said Western line, South 20 degrees 59 minutes 51 seconds West, 10.01 feet to a point; THENCE departing said Western line, North 66 degrees 21 minutes 52 seconds West, 41.61 feet to a point; THENCE South 43 degrees 01 minute 47 seconds West, 55.46 feet to a point; THENCE North 46 degrees 59 minutes 32 seconds West, 10.04 feet to a point on the Eastern line of Missouri State Highway 366, as aforementioned; THENCE along said Eastern line, Northeastwardly 138.18 feet along a curve to the left, having a radius of 4633.75 feet and a chord bearing North 42 degrees 33 minutes 52 seconds East to the POINT OF BEGINNING, EXCEPTING THEREFROM all that part of the Sewer Easement described in the instrument recorded in Deed Book 1396, Page 1 of the St. Louis County Records, residing therein AND A VARIABLE WIDTH TEMPORARY CONSTRUCTION EASEMENT (TCE #1) across the tract of land conveyed to H. M. Bogeman Realty Company by Deed recorded in Book 7679, Page 2200 of the St. Louis County Records, situated within Lot 38 of Kenneth Mackenzie’s Subdivision in U.S. Survey 1953, Township 44 North, Range 6 East, City of Shrewsbury, St. Louis County, Missouri, said tract being more particularly described as follows: COMMENCING at a point on the Eastern line of Missouri State Highway 366 (also known as Watson Road, one-hundred feet wide), at the Northernmost corner of the tract of land conveyed to H. The TEMPORARY CONSTRUCTION EASEMENTS will become null and void upon completion of the above-described sewer construction. AND TCE #2 being a 20.00 feet wide tract of land being of uniform width and parallel and adjacent to the Northern line of the TEN-FOOT WIDE SEWER EASEMENT defined above, bounded on the east by a line perpendicular to Point “A”, as defined above and bounded on the west by the Western line of Parcel (a), as defined above, EXCEPTING THEREFROM all those parts of the sewer easements described in the instruments recorded in Deed Book 1438, Page 211, Deed Book 1797, Page 498 and Deed Book 2193, Page 164 of the St. Louis County Records. AND Two (2) TWENTY-FOOT WIDE TEMPORARY CONSTRUCTION EASEMENTS across a tract of land being Parcel (b) of those tracts conveyed to Lutheran Senior Services by Deed recorded in Book 12182, Page 2021 of the St. Louis County Records, situated within Lot 35 of Pierre Chouteau’s Subdivision of the Sarpy Tract in U.S. Survey 1953, Township 44 North, Range 6 East, City of Webster Groves, St. Louis County, Missouri, said tract being more particularly described as follows: TCE #2 being a 20.00 feet wide tract of land being of uniform width and parallel and adjacent to the Southeastern line of the VARIABLE WIDTH SEWER EASEMENT defined above, bounded on the east by the Eastern line of Parcel (b), as defined above, and bounded on the south by the Southern line of Parcel (b), as defined above, EXCEPTING THEREFROM all that part of the sewer easement described in the instrument recorded in Deed Book 1440, Page 6 of the St. Louis County Records. AND Two (2) TWENTY-FOOT WIDE TEMPORARY CONSTRUCTION EASEMENTS a part of Lot 24 and the Park of Chestnut Hill, a Subdivision according to the plat thereof recorded in Plat Book 62 Page 26 of said St. Louis County Records, situated within Lot 35 of Pierre Chouteau’s Subdivision of the Sarpy Tract in U.S. Survey 1953, Township 44 North, Range 6 East, City of Webster Groves, St. Louis County, Missouri, said tracts being more particularly described as follows: TCE #1 being a 20.00 feet wide tract of land being of uniform width and parallel and adjacent to the Northwestern line of the SEVENTEEN-FOOT WIDE SEWER EASEMENT defined above, bounded on the north and west by the Northern and Western lines of said Subdivision, EXCEPTING THEREFROM all that part of the easements described in the instruments recorded in Deed Book 1440, Page 9 and Plat Book 62, Page 26. AND TCE #2 being a 20.00 feet wide tract of land being of uniform width and parallel and adjacent to the Southeastern line of the SEVENTEEN-FOOT WIDE SEWER EASEMENT defined above, bounded on the north and west by the Northern and Western lines of said Subdivision, EXCEPTING THEREFROM all that part of the easements described in the instruments recorded in Deed Book 1440, Page 9 and Plat Book 62, Page 26. The TEMPORARY CONSTRUCTION EASEMENTS will become null and void upon completion of the above-described sewer construction. Section Two. Counsel for The Metropolitan St. Louis Sewer District be and is hereby authorized to enter into contracts to acquire by purchase to the extent possible or to continue with the condemnation process by preparing and/or filing all necessary court pleadings and documents to institute and prosecute legal actions in condemnation to acquire all easements for the above-referenced project, pursuant to the provisions of the Charter of The Metropolitan St. Louis Sewer District and the laws of the State of Missouri for the appropriation of private property rights as hereinabove set out. The foregoing Ordinance was adopted on October 14, 2021.
